प्रतिस्पर्धात्मक विद्युत् क्षेत्र

नेपाल विद्युत् प्राधिकरणले औसत प्रतिमेगावाट ३६.४६ करोड रुपियाँ लागतमा जलविद्युत् गृहहरू बनाएको सार्वजनिक भएको छ । जसमध्ये ६० मेगावाटको अप्पर त्रिशूलीको २८.०५ करोड, १४ मेगावाटको कुलेखानी तेस्रोको ३२.३५ करोड र ३० मेगावाटको चमेलियाको ४९ करोड परेछ । तर निजी क्षेत्रले भने औसत प्रतिमेगावाट १६.२२ करोड रुपियाँमा जलविद्युत् आयोजनाहरू निर्माण गरेको रहेछ । जसमध्ये ४२ मेगावाट क्षमताको मिस्त्रीखोलाको १३.४३ करोड, ३.८ मेगावाट क्षमताको सुपर माइ क्यास्केडको १४.६८ करोड, ७.८ मेगावाट क्षमताको सुपरमाइ दोस्रोको १९.०८ करोड र ६.६ मेगावाट क्षमताको रुदी खोला ‘बि’ को १७.७ करोड परेको रहेछ । प्राधिकरणको सहायक कम्पनीले ४५६ मेगावाटको माथिल्लो तामाकोसी आयोजनाको १९.६ करोड पर्‍यो, अनुमानितभन्दा झण्डै ३ गुणा र निजी क्षेत्रभन्दा २० प्रतिशत बढी । सामान्य अवस्थामा महँगो लागतमा निर्मित विद्युत् गृहको बिजुली उपभोक्तालाई महँगो पर्छ भने कम लागतमा सस्तो । किनभने विद्युत् उत्पादन लागत निर्माण लागतमा आधारित हुन्छ र त्यसैबमोजिम उपभोक्ता महसुल निर्धारित हुन्छ । यस्तो अवस्थामा प्रतिस्पर्धात्मक विद्युत् बजार भएको भए महँगो विद्युत् गृहको बिजुली बिक्री हुँदैन वा बिक्री भए पनि उत्पादक घाटामा जान्छ वा मुनाफा निकै कम हुन्छ भने कम लागतमा निर्मित विद्युत् गृहले मुनाफा कमाउँछ । सबै वस्तु–सामग्रीमा लागु हुने अर्थशास्त्रको सामान्य सिद्धान्त हो यो । जुन अधिकांशले बुझेका छन् । धरातलीय यथार्थ विद्युत् क्षेत्रको अवस्था ठीक उल्टो छ । प्राधिकरणले बढी लागतमा विद्युत् गृहहरू निर्माण गरे तापनि गत आर्थिक वर्ष देशमा ८९.५७ अर्ब रुपियाँको बिजुली बिक्री गरेर २१.३८ अर्ब रुपियाँ खुद मुनाफा ग¥यो (भारतसँगको व्यापारमा भएको घाटा कटाएर), जुन बिक्रीको २४ प्रतिशत हो । जबकि ‘कालोबजार तथा केही अन्य सामाजिक अपराध तथा सजाय ऐन २०३२’ को दफा ३ अनुसार २० प्रतिशतभन्दा बढी मुनाफा गरे नाफाखोरी ठहरिन्छ र दण्डनीय हो । २० प्रतिशतभन्दा बढी नाफा लिन नहुनेमा प्राधिकरणले त खुद मुनाफा नै २४ प्रतिशत लियो । स्मरणीय छ, खुद मुनाफा २४ प्रतिशत हुँदा मुनाफाको अनुपात अझ बढी हुन्छ । नाफाखोरी गर्नेलाई उक्त व्यवस्थाअनुसार १ वर्षसम्म कैद वा २ लाख ५० हजार रुपियाँसम्म जरिवाना वा दुवै हुन्छ । सामान्य व्यापारी–व्यवसायीले २० प्रतिशतभन्दा बढी मुनाफा (खुद मुनाफा होइन) लिएको भए थुनामा राखेर कारबाही गरेर कैद नै गरिन्थ्यो वा जरिवाना पक्कै हुन्थ्यो । प्राधिकरणले नाफा २० प्रतिशतभन्दा बढी लिएको नभएर खुद मुनाफा नै २४ प्रतिशत लियो । तथापि प्राधिकरणमाथि कारबाही भएन । अझ प्राधिकरणलाई विद्युत् क्षेत्रमा एकाधिकार प्राप्त छ र एकाधिकार प्राप्त संस्थाले चर्को मूल्यमा बिक्री गरेर उपभोक्ताको दोहन, शोषण गरेर मुनाफाखोरी गर्नु जघन्य अपराध हो । तथापि विद्युत् नियमन आयोगलगायत राज्यका निकायहरू चेतनाशून्य देखिए भने उपभोक्तावादी गैरसरकारी संस्थाहरूले रहस्यमय मौनता अवलम्बन गरे । यो नै विद्युत् क्षेत्रको सबभन्दा ठूलो विकृति विसंगति हो, जसको निराकरण अनिवार्य, अपरिहार्य छ । दफा १८ हाल प्रतिनिधि सभामा विचाराधीन विद्युत् विधेयकको दफा १८ ले यो विकृति विसंगति धेरै हदसम्म निराकरण गर्छ जसअनुसार एउटै संस्थाले विद्युत् उत्पादन, प्रशारण वा वितरण गर्न पाउँदैन । विधेयक संसद्बाट पारित भएपछि प्राधिकरणको एकाधिकार तोडिन्छ र कम लागतमा विद्युत् गृह निर्माण गर्ने उत्पादकबाट उपभोक्ताले सोझै सुपथ मूल्यमा बिजुली किन्न सक्ने प्रतिस्पर्धी बजार स्थापनामा आइ प्राधिकरणको मुनाफाखोरी अन्त्य हुनेछ भने कम लागतमा विद्युत् गृह निर्माण प्रोत्साहित भएर सबै उपभोक्ता र देशको अर्थतन्त्र लाभान्वित हुन्छ । प्राकृतिक एकाधिकार प्राविधिक कारणले प्राधिकरण प्राकृतिक एकाधिकार हो । विद्युत् गृहबाट उत्पादित बिजुली प्रशारण सञ्जाल तथा वितरण सञ्जालबाट उपभोक्तासम्म पुग्छ । प्रत्येक उत्पादकले छुट्टाछुट्टै प्रशारण तथा वितरण सञ्जाल निर्माण गरेर हरेक उपभोक्तालाई बिजुली बिक्री गर्न भौतिकरूपमा असम्भव छ । मोबाइल फोन प्रचलनमा आउनुअघि टेलिफोन सेवामा पनि प्राकृतिक कारणले नेपाल दूरसञ्चार कर्पोरेसनको प्राकृतिक एकाधिकार थियो (कतिपय पाश्चात्य देशमा ल्यान्डलाइन फोनमा समेत एकाधिकार तोडिइसकेको थियो तर यस सम्बन्धमा विवेचना गर्न स्थानाभावको कारण यहाँ सम्भव छैन ।) २०४१ सालमा प्राधिकरण स्थापना हुनुअघि नेपाल सरकारको तत्कालीन विद्युत् विभाग, नेपाल विद्युत् कर्पोरेसन, पूर्वाञ्चल विद्युत् कर्पोरेसन र साना जलविद्युत् विकास समितिसमेत चार वटा छुट्टाछुट्टै संस्था थिए । जसले गर्दा विद्युत् गृह निर्माण लागतको हिसाबले तुलना गर्न सम्भव भएर केही हदसम्म प्रतिस्पर्धा हुन्थ्यो । तर नेपाल विद्युत् प्राधिकरण ऐन २०४१ जारी भएपछि यी चारै संस्था विलय गरिएर प्राधिकरण स्थापना गरियो, जसलाई विद्युत् उत्पादन, प्रशारण तथा वितरणमा एकाधिकार दिइयो । विद्युत् ऐन विद्युत् पूर्वाधार क्षेत्र भए तापनि निजी क्षेत्रलाई आकृष्ट गर्न २०४९ सालमा विद्युत् ऐन ल्याइयो । यसमा विद्युत् उत्पादन, प्रशारण र वितरण गर्न व्यक्ति वा संगठित संस्थाले अनुमतिपत्र पाउने प्रावधान राखियो । लगत्तै सरकारले २०४९ सालको उत्तराद्र्धमा ६० मेगावाटको खिम्ती आयोजनालाई पहिलो अनुमतिपत्र जारी ग¥यो भने प्राधिकरणले २०५० सालको उत्तराद्र्धमा यसका लागि पहिलो विद्युत् खरिद सम्झौता गरेर उत्पादनतर्फ प्राधिकरणको एकाधिकार तोडिन सुरु भयो । अहिले उत्पादनरत, निर्माणाधीन र निर्माण सुरु गर्न लागेकोसमेत झण्डै चार सय निजी कम्पनी अस्तित्वमा आएर बहुलता आइसक्यो । प्रशारणतर्फ निजी क्षेत्रले चासो देखाएन । वितरणतर्फ ९० प्रतिशत उपभोक्तामाथि प्राधिकरणको एकाधिकार छ भने सामुदायिक संस्था र बिपिसीले एकाधिकारसहित १० प्रतिशत उपभोक्तालाई वितरण गर्दैछन् । साथै यही विधेयकको दफा १४ मा पनि उत्पादन, प्रशारण, वितरण आदिका लागि निजी क्षेत्रलाई अनुमतिपत्र दिने व्यवस्थालाई निरन्तरता दिइएको छ । यसरी उत्पादनतर्m प्राधिकरणको एकाधिकार तोडिएर प्रतिस्पर्धाको पहिलो चरणमा विद्युत् क्षेत्र प्रवेश गरिसकेको छ, फलस्वरूप अहिले प्राधिकरण र निजी क्षेत्रबीच विद्युत् गृह निर्माणमा प्रतिस्पर्धा छ, निर्माण लागत तुलना सम्भव भएको छ । एकल क्रेता र एकाधिकार प्राप्त वितरक अहिले निजी क्षेत्रबाट उत्पादित बिजुली कानुनतः अन्यत्र बिक्री गर्न नमिल्ने हुनाले प्राधिकरण एकल क्रेता हो । अर्कोतिर वितरणतर्फ पनि एकाधिकार प्राप्त संस्थाहरू छन् । त्यसैले विद्युत् क्षेत्रमा एकैसाथ एकल क्रेता र एकाधिकार जस्तो वर्णशंकर अवस्था हुनाले थुप्रै विसंगति विकृति देखापरेको छ । जस्तै प्राधिकरणले अत्यन्त महँगोमा विद्युत् गृह निर्माण गर्दा पनि गैरकानुनीरूपमा २०औँ अर्ब खुद मुनाफा गर्छ, तर निजी क्षेत्रले महँगोमा विद्युत् गृह निर्माण गरे तिनीहरू टाट उल्टन्छन् । किनभने प्राधिकरणले उपभोक्ताबाट असुल गर्ने महसुल उसको लागतमा आधारित गरेर विद्युत् नियमन आयोगले निर्धारण गर्छ भने निजी क्षेत्रले महँगो लागतमा विद्युत् गृह निर्माण गरेको अवस्थामा प्राधिकरणले सम्झौतामा तोकिएभन्दा बढी दरमा खरिद गर्दैन र घाटामा जान्छ । प्रतिस्पर्धात्मक थोक बजार विद्युत् क्षेत्रमा प्रतिस्पर्धाको दोस्रो चरणमा बिजुलीको थोक बजारमा प्रतिस्पर्धा प्रादुर्भाव गराइन्छ । यसका लागि विभिन्न भौगालिक क्षेत्रहरूमा छुट्टाछुट्टै वितरण कम्पनीहरू (खुद्रा व्यापारी) स्थापना गरिएर यी वितरकहरू तथा ठूलो परिमाणका खरिदकर्ताहरूले जुनसुकै भूगोलको उत्पादकहरूबाट सोझै प्रतिस्पर्धात्मक थोक दरमा किन्ने व्यवस्था हुन्छ । यो चरणमा प्रशारण सञ्जाल सञ्चालकले थोक बजारको सहजीकरण गर्छ, जसले ह्विलिंग चार्जलगायतका प्रशारण महसुल असुल गर्छ । उदाहरणका लागि सुदूरपश्चिम प्रदेशको कञ्चनपुर जिल्लाका वितरकले कोसी प्रदेशको पाँचथर जिल्लास्थित उत्पादकबाट थोकमा किनेर कञ्चनपुर जिल्लाका ग्राहकलाई वितरण गर्न सक्नेछ । स्मरणीय छ, उत्पादनमा प्रतिस्पर्धा भएर मितव्ययी, प्रभावकारी तथा कार्यकौशलसहित विद्युत् गृहहरू निर्माण हुँदा उत्पादन लागतमा ठूलो कमी आएर थोक दर सस्तिन्छ । अनि सस्तो थोक दरमा वितरकले किनेको बिजुलीमा कानुनतः नाफाखोरी गर्न प्रतिबन्ध हुनाले उपभोक्ताहरूले अहिले भन्दा धेरै कम महसुलमा आआफ्ना क्षेत्रका वितरकबाट किन्न पाउँछन् । प्रतिस्पर्धात्मक खुद्रा बजार अन्तिम चरणमा उपभोक्ताहरू पनि प्रतिस्पर्धामा सहभागी हुन्छन् । प्रशारण सञ्जाल सञ्चालकले थोक बजारको सहजीकरण गरेझैँ अन्तिम चरणमा वितरण सञ्जाल सञ्चालकले खुद्रा बजार सहजीकरण गर्छ, तोकिएको महसुल लिएर । अनि देशभित्रका सबै साना ठूला उपभोक्ताले आआफ्नो भूगोलका वितरकमा मात्र सीमित रहन पदैन । देशभित्रका कुनै पनि उपभोक्ताले प्रतिस्पर्धात्मक दरमा आपूर्ति गर्न सक्ने कुनै पनि वितरकबाट किन्न सक्छन् । यो चरणमा उत्पादकहरू तथा वितरकहरू मात्र भौगालिक सीमामा नबाँधिइने होइन, उपभोक्ता पनि भौगालिक सीमामा बाँधिन पर्दैन । जुनसुकै क्षेत्रको वितरकले अर्को जुनसुकै क्षेत्रको उपभोक्तालाई सुपथ दरमा बिक्री गर्न सक्छ । अर्थात् दोस्रो चरणमा उत्पादकले भौगोलिक क्षेत्रमा सीमित नभएर जुनसुकै क्षेत्रको वितरकलाई थोकमा बिक्री गरेझैँ यो चरणमा वितरकले पनि जुनसुकै क्षेत्रको उत्पादकबाट किनेर जुनसुकै क्षेत्रको उपभोक्तालाई बिक्री गर्न सक्छ । उदाहरणका लागि कोसी प्रदेशको सुनसरीका वितरकले सुदूरपश्चिम प्रदेशको दार्चुलाका उत्पादकबाट बिजुली किन्न सक्छ भने वाग्मती प्रदेशका काठमाडौँका उपभोक्ताले गण्डकी प्रदेशको कास्कीको वितरकबाट बिजुली किन्न सक्छ । अर्थात झापाका वितरकले कास्कीका उत्पादकबाट किनेर बर्दियाका उपभोक्तालाई बिक्री गर्न सक्छ । यो दृष्यपटलमा विद्युत् व्यापारमा पूर्ण प्रतिस्पर्धा सम्भव भएर एकल क्रेताले निजी उत्पादकको शोषण गर्ने र एकाधिकार प्राप्त वितरकले उपभोक्ताहरूको दोहन शोषण गर्ने वर्तमान अवस्थाको अन्त्य हुन्छ । निष्कर्ष प्राधिकरणका केही पदाधिकारी, कर्मचारीहरूको युनियनहरूका साथै केही कर्मचारी, दिग्भ्रमित बुद्धिजीवीलगायतले विधेयकको यो प्रावधानको विरोध गरेको सुनिन्छ । यो प्रावधानबारे समुचितरूपमा बोध नभएकाले विरोध गरेको हुनुपर्छ । यो प्रावधान पूर्णतः कार्यान्वयनमा आएपछि देशका सबै उत्पादक तथा उपभोक्ता लाभान्वित हुने हुनाले प्राधिकरणका कर्मचारी र तिनका परिवारका सदस्यहरू पनि उपभोक्ता नै हुनाले लाभान्वित हुनेमा उनीहरू पनि हुन्छन् र यो प्रावधानको विरोध गर्नु युक्तिसंगत छैन । यसका साथै यी प्रक्रियाबाट विद्युत् गृह निर्माण लागतमा ठूलो कमी आएर विद्युत् महसुल सस्तो हुँदा गार्हस्थ्य उपभोक्ता, विद्युतीय प्रविधि उपयोग गर्ने कृषक, बिजुलीले पानी तानेर सिँचाइ गर्ने किसान, कृषि, वन पैदावार, जडीबुटी आदि प्रशोधन गर्नेसमेतका उद्योगी, पर्यटन व्यवसायी, विद्युतीय परिवहन प्रयोगकर्ता, अत्याधुनिक सञ्चार माध्यम प्रयोग गर्ने शैक्षिक संस्था, इन्टरनेट व्यवसायी, अत्यधिक बिजुली खपत गर्ने ब्यांक तथा वित्तीय संस्था, पत्रपत्रिकालगायतका विद्युतीय सञ्चार माध्यम, मुद्रक आदि सबै लाभान्वित भएर देशको अर्थतन्त्र नै समृद्ध हुन्छ । त्यसैले यो प्रावधान पूर्णरूपमा बुझेर यस्तो सकारात्मक क्रान्तिकारी कदमको सबैले समर्थन गरेर कार्यान्वयन गर्न सहयोग गर्नु जरुरी छ । Unbundling Electricity Sector

Sub-section (1) of Section 18 of the Electricity Bill 2023, which is under active consideration by the House of Representatives, stipulates that a single organization cannot generate, transmit and/or distribute electricity. It means, a power producer cannot transmit or distribute electricity, a transmission company cannot generate or distribute electricity, and a distribution company cannot produce or transmit it. In other words, a generator can only sell the electricity in bulk, the transmission company’s responsibility is limited to operation of transmission infrastructure and transmission of electricity and the distribution company is only to buy bulk electricity from the generator and retail it. Existing institutions Similarly, sub-section (4) of section 18 of the Bill makes it mandatory for vertically integrated institutions currently engaged in electricity generation, transmission and distribution businesses to form separate organizations for generation, transmission and distribution within 5 years. Accordingly, the Nepal Electricity Authority (NEA), which is a vertically integrated institution, will not be able to continue the generation, transmission and distribution 5 years after the Bill is passed by the parliament. Section 6.15.2 of the Hydropower Development Policy 2001 also stipulated that “the functions pertaining to the operation of the power centers, operation of electricity transmission and national grid, and electricity distribution owned by NEA shall be gradually unbundled and appropriate institutional arrangement shall be made therefor.” It also states that an autonomous public body shall be entrusted with the responsibility for the operation of the national grid. It had envisaged that local bodies, community organizations and the private sector shall also be allowed in distribution business. Currently Butwal Power Company (BPC) is also generating electricity and is also distributing it in 4 districts. According to this Bill, BPC too will have to set up separate organizations within 5 years for generation and distribution. This provision has been denounced by certain sections of the populace and some have even started to protest. In this backdrop, a critical assessment of this provision is warranted. Distribution In the last fiscal year, NEA had 5.13 million consumers and 471 community rural electrification entities (CREEs) had 514,000 consumers in 43 districts. Meaning more than 10 percent of the consumers were served by CREEs. Similarly, BPC too generated hydropower from Andhikhola and Jhimruk and retailed it to 62,000 consumers in Syangja, Palpa, Pyuthan and Arghakhanchi districts and sold the remaining to NEA in bulk. CREEs and BPC retail electricity mostly in rural areas. The consumers of CREEs and BPC are not required to spend almost equal to or more than the electricity bill on the bus fare or be absent from work for the whole day in order to travel to pay the bill. Also, the non-technical leakage of these institutions is significantly lower than NEA’s. From this NEA also benefits. Moreover, the problem of unpaid bills under CREEs and BPC is almost nonexistent. Therefore, unbundling of distribution business will be beneficial not only to the consumers, but also to NEA and the country. If all the 753 local bodies are to be allowed to distribute electricity as envisaged by the Policy, the above mentioned benefits would also increase exponentially. From this perspective, the principle enshrined in Section 18 of the Electricity Bill has already been implemented to an extent and its full implementation is in the interest of consumers, the sector and the country. Transmission NEA is currently operating the existing 66 kV, 132 kV, 220 kV and 400 kV transmission infrastructure and is also engaged in constructing new transmission lines of different capacities. Moreover, the Rastriya Prasaran Grid Company Limited was established in 2018 by GoN to transmit and evacuate electricity; also, to collect revenue like wheeling charges, royalties, etc. from the users of the grid. This provision is in line with the Electricity Bill and the Policy. Generation Total generation capacity last year was 2,684 MW, of which NEA owned 583 MW hydropower, 53 MW of thermal and 25 MW solar power. NEA’s subsidiaries, with investment from the general public generated 478 MW hydropower. Similarly, Independent power producers (IPPs) generated 1,477 MW hydropower, 62 MW solar power and 6 MW from bagasse. In other words, of the total electricity generation, NEA generated 662 MW and NEA’s subsidiaries with general public investment and IPPs together generated 2,023 MW. Therefore, only 25% electricity was generated by NEA while 75% electricity was generated with the private sector investment. Besides NEA, 2 subsidiaries of NEA with investment from the general public and 157 IPPs had generated electricity. In other words, NEA generated 25% electricity, while 159 organizations with private investment generated 75%. Moreover, 3 subsidiaries of NEA and 3 more with investment from the general public are constructing power plants, while 114 IPPs are constructing hydropower plants and 4 IPPs are constructing solar power projects. Further, 106 IPPs and 1 subsidiary of NEA are awaiting financial closure. Hence, there are in total 391 organizations in generation business, some already generating, some constructing power plants and some awaiting financial closure. From this, it becomes clear that NEA does not enjoy monopoly over electricity generation business anymore and multiplicity has come to exist in it. Furthermore, Vidyut Utpadan Company Limited was established in 2016 by GoN, with 29 percent shares from project-affected local people, under-privileged and general public. Of course, the proportion of electricity generated by NEA will become very small in the near future. Hydropower construction cost In view of the multiplicity in the generation business, construction cost should be compared. The Auditor General's Office in its 60th report had pointed out that the average construction cost of IPPs was Rs 162.2 million per MW while it cost Rs 364.6 million/MW to NEA; more than double. The construction cost of hydropower projects of IPPs was Rs 134.3 million/MW for 42 MW Mistrikhola, Rs 146.8 million for 3.8 MW Super Mai Cascade, Rs 198 million/MW for 7.8 MW Super Mai II and Rs 177 million/MW for 6.6 MW Vindhyavasini. While it cost NEA Rs 285 million/MW for Upper Trishuli, Rs 323.5 million/MW for 14 MW Kulekhani III and Rs 490 million/MW for 30 MW Chamelia. NEA blamed COVID19 pandemic and repeated lockdowns for the cost overrun. But, both NEA and IPP projects were commissioned during the same period. Whereas, NEA had begun construction of Upper Trishuli in 2011, Kulekhani III in 2010 and Chameliya in 2005. Moreover, Upper Tamakoshi project, 456 MW, built by NEA’s subsidiary with investment from the general public cost Rs 196 million/MW, which initially was described as the most attractive project and was estimated to cost only Rs 77 million/MW. But it ended up costing nearly 3 times the estimate, and 20% more than IPPs. According to the theory of economies of scale, larger projects should cost relatively less than smaller ones. Although NEA and its subsidiaries have constructed relatively large projects, the cost of IPP projects are substantially lower; in direct contrast to the principle of economies of scale. By allowing IPPs to construct power projects, NEA’s high cost of construction has been exposed. It becomes clear from this analysis that compared to NEA and its subsidiaries, the IPPs are more economic, efficient and effective. From the perspective of the country, its people and the economy, if hydropower projects are constructed at lower cost, electricity generation cost in turn would be substantially lower and, therefore, retail tariff too would be lower. Nepal Electricity Regulatory Commission takes the construction/generation cost into account when fixing electricity tariff. From this perspective, section 18 of the Electricity Bill is in the interest of the country, the people and the economy. Conclusion Unbundling of NEA into generation, transmission and distribution businesses should not be equated with partitioning of that empire in the lines of creation of Kathmandu, Lalitpur and Bhaktapur states after the death of Yaksha Malla, last king of unified Nepal Mandal in 1538. Unbundling is not the disintegration of NEA, rather it is the spinning off of specialized entities to do generation, transmission and distribution businesses separately. Currently anomalies and distortions have crept in the vertically integrated entity involved in the disparate nature of businesses. Large scale industries too specialize in production only and they do not involve in transportation of their production, nor do they retail it. It is now clear that unbundling will benefit the consumers, the country's economy and the related organizations. Once the generation, transmission and distribution businesses are unbundled, it could be easily determined how much electricity was handed over for transmission by the generator, how much electricity was received and transmitted by the transmitter and how much electricity received from the transmitter was distributed to the consumers. It would afford a double entry bookkeeping system and would help determine how much and where leakages occurred, and help eradicate it. The provision in the Bill to provide value added water and lean season augmented flow to downstream countries free of cost is anti-national. Whereas, the provision related to unbundling is in national interest. दफा १८ को अन्तर्य

प्रतिनिधि सभामा विचाराधीन विद्युत विधेयक २०८० को दफा १८ को उपदफा (१) मा एउटै संस्थाले विद्युत उत्पादन, प्रशारण र÷वा वितरण गर्न नपाइने व्यवस्था छ । यसले गर्दा विद्युत उत्पादकले प्रशारण र÷वा वितरण गर्न पाउँदैन, प्रशारकले उत्पादन र÷वा वितरण गर्न पाउँदैन र वितरकले उत्पादन र÷वा प्रशारण गर्न पाउँदैन । अर्थात उत्पादकले उत्पादित बिजुली थोकमामात्र बिक्री गर्न पाउँछ भने, प्रशारकको जिम्मेवारी प्रशारण संजालमार्फत विद्युत प्रशारण गर्ने मात्र र वितरकले उत्पादकबाट थोकमा बिजुली किनेर उपभोक्ताहरुलाई बिक्री गर्ने मात्र हुन्छ । विद्यमान संस्थाहरु उक्त दफाको उपदफा (४) मा यस अघि कुनै एउटै संस्थाले उत्पादन, प्रशारण तथा वितरण समेतका कामहरु गरिरहेको भए ५ वर्ष भित्र उत्पादन, प्रशारण तथा वितरणको लागि अलग अलग संस्था गठन गर्नु पर्ने बाध्यात्मक व्यवस्था छ । यस अनुसार नेपाल विद्युत प्राधिकरणले एकिकृतरुपमा गर्दै आएको उत्पादन, प्रशारण र वितरणको कामलाई ५ वर्ष पछि निरन्तरता दिन नपाउने हुन्छ । हुन त, प्राधिकरणले एकिकृतरुपमा गर्दै आएका कामहरु अलग्याउने भनेर २०५८ सालमा जारी गरिएको जलविद्युत विकास नीतिको दफा ६.१५.२ मा पनि उल्लेख थियो र विद्युत वितरण प्रणालीको संचालनमा स्थानिय निकाय, सामुदायिक संस्था तथा निजी क्षेत्रलाई प्रोत्साहित गर्ने उल्लेख छ । यसै अनुसार उत्पादन तथा वितरणको काम गर्दै आएको बुटवल पावर कम्पनीले पनि उत्पादन तथा वितरणको काम ५ वर्षभित्र छुट्टाछुट्टै संस्थाहरुबाट गर्नु पर्ने हुन्छ । उक्त विधेयकमा भएको यो व्यवस्थाको विरोधमात्र भएको छैन, एक तप्का विशेषले आन्दोलन समेत ग¥यो । यस पृष्ठभूमिमा यो व्यवस्थाको विवेचना वान्छनिय छ । वितरण व्यवसाय गत आर्थिक वर्ष प्राधिकरणले जम्मा ५१ लाख ३४ हजार उपभोक्तालाई विद्युत वितरण गरेको थियो । अनि ४३ जिल्लामा ४ सय ७१ सामुदायीक संस्थाहरुले ५ लाख १४ हजार उपभोक्तालाई विद्युत वितरण गरेको थियो; जम्मा उपभोक्ताहरुको १० प्रतिशत भन्दा बढी । त्यस्तै बुटवल पावर कम्पनीले आफ्नो उत्पादन मध्ये स्यांग्जा, पाल्पा, प्युठान र अर्घाखाँची जिल्लामा ६२ हजार उपभोक्ताहरुलाई वितरण गरेर बाँकी बिजुलीमात्र प्राधिकरणलाई थोकमा बिक्री ग¥यो । समग्रमा जम्मा ग्राहक संख्या ५१ लाख ९६ हजार रहेकोमा प्राधिकरण बाहेकले झंडै १२ प्रतिशत विद्युत वितरण गरेछ; अधिकांश ग्रामिण ग्राहस्थ्य उपभोक्ता । यी संस्थाहरुले विद्युत वितरण गर्दा उपभोक्ताहरुले तिर्नु पर्ने महशूल बराबर वा बढी बसमा खर्चेर वा दिन भरको काम छाडेर महशूल तिर्न जानु परेन । साथै प्राधिकरणको ग्रामिण क्षेत्रमा विद्युत वितरणमा भन्दा यी संस्थाहरुका अप्राविधिक चुहावट तात्विकरुपमा कम छ, जसबाट प्राधिकरणपनि लाभान्वित भएकोछ । साथै महशूल बक्यौताको समस्यापनि निराकरण भएको छ । जलविद्युत विकास नीति २०५८ ले अवलम्बन गरेको नीति अनुसार ७ सय ५३ वटै स्थानिय निकायहरुलाईपनि विद्युत वितरण गर्न दिएको खंडमा माथि वर्णित लाभको मात्रामा बढेर उपभोक्ता, प्राधिकरणको साथै देशलाई फाइदा हुन्छ । स्पष्टतः विद्युत विधेयकको दफा १८ मा अन्तरनिहित सिद्धान्त केही हदसम्म अहिल्यै कार्यान्वयनमा आइ सकेको छ । प्रशारण व्यवसाय प्राधिकरणले हाल विद्यमान ६६ केभी, १३२ केभी, २२० केभी र ४०० केभी क्षमताका प्रशारण लाइन, सबस्टेशन इत्यादि संचालन गरेर विद्युत प्रशारण व्यवसाय संचालन गर्दैछ र बिभिन्न क्षमताका नयाँ प्रशारण लाइनहरु पनि निर्माण गराउँदैछ । यस अतिरिक्त सरकारले प्रशारणको काम गर्न २०७२ सालमा राष्ट्रिय ग्रिड कम्पनी लिमिटेड स्थापना गरेको छ, जसको प्रमुख काम देशमा उत्पादित सम्पूर्ण बिजुली बिभिन्न केभीका प्रशारण लाइनहरुबाट प्रवाह गर्ने, सो कार्य गरे बापत ह्विलिंग चार्जलगायतका राजश्व संकलन गर्ने, इत्यादि हो । जुन प्रस्तुत विधेयकको दफा १८ र जलविद्युत नीतिको दफा ६.१५.२ संग तादात्म्य राख्छ । उत्पादन व्यवसाय गत आर्थिक वर्ष जम्मा विद्युत उत्पादन क्षमता २ हजार ६ सय ८४ मेगावाट रहेकोमा प्राधिकरणको स्वामित्वमा जलविद्युत ५ सय ८३ मेगावाट, पेट्रोलियम पदार्थमा आधारित ५३ मेगावाट र सौर्य उर्जा २५ मेगावाट रहेकोमा प्राधिकरण र सर्वसाधारणको संयुक्त लगानीबाट गठित सहायक कम्पनीहरुबाट ४ सय ७८ मेगावाट जलविद्युत र निजी क्षेत्रबाट १ हजार ४ सय ७७ मेगावाट जलविद्युत, ६२ मेगावाट सौर्य उर्जा र ६ मेगावाट जैविक उर्जा छ । अर्थात जम्मा विद्युत उत्पादन क्षमता मध्ये प्राधिकरणको स्वामित्वमा उत्पादन क्षमता जम्मा ६ सय ६२ मेगावाट र निजी क्षेत्रको लगानी सहित जम्मा उत्पादन क्षमता २ हजार २३ मेगावाट हुनाले प्राधिकरणले २५ प्रतिशतमात्र विद्युत उत्पादन ग¥यो भने निजी क्षेत्रसमेतको लगानीबाट ७५ प्रतिशत बिजुली उत्पादन भयो । सर्वसाधारणको पनि लगानी रहेका प्राधिकरणका २ वटा सहायक कम्पनीहरुले विद्युत उत्पादन गर्दैछन् भने निजी तर्फ १ सय ५७ वटा संस्थाले बिजुली उत्पादन गरे । अर्थात एउटा प्राधिकरणले २५ प्रतिशत बिजुली उत्पादन गरेकोमा १ सय ५९ वटा निजी क्षेत्र संलग्न संस्थाहरुले ७५ प्रतिशत बिजुली उत्पादन गरे । यसबाट विद्युत उत्पादनतर्फ प्राधिकरणको एकाधिकार कायम नरहेको र यो क्षेत्रमा बहुलताको प्रादुर्भाव भइ सकेको प्रष्टिन्छ । यस अतिरिक्त प्राधिकरणका ३ वटा सहायक कम्पनी र निजी क्षेत्रको लगानी रहेको थप ३ वटा प्राधिकरणका सहायक कम्पनीहरु पनि विद्युत आयोजना निर्माण गर्दैछन् भने निजी क्षेत्रमात्रको लगानीमा १ सय १४ वटा जलविद्युत आयोजनाहरु निर्माणाधीन छन् भने सौर्य उर्जातर्फ ४ वटा निजी कम्पनी आयोजना निर्माण गर्दैछन् । साथै १ सय ६ वटा निजी क्षेत्रका कम्पनी र प्राधिकरणको १ वटा सहायक कम्पनी पनि विद्युत आयोजना निर्माण शुरु गर्न वित्तीय व्यवस्था गर्दैछन् । यसरी विद्युत उत्पादनरत, निर्माणाधीन आयोजना र निर्माण शुरु गर्न लागेको समेत जम्मा ३ सय ९१ वटा कम्पनी उत्पादन क्षेत्रमा देखा परि सकेका छन् । यस अतिरिक्त सरकारले २०७३ सालमा आयोजना प्रभावित, वञ्चितिकरण परेका र सर्वसाधारणको २९ प्रतिशत शेयर रहने गरेर विद्युत उत्पादन कम्पनी लिमिटेड नामको संस्था स्थापना पनि गरिसकेकाछ । अर्थात केही वर्षमा नै प्राधिकरणले उत्पादन गर्ने बिजुलीको अनुपात धेरै सानो हुनेछ । उत्पादन लागत विद्युत उत्पादन तर्फ बहुलता प्रादुर्भाव भएको परिप्रेक्ष्यमा प्राधिकरण, निजी क्षेत्रको लगानीसहितको प्राधिकरणका सहायक कम्पनी र निजी क्षेत्रले विद्युत आयोजना निर्माण गर्दा लागेको लागतको विवेचना वान्छनिय छ । महालेखापरीक्षकको कार्यालयको ६० औं प्रतिवेदनमा निजी क्षेत्रले औसत प्रति मेगावाट १६ करोड २२ लाख रुपियाँ लागतमा जलविद्युत आयोजनाहरु निर्माण गरेकोमा प्राधिकरणको औसत निर्माण लागत ३६ करोड ४६ लाख रुपियाँ भएको तथ्य औंल्याएको थियो । निजी क्षेत्रले निर्माण गरेको ४२ मेगावाट क्षमताको मिस्रीखोला जलविद्युत् आयोजनाको लागत प्रतिमेगावाट १३ करोड ४३ लाख, ३.८ मेगावाट क्षमताको सुपर माई क्यास्केडको १४ करोड ६८ लाख, ७.८ मेगावाट क्षमताको सुपरमाई दोस्रो १९ करोड ८ लाख र ६.६ मेगावाट क्षमताको विन्ध्यवासिनी हाइड्रोको १७ करोड ७० लाख रहेको उल्लेख छ । प्राधिकरणले निर्माण गरेको ६० मेगावाटको अप्पर त्रिशूलीको प्रतिमेगावाट लागत २८ करोड ५ लाख, १४ मेगावाटको कुलेखानी तेस्रोको ३२ करोड ३५ लाख र ३० मेगावाटको चमेलियाको ४९ करोड लागत प¥यो भनिएको छ । लागत बढी परेको सम्बन्धमा प्राधिकरणले देशमा कोभिडको महाव्याधि फैलिएको र त्यसको कारणले पटक पटक लगाइएको लकडाउनलाई दोष दियो । स्मरणीय छ, निजी क्षेत्रले पनि सोहि अवधिमा माथि उल्लिखित आयोजनाहरु निर्माण गरेको हो भने प्राधिकरणले त अप्पर त्रिशूलीको २०६८ सालमा, कुलेखानी तेस्रोको २०६७ सालमा र चमेलिया त २०६२ सालमा नै निर्माण शुरु गरेको हो भने यी उल्लिखित प्राधिकरण र निजी क्षेत्रका आयोजनाहरु एउटै अवधिमा संचालनमा आएका हुन् । यस अतिरिक्त प्राधिकरणको सहायक कम्पनी अप्पर तामाकोशी हाइड्रोपावर लिमिटेडले निर्माण गरेको (एक समयमा धेरै आकर्षक भनिएको) ४५६ मेगावाटको माथिल्लो तामाकोशी आयोजनाको अनुमानित लागत ७ करोड ७० लाख रुपियाँ प्रति मेगावाट भएकोमा १९ करोड ६० लाख खर्च भयो, अनुमानित लागतको झंडै ३ गुणा, जुन निजी क्षेत्रको औसत लागत भन्दा २० प्रतिशत बढी । अर्थशास्त्रको सिद्धान्त अनुसार ठूला आयोजनाको लागत सापेक्षरुपमा सानाको भन्दा कम हुनु पर्छ । प्राधिकरण र यसका सहायक कम्पनीले सापेक्षरुपमा निजी क्षेत्रभन्दा ठूला आयोजनाहरु निर्माण गरे तापनि निजी क्षेत्रको औसत लागत प्राधिकरण र यसका सहायक कम्पनीको लागत भन्दा कम हुनाले अर्थशास्त्रको सिद्धान्तको ठीक विपरित भएको छ । यदी निजी क्षेत्रलाई विद्युत उत्पादन अनुमति दिने व्यवस्था नभएको भए यसरी तुलना गर्न सकिने थिएन र प्राधिकरणले सापेक्षरुपमा भन्दा बढी लागतमा विद्युत आयोजना निर्माण गरेको सम्बन्धमा खुलासा हुने थिएन । यो विवेचनाबाट के प्रष्ट हुन्छ भने जलविद्युत आयोजनाहरु निर्माण गर्न निजी क्षेत्रको तुलनामा प्राधिकरण र यसको सहायक कम्पनीहरु मितव्ययीता, कार्यकौशल र प्रभावकारीताको कसीमा अक्षम देखियो र यसको लागि आवश्यक दक्षता प्राधिकरण र त्यसको सहायक कम्पनीमा अभाव रहेछ । समग्र देशको हितको हिसाबले कम लागतमा जलविद्युत आयोजना निर्माण गरिएमा विद्युत उत्पादन लागत कम भएर उपभोक्तालाई सस्तो दरमा बिजुली बिक्री गर्न सकिन्छ । स्मरणीय छ, विद्युत नियमन आयोगले महशूल निर्धारण गर्दा निर्माण लागतलाई दृष्टिगत गर्दछ र प्राधिकरण र यसका सहायक कम्पनीको निर्माण लागत बढी हुनाले नै महशूल महँगो भएको हो । यो दृष्टिकोणबाट पनि यो विधेयकको दफा १८ देश, जनता र अर्थतंत्रको हितमा देखिन्छ । निष्कर्श एकिकृतरुपमा विद्युत उत्पादन, प्रशारण, वितरणमा गर्न नपाउने भनेको तत्कालिन एकिकृत नेपाल मण्डल (देश)का अन्तिम राजा यक्ष मल्लको १५३८ सालमा देहान्त पछि उनका छोराहरुले नेपाल मण्डल टुक्र्याएर येँ (काठमाडौं), यलः (पाटन) र ख्वपः (भादगाउँ) नामक छुट्टाछुट्टा राज्यहरु खडा गरे जस्तो प्राधिकरण नामको साम्राज्यको विखण्डिकरण गरिने होइन । यो त विद्युत उत्पादन, प्रशारण तथा वितरण जस्ता छुट्टाछुट्टा प्रकृतिका व्यवसाय एउटै संस्थाले गर्दा भएका विसंगति र विकृतिको अन्त्य गर्न व्यवसायको प्रकृति अनुसारका छुट्टाछुट्टा संस्थाले व्यवसाय संचालन गर्दा उपभोक्ता, देशको अर्थतंत्र र सम्बन्धित संस्थालाई लाभान्वित गराउने प्रावधान हो । उत्पादन, प्रशारण तथा वितरण गर्ने संस्थाहरु छुट्टाछुट्टै भएमा उत्पादक संस्थाले कति बिजुली प्रशारण गरायो, प्रशारण गर्ने संस्थाले कति बिजुली उत्पादकबाट प्राप्त गरेर वितरक संस्थाहरुलाई उपलब्ध गरायो र प्रशारित कति बिजुली वितरकले प्राप्त गरेर उपभोक्तालाई वितरण ग¥यो भन्ने छुट्टाछुट्टै अभिलेख राखिएर दोहरो हिसाब किताब रहने हुनाले के कति कहाँ कसरी चुहावट भयो भन्ने समेत सरलरुपमा यकिन सम्भव भएर समग्र अर्थतंत्र सुदृढ बन्दछ । प्रस्तुत विधेयकको केही व्यवस्थाको कारण नेपालका नदी दोहन गरेर वर्षायाममा मूल्य अभिवृद्धि गरिएको पानी देखि सुख्खायाममा थप÷नियन्त्रित पानी तथा बाढी नियन्त्रणको लाभ तल्लो तटीय देशलाई निःशुल्क उपलब्ध गराउने राष्ट्रघाती अवस्था बनेको छ, जुन निकृष्ट व्यवस्था हो । अर्कोतिर यो विधेयकमा राम्रा व्यवस्थहरुापनि छन् र जस मध्ये एकिकृतरुपमा Retrogressive Bill Compared to Koshi/Gandak Treaties

In order to test if Electricity Bill 2080 is in national interest, a comparison between this Bill and Koshi/Gandak treaties signed in 1950s with India is warranted, which will enable to discern the water resource harnessing policy enshrined in this Bill. Most of Nepal’s politicos, bureaucrats, intellectuals, etc. mistakenly believe that use of rivers is limited to electricity generation. In reality, important uses of rivers are drinking water, irrigation, animal husbandry and fisheries. Because homo sapiens have survived without electricity since eons and a substantial number of people are still surviving without electricity even now. However, people cannot survive without drinking water and eating, production of food requires water for irrigation. River water is used for irrigation by spatial transfer (diverting river in rainy season) and also by temporal transfer (storing river water in a reservoir behind a dam and releasing it in dry season). From both spatial and temporal transfer, lower riparian areas benefit from flood control and by receiving value added water, both together called positive externalities. There are international precedents under which downstream beneficiary nations have paid upper riparian nations for positive externalities. In 2020 South Africa paid Lesotho for supplying water at the rate of $ 2.789 million per cumecs. Latter had built physical structures on the Senqu River to supply water to the former under a treaty signed in 1986. Such water is deemed to be value added water. Similarly, under Columbia Treaty, USA was afforded flood control benefit by Canada, where physical structures were built, and former had paid $ 64 million for 60 years in 1964 to latter for the benefit; the treaty is subject to renewal in 2024. Flood control benefit to lower riparian areas entails negative externalities like inundation of valuable land and involuntary displacement of populace of upper riparian area. This Bill is compared with Koshi/Gandak treaties in the light of these two international precedents below. Koshi treaty Koshi River was renowned as “sorrow of Bihar”. It used to flow near Purnia in Bihar province of India 200 years ago and now it flows near Nirmali, after shifting 133 kilometers east. As it was not possible to build physical structures in India to control floods, she had been trying to build physical structures in Nepal for a long time. Bir Shamsher Rana, the then Prime Minister of Nepal, had consented to Indian proposal to build a barrage in Chatara in 1897, which got shelved. Again in 1947 the then prime minister of Nepal, Padma Shamsher Rana agreed to allow India to build a barrage near Barahchhetra. This too was not implemented. Finally, first commoner prime minister of Nepal, Matrika Prasad Koirala signed the Koshi treaty in 1954 and under which Koshi River was diverted to irrigate about 1 million hectares in Bihar, and also to control floods there. But there was no provision to irrigate even a small parcel of land in Nepal. While Nepal suffered negative externalities. Simply because India had invested in the project, she has appropriated positive externalities for 6 decades already without paying a rupee to Nepal. Nepal is still suffering from inundation and involuntary displacement every rainy season, besides the land which is submerged due to the barrage. Hence, this treaty is against Nepal’s national interest. Gandak treaty British India had planned to construct physical structures there to irrigate in UP and Bihar from the Gandak river and control flood in 1874, when Jang Bahadur Rana was prime minister in Nepal; which wasn’t implemented. In 1903 construction of a canal network commenced, when Chandra Shamsher Rana was prime minister in Nepal, which was called Tribeni canal system; it became operational in 1909, but was ineffective. Because without building a barrage in Nepal, spatial transfer of water from Gandak River is not possible. Hence, irrigation from Gandak did not materialize for 9 decades since the time the idea was conceived. In 1956 Nepal’s prime minister Tanka Prasad Acharya turned down an Indian request to sign the Gandak treaty. When India repeated it to prime minister Dr. K.I. Singh in 1957, he constituted an Enquiry Commission which came up with seventeen conditions, which were inter alia Nepal to have full right on water upstream of the barrage, India to pay Nepal at the rate of one rupee per acre of land irrigated (Nepal expected to earn Rs 2.5 million/year: equivalent to US $ 525,000 at that time, which is equal to US $ 5.75 million at 2023 price level), and so forth. This time India refused. This treaty was signed in 1959 when B.P. Koirala became Nepal’s first elected prime minister, ignoring the fact that the Acharya government had refused to sign it and the Singh government had imposed 17 conditions. India irrigates 3.4 million hectares. Although Nepal was supposed to receive 40 cusecs to irrigate 143,500 acres (58,000 hectares), we receive very little water, while India also benefits from flood control. Merely because India bore the cost, she has hogged positive externalities for 6 decades without paying anything to Nepal, while Nepal suffered from negative externalities due to construction of the barrage and suffers more flooding every rainy season. Hence, this treaty too is anti-national. Reservoir project Only rainy season water is diverted from Koshi and Gandak barrages for irrigation in India. In other words, India receives value added water only in the rainy season (about 4 months) from these barrages. There is provision for construction of reservoir projects in this Bill. If reservoir projects like Budhi Gandaki, Sapta Koshi High Dam, Karnali Chisapani High Dam are built in Nepal in the guise of hydropower projects, India would stand to receive water not only in the rainy season but also in the dry season (about 8 months). It would mean water would be availed to India for multiple crops, more than 4 crops/year. Meaning, if this Bill is passed by the parliament without requisite amendments, India would not only benefit from flood control in the rainy season, but also would receive value added water around the year. Unfortunately, there is no provision in the Bill to receive payment for flood control benefit and value added water that India stands to receive in accordance with extant international precedents. Budhi Gandaki reservoir project, 1,200 MW, can be cited as an example. The value of electricity generated by it would amount to US $ 124.75 million at US 5 cents/kWh, while the value of just lean season augmented flow is US $ 390.5 million per year (Rs 52 billion/year at current exchange rate). Since the Bill is silent about recovering the value of lean season augmented flow from the beneficiary, India stands to receive such value added water for free from this and all reservoir projects. Similarly, India would also benefit from flood control from most of the reservoir projects that would be built in Nepal. Unfortunately, this Bill is also silent about receiving payment for flood control benefits based on international precedents. On the other hand, Nepal would suffer from inundation of land and involuntary displacement if reservoir projects are built. But there is no provision in this Bill to receive recompense for such negative externalities from India that benefits from positive externalities. Inundation entails opportunity cost in terms of lost agricultural produce and forest product from inundated agricultural land and forest for the life of the reservoir. Similarly, involuntary displacement will require Nepal to bear the cost of resettlement and rehabilitation. Anti-national Bill It becomes obvious from the above discussion that this Bill is not in Nepal’s national interest. Two separate treaties had to be signed to provide flood control and irrigation benefits to India from Koshi and Gandaki rivers. But if this Bill is passed without any amendment, no such treaty will have to be signed and India will receive regulated water not only in the rainy season but also in dry season with the construction of each reservoir project in Nepal, including flood control benefit without having to pay a rupee. India may not even have to invest to receive such positive externalities, if projects were to be built in the lines of Budhi Gandaki at Nepal’s own cost. Therefore, this bill is retrogressive even compared to Koshi and Gandak treaties. Denounce anti-national activity The then president of Nepali Congress, B.P. Koirala had denounced Koshi treaty, signed by his elder brother’s government being detrimental to Nepal and Ganesh Man Singh had opined that the treaty amounted to national suicide. When an Indian parliamentary delegation came to visit Nepal to quell the protest, the protesters blocked Kathmandu airport, which was forcibly opened by the army. Number of protesters including Mrigendra Shamsher, a Leader of Gorkha Dal were arrested in this episode. Six months before his death, even Matrika Koirala confessed that the Koshi treaty was detrimental to Nepal. Gandak treaty was signed when B.P. Koirala was prime minister and Ganesh Man Singh was construction, communication and canal minister; the duo that had denounced the Koshi treaty. The Gandak treaty was also denounced as anti-national and the communist party lodged a complaint with the Indian embassy, called general strike and celebrated black day. GoN has tabled this Bill which is a lot more damaging to Nepal than Koshi and Gandak treaties. But not a single word of protest was heard in the parliament, neither from the intelligentsia as regards the anti-national nature of this Bill, which is highly surprising. In the 1950s people rose up against Koshi and Gandak treaties. It is surprising that people have been apathetic to anti-national activity in the twenty-first century. Conclusion All legislation prepared for promulgation in Nepal should benefit the country, her people and the economy. But it is clear from the above discussion that this Bill is formulated to benefit India and harm Nepal’s national interest. कोशी/गण्डक सन्धिभन्दा पश्चगामी विधेयक

विद्युत विधेयक, २०८० प्रतिनिधि सभामा विचाराधीन छ । क्रमसः २०११ र २०१६ सालमा नेपाल र भारत सरकारहरुका बिच सम्पन्न कोशी र गण्डक सम्झौताहरुसंग यो विधेयक तुलना गर्दा यस विधेयकले विद्युत विकासको नाममा नेपालको जलस्रोत दोहन गर्न अवलम्बन गरेको अन्तरनिहित नीति प्रष्टिन्छ । यस सम्बन्धमा के स्मरणीय छ भने नदीमा बगेको पानीको उपयोग बिजुली उत्पादनमा मात्र सीमित हुँदैन । पानी पिउनाको साथै, खाद्यान्न आदि उत्पादन गर्न नदीमा भौतिक संरचना बनाएर नदीको बहाव परिवर्तन (पथान्तरण) गरेर सिंचाइ गरिन्छ भने मत्स्य तथा पशुपालन, उद्योग संचालन, आदि गर्न पनि पानी आवश्यक हुन्छ । यसका साथै नदीमा बाँध बनाएर तल्लो तटीय इलाकामा बाढी नियन्त्रण पनि गरिन्छ । यसरी प्राप्त गरिने मूल्यअभिवृद्धि गरिएको पानी र बाढी नियन्त्रणको लाभ बापत मूल्य तिरिएको अन्तरराष्ट्रिय नजीरहरु छन् । लेसेथोले आफ्नो देशमा बग्ने सेन्कु नदीमा भौतिक संरचना बनाएर उक्त नदीको पानी पथान्तरण गरी दक्षिण अफ्रिकालाई उपलब्ध गराए बापत सन् २०२० मा १ क्युमेक पानीको वार्षिक २७ लाख ८९ हजार अमेरिकी डलरको दरले रकम पाएको नजीर छ । किनभने भौतिक संरचना निर्माण गरेर पथान्तरण गरिएको पानी भनेको मूल्यअभिवृद्धि गरिएको पानी हो । यस्तै क्यानाडामा कोलम्बिया नदीमा भौतिक संरचना निर्माण गरेर संयुक्त राज्य अमेरिकालाई बाढी नियन्त्रणको लाभ उपलब्ध गराए बापत सन् १९६४ मा मा ६० वर्षको लागि ६ करोड ४० लाख डलर भुक्तानी पाएको नजीर छ र सन् २०२४ मा उक्त सम्झौता नविकरण हुँदैछ । तल्लो तटीय देशमा बाढी नियन्त्रण गर्न माथिल्लो तटीय देशमा भौतिक संरचना निर्माण गर्दा माथिल्लो तटीय देशको बहुमूल्य भूभाग डुबानमा र स्थानिय बासिन्दा विस्थापनमा पर्छ भने बाढी नियन्त्रण हँुदा बाढीबाट हुने क्षतिबाट मात्र जोगिने होइन, पुनर्वास तथा पुनःस्थापना लगायतको खर्च पनि बच्छ । यी दुइ नजीरहरुको आलोकमा कोशी÷गण्डक सम्झौतासंग यहाँ विद्युत विधेयक तुलना गरिएको छ । कोशी सम्झौता कोशी नदीलाई भारतमा बिहारको शोक भनिन्थ्यो । २०० वर्ष अघि भारतको बिहारको पुर्णिया भएर बग्ने यो नदीले धार परिवर्तन गर्दै १ सय ३३ किलोमिटर पश्चिमतिर सरेर अहिले त्यहिँको निर्मली हुँदै बग्दैछ । यो नदी नियन्त्रण गर्न भारतमा भौगागिकरुपमा सम्भव नहुनाले शताब्धिऔँ देखि भारत यसलाई नियन्त्रण गर्न नेपालमा भौतिक संरचना बनाउन चाहन्थ्यो । विक्रम संवत १९५४ र २००३ मा ब्रिटिश भारतले नेपालमा बाँध निर्माण गर्ने प्रस्ताव गरेकोमा कार्यान्वयन गरिएन । २०११ सालमा तत्कालिन प्रधानमन्त्री मातृकाप्रसाद कोइरालाको सरकारले कोशी नदीमा बाँध बनाएर पानी पथान्तरण गरी भारतको बिहारमा सिंचाइ तथा बाढी नियन्त्रण गर्नको लागि सम्झौता गरे । उक्त पानीले भारतको बिहारमा १० लाख हेक्टर जमिन सिंचाइ गन्छि भने नेपालमा एक बित्ता जमिन पनि सिंचाइ हुन्न । उक्त बाँध निर्माण गरिनु अघि भारतको बिहारमामा २१ लाख हेक्टर जमिन डुबानमा पथ्र्याे भनिने हुनाले उक्त बाँधले त्यो जमिनमा बाढी नियन्त्रण भएको हुनु पर्छ । सो बाँधले नेपालको भूभाग डुबानमा प¥यो र स्थानिय बासिन्दा विस्थापित भए । भारतको लगानीमा यो बाँध बनाइएको नाममा भारतले बाढी नियन्त्रण र सिंचाइको लाभ ६ दशकसम्म निःशुल्क लिइसक्यो भने नेपालले डुबान र विस्थापनको हानी अद्यापि व्यहोरी रहेको छ । त्यसैले यो सम्झौता नेपालको हितमा छैन । गण्डक सम्झौता भारतले १९३० सालको दशकमा नै गण्डक नदीबाट भारतमा सिंचाई गर्ने सोच बनाएकोमा १९६० सालमा त्रिवेणी नहर निर्माण गरेर १९६६ सालमा संचालनमा ल्याएपनि प्रभावकारी भएन । किनभने भारतमा गण्डक नदीमा बाँध बनाएर पानीको प्रभावकारीरुपमा पथान्तरण गर्न भौगोलिक रुपमा सम्भव थिएन÷छैन । २०१३ सालमा टंकप्रसाद आचार्यले प्रधानमन्त्री हुँदा गण्डक सम्झौता गर्न मानेनन् । २०१४ सालमा डा. के.आइ. सिंह प्रधानमन्त्री हुँदा भारतले पुनः आग्रह गर्दा राष्ट्रिय हितको दृष्टिबाट मन्त्रिस्तरको जाँच कमिशन गठन गरेर नारायणीमा जलमार्ग विकास गर्ने, भारतमा प्रत्येक एकडमा सिंचाइ गरे बापत नेपाललाई वार्षिक एक रुपैया तिर्नु पर्ने (नेपालले वार्षिक २५ लाख रुपैया आम्दानी हुने आकलन थियो र त्यसबेला १ डलरको भारु ४।७६ हुनाले वार्षिक ५ लाख २५ हजार डलर नेपालले रोयल्टी पाउन सक्थ्यो, जुन सन् २०२३ को मूल्यमा ५७ लाख ५० हजार डलर हुन्छ), लगायतका १७ बुँदे शर्त राखेकोमा भारतले अस्वीकार ग¥यो । पछि २०१६ सालमा विश्वेश्वरप्रसाद कोइराला प्रधानमन्त्री हुँदा सम्झौता गरियो । यो बाँधबाट भारतमा ३४ लाख हेक्टरमा सिंचाई हुन्छ भने नेपालमा १ लाख ४३ हजार हेक्टर सिंचाइ गर्ने सम्झौतामा भएपनि यथार्थमा यसभन्दा निकै कममात्र सिंचाइ हुन्छ । साथै भारतको बिहारमा बाढी नियन्त्रण भएको छ । नेपालले डुबान र विस्थापन भोगेको छ । भारतको लगानीमा यो बाँध बनाएको नाममा भारतले बाढी नियन्त्रण र सिंचाइको लाभ ६ दशक देखि निःशुल्क लिइ रहेको छ । तर नेपालले डुबान र विस्थापनको हानी अद्यापि व्यर्होदै छ । समग्रमा गण्डक सम्झौता पनि नेपालको हितमा छैन । जलाशययुक्त आयोजना कोशी र गण्डक बाँधकहरुबाट वर्षायामको पानीमात्र पथान्तरण गरिन्छ भने नेपालमा जलाशययुक्त आयोजनामा बनाइएर वर्षातको पानी जलाशयमा संचित भएर सुख्खायाममा समेत भारतमा उपलब्ध हुन्छ । अर्थात हाल विद्यमान बाँधहरुबाट भारतले वर्षायाममा एक वालीको लागि मात्र सिंचाइ गर्न मूल्यअभिवृद्धि गरेको पानी पाएको छ भने नेपालमा बुढी गण्डकी, सप्तकोशी उच्च बाँध, कर्णाली चिसापानी लगायतका जलाशययुक्त आयोजनाहरु निर्माण गरिएर सुख्खायामका लगभग ८ महिनापनि भारतले सिंचाइ गर्न मूल्यअभिवृद्धि गरेको पानी पाउने अवस्था बन्छ; एक वर्षमा एक वालीमा ठाउँमा ३ देखि ४ वालीसम्म सिंचाइ गर्न पाउने छ । तर यो विधेयक बिना संशोधन यथावत पारित भएमा भारतले सुख्खायाममा समेत सिंचाइको लागि मूल्यअभिवृद्धि गरेको पानी पाउने अवस्था बन्ने छ । र, सो बापत अन्तरराष्ट्रिय नजीर बमोजिम पैसा लिने व्यवस्था यो विधेयकमा गरिएको छैन । बुढी गंडकी आयोजनाकै उदाहरण लिने हो भने सुख्खायाममा भारतले पाउने मूल्यअभिवृद्धि गरिएको पानीको मूल्य लेसेथोको नजीर अनुसार वार्षिक ३९ करोड डलर (वर्तमान विनिमय दर अनुसार ५२ अर्ब रुपियाँ) नेपालले पाउनु पर्ने हो । तर यस सम्बन्धमा विधेयक मौन रहेको हुनाले नेपालमा बन्ने सबै जलाशययुक्त आयोजनाबाट भारतले सुख्खायाममा प्राप्त गर्ने मूल्यअभिवृद्धि गरिएको पानीको मूल्यबाट नेपाल बञ्चित हुने अवस्था बन्ने छ । यस्तै नेपालमा जलाशययुक्त आयोजना बनाइएमा भारतमा बाढी नियन्त्रण हुन्छ । तर यस बापत पनि अन्तरराष्ट्रिय नजीर बमोजिम पैसा लिने व्यवस्था यो विधेयकमा गरिएन । नेपालमा भने डुबान र विस्थापन हुन्छ, जसको क्षतिपूर्ति बाढी नियन्त्रण र सिंचाइबाट लाभान्वित हुनेबाट असूल्ने व्यवस्था पनि विधेयकमा गरिएको छैन । राष्ट्रघाती विधेयक माथि उल्लिखित कारणहरुले गर्दा स्पष्टतः यो विधेयक राष्ट्रघाती छ । कोशी र गण्डक बाँध निर्माण गर्न नेपालले भारतसंग छुट्टाछुट्टै सम्झौता गरेकोमा प्रस्तुत विधेयक यथावत संसदबाट पारित भएमा नेपाल र भारतबिच कुनै सम्झौता नगरिकनै नेपालमा जलविद्युत आयोजनाको नाममा जलाशययुक्त आयोजना निर्माण गरिएर भारतले सुख्खायाममा सिंचाइ गर्न बहुमूल्य पानी र वर्षायाममा बाढी नियन्त्रणको लाभ निःशुल्क पाउनेछ । अझ आयोजना निर्माणमा भारतले लगानी समेत गर्न नपर्ने अवस्था बन्ने छ, जस्तै नेपाल आफैले बनाउने भनिएको बुढी गण्डकी आयोजना । तसर्थ यो विधेयक कोशी र गण्डक सम्झौताहरु भन्दा धेरै गुणाले पश्चगामी र राष्ट्रघाती छ, नेपालको राष्ट्रिय स्वार्थ सम्बर्धन हुने गरेर संशोधन गरेर मात्र पारित गरिनु पर्छ । राष्ट्रघातको विरोध मातृका सरकारले कोशी सम्झौता गरेकोमा नेपाली कांग्रेसका तत्कालिन अध्यक्ष विश्वेश्वरप्रसाद कोइरालाले “कोशी सन्धिमा नेपाललाई घाटा भएको छ” र गणेशमान सिंहले उक्त सन्धिलाई “राष्ट्रिय आत्महत्या” भनेका थिए । यसरी भएको चर्को विरोध साम्य पार्न भारतीय संसदीय प्रतिनिधि मंडल नेपाल आउँदा विरोध झन चर्किएर उक्त प्रतिनिधि मंडल चढेर आएको विमानलाई विमानस्थलमा अवतरण गर्न नदिएकोले सेना परिचालन गरेर मात्र विमान अवतरण गर्न सकेको थियो । यसरी विरोध गरेकोमा गोर्खा दलका मृगेन्द्र सम्शेर लगायतका नेताहरुलाई थुनामा राखिएको थियो । कोशी सम्झौता गर्ने मातृकाले नै मृत्यु हुनु ६ महिना अघि कोशी सम्झौतामा ठूलो राष्ट्रघात भयो भनेर स्वीकारेका थिए । कोशी सम्झौताको कटु आलोचना गर्ने विश्वेश्वरप्रसाद कोइराला प्रधानमन्त्री र गणेशमान सिंह निर्माण, संचार तथा नहरमन्त्री हुँदा गरिएको गण्डक सम्झौताको पनि विरोध भएको थियो । नेपाल कम्युनिस्ट पार्टीले भारतीय दुतावासमा विरोधपत्र बुझायो, बजार, शैक्षिक संस्था बन्द गरायो र कालो दिवस मनायो । विरोध उत्कर्षमा पुग्दा सम्झौता विरुद्ध नेपाल कम्युनिस्ट पार्टीका एक सांसदले महासभामा संकल्प प्रस्ताव प्रस्तुत गरे र छलफलको क्रममा तत्कालिन प्रधानमन्त्री कोइरालाले भारतलाई दिने भनिएको पानीको परिमाण गलत हो भनेर स्वीकार गरे । कोशी र गण्डक सम्झौताहरुबाट भन्दा नेपाललाई धेरै हानि हुने गरी र भारतको हित हुने गरेर नेपालको जलस्रोत दोहन गर्ने कानुन निर्माण गर्न विधेयक संसदमा सैद्धान्तिक छलफल हुँदा समेत यसको विरोधमा आवाज नउठ्नु आश्चर्यजनक छ । २०११ र २०१६ सालमा नेपालीले कोशी र गण्डक सम्झौताहरुको उग्र विरोध गरेकोमा एक्काइसौं शताब्धिमा सरकारले राष्ट्रघाती काम गर्न लाग्दा बुद्धिजीविहरुको मौनताले अनिष्टको आशंका हुन्छ । संसदले विधेयक पारित गरेर ऐन जारी भइ सके पछि गरिने विरोध प्रभावकारी हुन्न । त्यसैले यस्तो राष्ट्रघाती विधेयक पारित गर्नबाट सबै देशभक्त राष्ट्रवादी नेपालली प्रतिबद्ध भएर लाग्नुको विकल्प छैन । निष्कर्श नेपालमा जारी गरिने सबै ऐन, कानुन इत्यादि यो देश, यहाँका जनता र यसको अर्थतन्त्रलाई लाभान्वित बनाउने हिसाबले निर्माण गरिनु पर्ने हो । तर माथिको विवेचनाबाट प्रष्ट हुन्छ कि यो विधेयक छिमेकी देशलाई लाभ र नेपाललाई हानि पार्ने हिसाबले बनाइएको छ । यसबाट देखिन्छ कि यो विधेयक छिमेकीको स्वार्थपूर्ति गर्ने उद्देश्यले यो बनाइएको हो र÷वा त्यहाँका विज्ञले आफ्नो मातृभूमिको हितमा मस्यौदा गरेर नेपाललाई दिएको हो । यो कुरा साँचो भए ती विदेशी विज्ञ देशभक्त हुनुमा उनको कुनै गल्ति छैन । कुनै पनि देशको नागरिकले हरेक तरिकाले आफ्नो देशको स्वार्थपूर्ति गर्ने प्रयास गर्नु प्राकृतिक र स्वाभाविक हो । तर यसरी तयार पारिएको विधेयकलाई जस्ताको त्यस्तै सार्वभौम, स्वाधीन तथा स्वतंत्र नेपालको संसदमा दर्ता गर्नुलाई राष्ट्रद्रोह भन्दा कम मान्न सकिन्न । अझ कुनै विदेशी विज्ञले नभएर यो विधेयक नेपालीहरुले नै तयार पारेको भए यो अक्षम्य अपराध हो, ठूलो राष्ट्रद्रोह हो । नेपालको हित नहुने तर अन्य देशको हित हुने गरेर विधेयक बनाउने काम कुनै पनि देशभक्त राष्ट्रवादी नागरिकबाट नहुनु पर्ने थियो । Ratna Sansar Shrestha नागरिकमा २०८० कार्तिक १२ गते प्रकाशित https://nagariknews.nagariknetwork.com/opinion/1333221-1698540142.html

Electricity Bill: Gift Positive Externalities to Neighbors

GoN has tabled Electricity Bill 2080 in the House of Representatives last month to supplant currently prevalent Electricity Act, 2049. First hydropower plant came into operation in Nepal; 80 years before the Electricity Act was promulgated and, in this period, total generation capacity had reached 278 MW only. After the Act was promulgated to attract private sector investment in the electricity sector, electricity generation capacity reached 2,684 MW till last fiscal year. An increase of 2,406 MW in 30 years is substantial progress compared to 278 MW in the previous 80 year period. History of Electricity Act After noting a number of flaws in over a decade of implementation of the Electricity Act, 2049, a new Bill was tabled in the Constituent Assembly in 2065. MCAs from a number of parties submitted amendment proposals to the Bill, totaling 142 proposals. Instead of incorporating the amendments recommended by MCAs, the Bill was allowed to lapse. Again, another Bill was tabled in 2077 in the National Assembly only to withdraw it in 2079. Bill and Water As mentioned above total electricity generation capacity in Nepal till last fiscal year is 2,684 MW and out of which 2,538 MW is hydropower (based on water resources), 53.4 MW thermal, 86.9 MW solar and 6 MW bagasse. Meaning 95% of the electricity generation uses water resources. Similarly, of 3,102.7 MW power plants are under construction currently, of which 3,073.7 MW is based on water resources and 29 MW solar; 99% is based on water resources. Further, of 2,631.6 MW awaiting financial closure, 2,607.4 MW is based on water resources and 24.2 MW solar; 99% again based on water resources. Of total power plants in operation, under construction and awaiting financial closure of 8,418.89 MW, 97.63% is based on water resources, while 0.63% thermal, 1.66% solar and 0.07% bagasse. From this, it is clear that the main source of electricity generation in Nepal is water resources. But the Bill is deafeningly silent about multidimensional uses of water and value of water from spatial transfer and temporal transfer as well as flood control benefit. It is but natural to expect this Bill to play an effective role in the development of Nepal by harnessing her water resources. But this Bill fails to meet that expectation by a huge magnitude as there are numerous flaws, blunders, weaknesses and aberrations in it, which warrant correction. For example, in the very first page of the Bill, while throwing light on the objective and goal of the Bill, the phrase “comprehensive development framework” is mentioned attributing it to a person named James D. Wolfensohn, identifying him as an American President. In fact, nobody by that name has ever been president of the USA. A person by that name was president of the World Bank Group from 1995 to 2005. This is a serious blunder in a Bill that is highly important for Nepal; it also demonstrates negligence or lack of seriousness on the part of those who prepared it. Of the numerous flaws a few are discussed below. Electricity generation by harnessing water resources Human beings have survived without electric light for long and some are surviving even now. But no human being can live without drinking water for more than 3 days. Similarly, human beings cannot survive without food for more than 3 weeks; water is required to produce food. Therefore, clean water is deemed invaluable. People buy water from utilities and also in tankers, jars or bottles. South Africa has been paying to receive water from Lesotho under the Treaty on Lesotho Highlands Water Project between the government of the Kingdom of Lesotho and the government of the Republic of South Africa. In 2020 South Africa had paid $ 69 million to Lesotho for 780 million cubic meter water (24.74 cumecs), which works out to $ 2.789 million/cumecs). This example can be looked at from Nepal’s perspective by using the example of the Budhi Gandaki Project on the anvil (installed capacity 1,200 MW). Annual average electricity generated by this project would fetch $ 124.7 million at the rate of US 5 cents/kWh. While lean season augmented flow of water that would be produced by the reservoir is worth $ 390.5 million using Lesotho precedent. But this Bill is silent about lean season augmented flow. Therefore, following provision must be added in Section 14 of the Bill: • Installed capacity of reservoir project shall be fixed on the basis on requirement of lean season augmented flow for consumptive uses including irrigation in lower riparian areas within Nepal. • If downstream country/ies is/are prepared to pay for lean season augmented flow for consumptive uses including irrigation, the installed capacity of reservoir project can be fixed on the basis of requirement of lean season augmented flow for consumptive uses including irrigation in Nepal and downstream country/ies. Moreover, downstream country/ies may stand to benefit from flood control benefits if a reservoir project is built in Nepal. To cover for such instances a provision must be added in the Bill to recover recompense for such benefit from downstream country/ies. There is precedent under the Columbia Treaty, according to which the USA has paid to Canada for flood control benefits. In case downstream country/ies is/are unwilling to pay for positive externalities described above (lean season augmented flow and flood control), the installed capacity of reservoir projects must be based on requirement of lean season augmented flow for consumptive uses including irrigation in lower riparian areas just within Nepal. One should not lose sight of the fact that freely flowing water in the rivers does not have any financial value (nobody would be willing to pay for such water at the river bank). But value added water after construction of infrastructure on the river has value. For example, Melamchi Rver water after its spatial transfer from Sindhupalanchok to Kathmandu has high value. Similarly, lean season augmented flow after temporal transfer from a reservoir has high value also since the reservoir causes negative externalities in terms of inundation of valuable land and involuntary displacement of local populace, which would not be recompensed by the beneficiary downstream country/ies. Parliamentary ratification There is provision for parliamentary ratification of treaties and agreements, related to natural resources and the distribution of their uses in Article 279 (2). Therefore, provision must be inserted in this Bill for parliamentary ratification of any hydropower project from which lower riparian country/ies stand/s to benefit from positive externalities. Because building a reservoir project from which lower riparian country/ies stand to receive positive externalities is tantamount to distribution of uses of Nepal’s natural resources. In this manner supremacy of the Constitution will be established and the prestige of the parliament will be enhanced. Early last year the MCC compact, including to build a 400 kV transmission line with a grant of $ 500 million for 5 years, was ratified by the parliament. However, it was not necessary to ratify such a Compact, as such agreements do not fall in the ambit of Article 279 (2) of the Constitution. In this manner Nepal’s parliament has ratified an agreement which did not need to be ratified according to the Constitution, while many agreements that are related to distribution of uses of natural resources have not been ratified in contravention of the Constitution; which also amounts to contempt of parliament. Export oriented project The 900 MW Arun 3 project, licensed to an Indian company, is under construction as an export oriented project. Besides, GoN has already awarded Arun 4, Lower Arun, Upper Karnali, West Seti, Seti River 6 and Phukot Karnali to Indian companies as export oriented projects. Total capacity of these 7 projects is 4,649 MW. These projects would export all electricity, except for free energy to Nepal. These would export not just the spill/surplus energy of wet season and off peak energy but also dry season and peak time electricity for which there is high demand/requirement in Nepal. Such electricity can add value in Nepal’s economy at the rate of US 86 cents/kWh if used in Nepal according to a USAID study report. It is logical to export spill/surplus energy of wet season and off-peak period but export of dry season and peak time electricity is like committing hara-kiri. Because NEA is importing dry season and peak time electricity from India at exorbitant rates, while exporting spill/surplus electricity at rock bottom tariff. Therefore, no project should be allowed to be built as export oriented and all references to export oriented projects needs to be removed from the Bill. Conclusion On the whole this Bill is designed to provide electricity (clean non-polluting energy) at low tariff to neighboring country/ies and on top of that provide positive externalities free of cost to them (almost like adding insult to injury). An in-depth study of this Bill makes one feel that this Bill was prepared with a view to benefit downstream country/ies or it was prepared by an expert of such a country for the benefit of his/her motherland. If that is true then that expert is a patriot of that country, which is expected in every citizen. But it amounts to sedition/treason to table such a Bill in Nepal’s parliament. Further, if this Bill was prepared by leaders and bureaucrats of Nepal it amounts to unpardonable crime of sedition/treason. Such a Bill is not expected from any nationalist and patriotic citizen of Nepal. Matrik Koirala and Bisheshwar Koirala, former prime ministers of Nepal in 1950s, have not only been vilified but also demonized till now for signing Koshi and Gandak treaties respectively, under which India benefits in the form of water for irrigation and flood control free of cost, while inundating land in Nepal and involuntarily displacing Nepali people. If this Bill is passed by the parliament as it is then in the guise of hydropower development (entailing generation and export thereof), lower riparian country/ies stand/s to receive irrigation and flood control benefits without having to pay anything for such positive externalities. After that the Koirala brothers will not need to be demonized anymore. विद्युत विधेयकमा बहुमूल्य पानीको उपेक्षा

हाल प्रचलनमा रहेको विद्युत ऐन २०४९ लाई प्रतिस्थापन गर्ने गरेर गत भदौमा सरकारले प्रतिनिधि सभामा विद्युत विधेयक २०८० दर्ता गरेकोछ । १९६८ सालमा पहिलो विद्युतगृह निर्माण भएकोमा विद्युत ऐन लागू हुन अघि ८० वर्षमा देशको विद्युत उत्पादन क्षमता जम्मा २७८ मेगावाट थियो । तर सो ऐन लागू भए पछि देखि गत आर्थिक वर्षको अन्त्यसम्ममा ३० वर्षमा २,४०६ मेगावाट थपिएर जम्मा २,६८४ मेगावाट पुगेको छ, जुन उक्त ऐनको सकारात्मक पक्ष हो । विद्युत ऐनको इतिहास विद्युत ऐन लागू भएको ३ दशकमा कतिपय विसंगती र विकृति देखा परकोले त्यसलाई संवोधन गर्न नयाँ ऐनको आवश्यकता महसूस गरेर २०६५ सालमा नयाँ विद्युत विधेयक तत्कालिन संविधान सभामा दर्ता गरिएको थियो । त्यसमा संशोधन गर्नको लागि संविधान सभाका बिभिन्न सदस्यहरुले १४२ वटा संशोधन प्रस्तावहरु दर्ता गराएकोमा ती संशोधनहरु विधेयकमा समावेश गरेर उक्त विधेयक पारित गर्नुको सट्टा सो विधेयक नै तुहाइयो । फेरि २०७७ साल असारमा अर्को विद्युत विधेयक राष्ट्रिय सभामा दर्ता गरिएको थियो । तर सरकारले २०७९ साल भदौमा उक्त विधेयक राष्ट्रिय सभाबाट फिर्ता लिएर यो विद्युत विधेयक प्रतिनिधि सभामा दर्ता गरेको हो । यसबाट विद्युत ऐन परिमार्जनमा ठूलो अन्यौल रहेको देखिन्छ । विधेयक र पानी हाल देशमा जम्मा २,६८४ मेगावाट विद्युत उत्पादन क्षमता भएकोमा २,५३८ मेगावाट जलविद्युत छ भने खनिज इन्धनबाट ५३.४ मेगावाट, सौर्य उर्जा ८६.९ मेगावाट र जैविक उर्जाबाट ६ मेगावाट बिजुली उत्पादन भइ रहेको छ । अर्थात ९५ प्रतिशत बिजुली जलस्रोतको दोहन गरेर उत्पादन गरिएको हो । त्यस्तै ३,१०२.७ मेगावाट विद्युत आयोजनाहरु निर्माणाधीन रहेकोमा ३,०७३.७ मेगावाट जलविद्युत हो भने २९ मेगावाट सौर्य उर्जा हो । अर्थात जलस्रोत दोहनमा आधारित ९९ प्रतिशत विद्युत आयोजनाहरु निर्माणाधीन छन् । त्यस्तै निर्माण शुरु गर्ने उपक्रममा रहेको जम्मा २,६३१.६ मेगावाट मध्ये २,६०७.४ मेगावाट जलविद्युत आयोजाना हुन् भने २९ मेगावाट मात्र सौर्य उर्जा हो; जलस्रोतमा आधारित ९९ प्रतिशत । समग्रमा हाल संचालनमा रहेको विद्युतगृहहरु, निर्माणाधीन विद्युत आयोजनाहरु र निर्माण शुरु गर्ने उपक्रममा रहेका विद्युत आयोजनाहरु मध्ये ९७.७ प्रतिशत जलविद्युत हुन् भने ०.६ प्रतिशत खनिज इन्धन र १.७ प्रतिशत सौर्य उर्जा हो । यसबाट नेपालमा मुख्यतया जलस्रोत दोहन गरेर नै विद्युत उत्पादन गरिने यथार्थ पुष्टि हुन्छ । तथापि प्रस्तुत विधेयकले जलस्रोतका बहुआयामिक उपोगिता र मूल्यअभिवृद्धि गरिएको पानीको मूल्य सम्बन्धमा मौनता धारण गरेको छ । जब कि प्रस्तुत विधेयकले नेपालको जलस्रोतको दोहन गरेर देशको विकासमा अझ धेरै प्रभावकारी भूमिका खेल्ने अपेक्षा गर्नु अस्वाभाविक होइन । यो विधेयकमा धेरै कमी कमजोरी विकृति विसंगतिहरु छन्, जुन सच्याउनु वान्छनिय छ । जस्तै पहिलो पृष्ठमा विधेयकको उद्देश्य र कारण खुलासा गर्दा “वृहत विकासको अवधारणा” अनुसार विद्युत क्षेत्र एवं विद्युत सम्बन्धी कानुनको सुधार र परिमार्जन गर्ने विषय सरकारको उच्च प्राथमिकता रहँदै आएको छ भन्दै वृहत विकासको अवधारणा जेम्स डी वल्फेनशन नामका अमेरिकी राष्ट्रपतिले पैरवी गरेको भनेर लेखिएको छ । तर अमेरिकामा कहिल्यै पनि जेम्स डी वल्फेनशन नामक व्यक्ति राष्ट्रपति बनेनन् । उनी त सन् १९९५ देखि सन् २००५ सम्म विश्व ब्याँक नामको बहुराष्ट्रिय वित्तीय संस्थाका अध्यक्ष मात्र थिए । यति महत्वपूर्ण विधेयकमा यो धेरै गम्भिर तथ्यगत त्रुटि हो, अवथा यो विधेयकको निर्माणमा सम्बद्धहरुमा गम्भिरताको टडकारो अभाव देखिन्छ । यस अतिरिक्त यो विधेयकमा अरु धेरै कमि कमजोरीहरु छन्, जसको विवेचना निम्न पंक्तिहररुमा गरिएको छ । जलस्रोतको दोहन गरेर विद्युत उत्पादन विद्युत उत्पादन र उपयोगलाई जतिसुकै जोड दिए पनि मानव जाती अँध्यारोमा जीवित रहन सक्छन्, वा बिजुलीको विकल्प उपयोग गरेर पनि जीवित छन् । तर पानी नपिइकन ३ दिन भन्दा बाँच्दैनन् । त्यस्तै खाना नखाइकन बढीमा ३ हप्तामात्र बाँच्न सक्छन्, जुन उत्पादन गर्न पनि पानी अत्यावश्यक हुन्छ । त्यसैले गर्दा स्वच्छ पानीलाई बहुमूल्य मानिन्छ । मानिसहरुले पानी वितरण गर्ने संस्थालाई महसूल तिरेर पानी प्राप्त गर्छन् भने ट्यांकर, जार वा बोतलमा पनि पैसा तिरेर नै पानी किन्छन् । ठूलो परिमाणमा पानी किनबेच सम्बन्धमा दक्षिण अफ्रिकाले छिमेकी देश लेसेथोमा निर्मित संरचनाबाट सन् २०२० मा ७८ करोड घन मिटर पानी किने बापत ६ करोड ९० लाख अमेरिकी डलर लेसेथोलाई तिरेको नजीर छ । अर्थात २४.७४ घन मिटर प्रति सेकेन्ड (क्युमेक) पानीको लागि उक्त रकम तिरिएको रहेछ र यो हिसाबले १ क्युमेक पानीको मूल्य २७ लाख ८९ हजार अमेरिकी डलर पर्न आउँछ । यो उदाहरणलाई नेपाली परिवेशमा ढाल्न बुढी गंडकी आयोजनामा दृष्टिगत गर्नु उपयुक्त हुन्छ । उक्त आयोजनाबाट उत्पादन हुने बिजुलीको प्रति युनिट ५ सेन्टको दरले १२ करोड ४७ लाख ५० हजार अमेरिकी डलर मूल्य हुन्छ भने यसको जलाशयबाट सुख्खायाममा निसृत हुने थप÷नियन्त्रित पानीको मूल्य लेसेथोको नजीरको दर बमोजिम ३९ करोड ५ लाख अमेरिकी डलर हुन्छ । तर प्रस्तुत विधेयक बहुमूल्य पानी सम्बन्धमा मौन छ; जुन नेपालको हितमा छैन, तल्लो तटीय देशको हितमा छ । त्यसैले विधेयकको दफा १४ मा निम्न प्रावधान थप गरिनु पर्छः ड्ड जलाशययुक्त विद्युत आयोजनाको हकमा सुख्खायाममा विद्युतगृहबाट निसृत हुने थप÷नियन्त्रित पानीले नेपालभित्रको तल्लो तटीय इलाकामा सिंचाइ लगायतका उपभोग्य उपयोगको लागि आवश्यक पानीको परिमाणको आधारमा विद्युत आयोजनाको जडित क्षमता निर्धारण गर्ने । ड्ड नेपालमा निर्माण गरिने जलाशययुक्त आयोजनाका विद्युतगृहबाट निसृत हुने थप÷नियन्त्रित पानी तल्लो तटीय देश(हरु)ले प्राप्त गर्ने अवस्थामा त्यस्तो थप÷नियन्त्रित पानी बापत ती देशले रकम तिर्न कबूल गरेको अवस्थामा जलविद्युत आयोजनाको जडित क्षमता तद्अनुरुप बनाउन सकिनेछ । साथै नेपालमा जलाशययुक्त आयोजना निर्माण गरिँदा तल्लो तटीय देशलाई बाढी नियन्त्रणको लाभपनि प्राप्त हुन्छ । क्यानाडामा संरचना निर्माण गरेर अमेरिकालाई बाढी नियन्त्रणको लाभ उपलब्ध गराए बापत अमेरिकाले रकम तिरेको नजीर छ । त्यसैले यो विधेयकमा बाढी नियन्त्रणबाट लाभान्वित हुने तल्लो तटीय देशले उक्त लाभबापतको रकम पनि नेपाललाई तिर्न कबूल गर्नु पर्नेछ भन्ने व्यवस्था पनि यो विधेयकमा थपिनु पर्छ । साथै कथम् तल्लो तटीय देशले जलाशययुक्त आयोजनाको विद्युतगृहबाट निसृत हुने थप÷नियन्त्रित पानीबाट हुने लाभ तथा बाढी नियन्त्रणबाट हुने लाभ बापत नेपाललाई रकम तिर्न राजी नभएको अवस्थामा नेपालभित्रको तल्लो तटीय इलाकामा सिंचाइ लगायतका उपभोग्य उपयोगको लागि आवश्यक पानीको परिमाणको आधारमा मात्र विद्युत आयोजनाको जडित क्षमता निर्धारण गरिने छ भन्ने व्यवस्था पनि यो विधेयकमा गरिनु पर्छ । स्मरणीय छ, खोला नदीनालामा बगेको पानीको यथावत अवस्थामा मूल्य हुन्न, मूल्यअभिवृद्धि गरिएको पानी भने बहुमूल्य हुन्छ जस्तै भौतिक संरचना बनाएर पथान्तरण गरिएको पानी (मेलम्चीको जस्तै) हो । त्यस्तै जलाशय बनाएर तल्लो तटीय इलाकामा सुख्खायाममा थपिने (वा मौसमि स्थानान्तरण गरिएको) पानी पनि बहुमूल्यको हुन्छ, किनभने जलाशय बनाउन ठूलो भूभाग डुबानमा पारिन्छ र स्थानिय वासिन्दा विस्थापित गरिन्छ । संसदीय अनुमोदन संविधानको धारा २७९ को उपधारा (२) मा प्राकृतिक स्रोत तथा त्यसको उपयोगको बाँडफाँड सम्बन्धमा नेपाल सरकारले गर्ने सन्धि वा सम्झौताको संसदबाट अनुमोदन गरिनु पर्ने हुनाले तल्लो तटीय छिमेकी देश(हरु) लाभान्वित हुने गरेर निर्माण हुने सबै जलाशययुक्त आयोजनाको सम्बन्धमा संसदबाट अनुमोदन गराउनु पर्ने व्यवस्था गरिनु पर्छ । किनभने जलाशय निर्माण गरेर तल्लो तटीय देशलाई पानी उपलब्ध गराउनु भनेको प्राकृतिक स्रोतको उपयोगको बाँडफाँड हो । यसबाट संवैधानिक सर्वोच्चता कायम भएर संसदको गरिमा बढ्छ । स्मरणीय छ, ४०० केभीको प्रशारण लाइन निर्माणार्थ एक अमेरिकी निगमबाट वार्षिक १० करोड डलर (जम्मा ५० करोड डलर) अनुदान लिन समेत संसदबाट अनुमोदन गराइएको थियो, जुन संविधानको धारा २७९ अनुसार आवश्यक थिएन । यसरी संविधानले संसदीय अनुमोदन आवश्यक छ भनेर किटानी नगरेको विषयको सम्झौता संसदबाट अनुमोदन गराउने तर प्राकृतिक स्रोतको उपयोगको बाँडफाँड हुने सम्बन्धमा भने संसदलाई उपेक्षा गर्नु संसदको अवहेलना हो । निर्यातमूलक जलविद्युत आयोजना एक भारतीय निजी कम्पनीसंग नेपाल सरकारले गरेको सम्झौता बमोजिम ९०० मेगावाटको अरुण ३ आयोजनालाई निर्यातमूलक बनाएर निर्माण गरिँदैछ । यस अतिरिक्त अरुण ४, तल्लो अरुण, माथिल्लो कर्णाली, पश्चिम सेती, सेती नदी ६ र फुकोट कर्णाली समेतका जलविद्युत आयोजनाहरु भारतीय कम्पनीहरुलाई निर्यातमूलक रुपमा निर्माण गर्न दिने गरेर सम्झौताहरु नेपाल सरकारले गरि सकेको छ । यी ७ आयोजनाहरुको कूल क्षमता ४,६४९ मेगावाटका हो । नेपालमा खपत हुन नसकेको वा खेर जाने बिजुली निकासी गर्नु युक्तिसंगत हो । तर निर्यातमूलक बनाइँदा देशभित्र नै उच्च माग हुने सुख्खायाम र उच्च माग हुने साँझको समयको बिजुली पनि निर्यात हुन जान्छ । एकातिर नेपाल विद्युत प्राधिकरणले यस्तो समयको बिजुली आपूर्ति गर्न भारतबाट महँगोमा आयात गर्नु पर्ने स्थिति छ भने त्यस्तोे बिजुली समेत सस्तोमा निर्यात गर्ने व्यवस्था गर्नु हास्यास्पद हो । त्यसैले कुनै पनि आयोजनालाई निर्यातमूलक बनाउनु हुन्न र यस अनुरुपको व्यवस्था प्रस्तुत विधेयकमा गरिनु पर्छ । अनुमतिपत्रको अवधिपश्चात हस्तान्तरण विद्युत ऐन अवधारणा नै निजी क्षेत्रको लगानीमा विद्युत आयोजना निर्माण गरेर निजी क्षेत्रले स्वामित्वमा राखेर निश्चित अवधि संचालन गरेपछि सरकारलाई हस्तान्तरण गर्ने हो । तर नेपालको स्वामित्वमा आए पछि विद्युतगृह तोकिएको अवधिसम्म संचालन हुन सकेन भने नेपाल सरकारको हात लाग्यो शुन्यको अवस्था हुन्छ । त्यसैले विधेयकमा हस्तान्तरण पछि आयोजना कम्तीमा २५ वर्ष संचालन हुनसक्ने सुनिश्चित रहेको आधिकारिक निकायबाट प्रमाणित हुनुपर्ने र जलाशययुक्त आयोजनाको हकमा जलाशयको क्षमता हस्तान्तरणको समयमा ७५ प्रतिशत कायम रहनुपर्ने छ भन्ने व्यवस्था थपिनु पर्छ । संचालनयोग्य अवस्थामा नेपाल सरकारलाई हस्तान्तरण गरिने सुनिश्चित गर्न अनुमतिपत्रवालाले संरचनाको डिजाइन बनाउँदा र निर्माण गर्दा नेपाल सरकारले निर्धारण गरेको संरचनाको डिजाइन मानदण्ड र निर्माणसम्बन्धी मानदण्ड अनुरुप डिजाइन तथा निर्माण गर्नु पर्नेछ र तोकिएको डिजाइन आयू अवलम्बन गरेर निर्माण गरिनुपर्छ भन्ने प्रावधान विधेयकमा थपिनु पर्छ । त्यस्तै संचालन अवधिमा तोकिएको मर्मत सम्भार मापदण्ड बमोजिम संरचनाको मर्मत सम्भार गरिनुपर्दछ भन्ने पनि विधेयकमा व्यवस्था गरिनु पर्छ । अन्तःमा गहिरिएर यो विधेयक अध्ययन गरेर मनन गर्दा यस्तो प्रतित हुन्छ कि कुनै छिमेकी देशको स्वार्थपूर्ति गर्ने उद्देश्यले यो विधेयक तयार पारिएको हो र÷वा त्यस देशका विज्ञले आफ्नो देशको हितमा मस्यौदा गरेर नेपाललाई उपलब्ध गराएको हो । यो कुरा साँचो भए ती विदेशी विज्ञ देशभक्त हुनुमा उनको कुनै गल्ति छैन । कुनै पनि देशको नागरिकले हरेक तरिकाले आफ्नो देशको स्वार्थपूर्ति गर्ने प्रयास गर्नु नितान्त स्वाभाविक हो । तर ती विदेशी विज्ञले तयार पारेको मस्यौदालाई जस्ताको त्यस्तै सार्वभौम, स्वाधीन तथा स्वतंत्र नेपालको संसदमा दर्ता गर्नुलाई राष्ट्रद्रोह भन्दा कम मान्न सकिन्न । अझ कुनै विदेशी विज्ञले नभएर यो विधेयक नेपालीहरु आफैले तयार पारेको भए यो अक्षम्य अपराध हो, ठूलो राष्ट्रद्रोह हो । देशमक्त राष्ट्रवादी नेपालीबाट यस्तो विधेयकको अपेक्षा गर्न सकिन्नथ्यो । नेपालको हित नहुने तर अन्य देशको हित हुने गरेर विधेयक बनाउने काम कुनै पनि देशभक्त राष्ट्रवादी नागरिकबाट नहुनु पर्ने थियो । २०८० आश्वि १८ को नागरिक दैनिका प्रकाशित
