"Weak governments behind failed liberalization"

Delighted to learn that Dr Ram Sharan Mahat also agrees that Nepal's liberalization has failed. However, it is strange coming from him - the architect of it; perhaps a confession. He has ascribed the failure to weak governments, most of which his party led in last 15 years prior to People's movement II after which country is in deep transition. He seems to have failed to appreciate that the liberalization failed because of failure of its architects to institute necessary regulatory mechanism in the liberalization. Appointment of CJ as PM does not amount to merger of judiciary with executive

People are making unnecessary hullabaloo about separation of power between judiciary and executive in the context of CJ being reposed with the responsibility to conduct election of legislature. What they are ignoring is the fact that the proposal doesn’t entail merger of judiciary with executive; rather the CJ will leave judiciary and perform the duty while Supreme Court will be led by an Acting CJ.

Consensus on chief justice leading election govt expected by evening

THT has reported that “Three major parties are planning to request Chief Justice Khil Raj Regmi to resign from his post to assume the proposed post of chief administrator of advisory council or committee or chief executive of the administrative body to be set up to hold the fresh Constituent Assembly elections by May.” If true, this is great news. Because, this move will herald breaking the deadlock, paving path to hold election before the rainy season; if no election could be hold before coming monsoon another window for holding election could require waiting for one full year. However, I hope the CJ will not rush to resign as reported by THT without putting all pieces of the puzzle in place. Because, him hurrying to resign could result in the country losing another head of the constitutional body, the Supreme Court, in the middle of numerous headless constitutional bodies.

प्रधान न्यायाधीशको नेतृत्वमा सरकार गठन गरेर गत्यावरोध भंग गर्ने प्रस्ताव स्वागतयोग्य छ

ठूला भनाउंदा दलहरु साँप, बिच्छी र भ्यागुतोको अवस्थामा भएकोले यो समाधानको उत्कृष्ट उपाय हो । जुन दलले सत्तारोहण गर्छ त्यो दलले निर्वाचन नगराएर सत्ता कब्जा गर्ने आशंका प्रत्येक दललाई अर्को दल प्रति छ । यस्तै जुन दल सत्तामा छ त्यो दलले सत्ताको दुरुपयोग गरेर आफु चुनावमा जित्ने प्रयास गर्ने मात्र होइन अर्को दलको “पत्ता साफ” गर्न कुनै कसर नछाड्ने समेत सम्भावनाको पृष्ठभूमिमा पनि यो सुझाव नैं हाम्रो मुलुकको हितमा छ । नेपाली कांग्रेसका शेखर कोइरालाले यो सुझावको सन्दर्भमा सोच्न पनि प्रधानमन्त्रीको राजिनामा आवश्यक भएको धारणा व्यक्त गरेको कुरा संचार माध्यमले सार्वजनिक गरेकोछ । पद्मुक्त भएकै कारण कामचलाउ बनीसकेका प्रधानमन्त्रीबाट राजिनामाको अपेक्षा राख्नु नेपालको संबिधानको अज्ञानता, अनभिज्ञतामा मात्र सम्भव छ । यस्तै यो उपाय अवलम्बन गर्न संबिधान संशोधन उपरान्त मात्र सम्भव भएको बिचार पनि सार्वजनिक भएकाछन् । पुनः संबिधान सभाकै निर्वाचन गर्न देखि निर्वाचन आयोगमा पदाधिकारी नियुक्त गर्न समेत संबिधानमा संशोधनको आवश्यकता भएकोले संबिधानमा आवश्यक संशोधन गरेर अगाडी बढ्नुपर्दछ ।

Upper Trishuli 3A project

On NEA board confirming that it has no plan to makes changes in Upper Trishuli 3A project, Supreme Court has handed down verdict to the effect that no interim order is called for. People of Nepal are obliged by the decision of NEA board in the leadership of Leela Mani Poudyal, for refusing to give in to the machination of the contractor and its commission agents. Thanks are due to them. Trust that now the contractor will work to commission 60 MW in timely manner.
