२०६८ ज्येष्ठ ११ गतेको फैसलामा सर्बोच्च अदालतले "निर्वाचन हुनु पूर्व कार्यकाल निश्चित गरिएबाट र तद्नुरुप जनताबाट अनुमोदित भै निर्वाचन समेतबाट गठन भएको संविधान सभाले बाध्यात्मक रुपमा सो निश्चित गरिएको आफ्नो दुई वर्षको कार्यकाल भित्र संविधान निर्माणको कार्य पूरा गर्नु पर्ने अन्तरिम संविधानले स्पष्ट व्यवस्था गरेको देखिन्छ" भन्ने ठहर गरेकोछ । धारा १४८ ले संबिधान संशोधन गर्ने अधिकार व्यवस्थापिका संसदमा निहित गरेकोले यान्त्रिकरुपमा धारा ६४ पनि संशोधन गर्न सकिने र यसरी संबिधान सभाको कार्यावधि बढाउन सकिने भन्ने धारणालाई सर्बोच्च अदालतले खारेज गरेकोछ । यसले गर्दा गत वर्ष धारा ६४ संशोधन गरेर थपिएको कार्यावधि सर्बोच्च अदालतले असम्बैधानिक मानेको स्पष्ट छ तर यो कुरा प्रष्टसंग नभनेर सर्बोच्च अदालतले कुरा चपाएर फैसला गरेकोछ जसमा त्यस अदालतको बाध्यता पनि छ । जुन कुरा मौनरुपमा स्वीकृत गर्दै भनिएको छ "संविधान सभाले हालसम्म गरेको काम कारबाही प्रभावित हुने र सार्थक परिणाम नदिने समेत" भन्दै असम्बैधानिक भनेर बोलेको छैन ।

यस पंक्तिकारले २०६६ फाल्गुण १८ गतेको गोरखापत्रमा प्रकाशित लेखमा नैं भनेका थिए "अन्तरिम संबिधानमा किहंकतै पनि संबिधान निर्माण नभएको कारण दर्शाएर संबिधान सभाको म्याद थप्ने व्यवस्था छैन । तसर्थ काम सकिएन भनेर आफैले आफ्नो कार्यकाल बढाउन सकिन्न मिल्दैन ।" १ वर्ष भन्दा पहिले यस पंक्तिकारले व्यक्त गरेको धारणालाई अहिले आएर सर्बोच्च अदालतले सहि ठहर् याएकोछ ।

I have a vision as to how should Nepal’s water resources be exploited in the interest of Nepal and her people and ideas to implement the vision. But data collection is something that takes quite a lot of time, energy and resources beyond my means.

Private sector cannot be depended upon entirely for arranging energy for industrialization. You are right. However, it can very well complement if appropriate policies are formulated based upon a vision that will serve Nepal’s national interest. In eight decades from 1911 Nepal had built 238 MW. But in two decades from 1992 405 MW was added to the system of which 166.8 MW was added by the private sector.

I have my own reason for asking that because some of the energy needs can be easily fulfilled by private sector whereas demand for industrialization etc. cannot be fulfilled by them as seen with our reliance on private developers.

Anyway, if you feel it is not needed then I have nothing more to say.

Comments regarding “hydrocratic dreams”

My article on above topic, published in Nepali Times last week (# 553), has elicited a number of comments; some profound, some not so profound. There were appreciative comments and there were angry and nasty ones, too. Appreciative comments are what keeps me fueled to continue with my writing spree.

 However, it doesn’t mean that I don’t welcome negative comments which afford an opportunity to correct errors of omission and commission. This time, disappointingly, the angry and nasty negative comments were only superficial. However, I am happy to note a silver lining in the dark cloud – none of these comments were able to refute following points that I was making in my article:

  • Even exporting full economic potential of 43,000 MW will not make Nepal’s GDP comparable to that of Saudi Arabia by any stretch of imagination; notwithstanding the proclamation of Ms Susan Goldmark, the World Bank country director in Nepal.
  • Hydro-dollars from the export of power will not mitigate Nepal’s balance of payment deficit significantly as only about 3% of the export proceed will “stay” in Nepal.
  • Although statistically, balance of trade will become favorable by the quantum of hydro-dollars, value addition to Nepal’s economy will not be commensurate to export; it will rather be limited by the quantum of percolation into Nepal’s economy. Ninety-seven percent of hydro-dollars flowing out of the economy will not meaningfully add value, will neither increase industrialization nor generate employment.

I wonder why do you ask me to “start analyzing the disaggregated energy needs for different uses” because I am not the appropriate authority for the purpose. This is the kind of exercise that an agency like planning commission needs to take up. This exercise will need substantial database, requiring conducting baseline survey to work out start disaggregated energy needs for different uses. All of this will need quite a lot of time, money and energy which is not available to me as a private citizen. I take it you do realize that I go on my writing spree in my private capacity.
However, if I am consulted by planning commission whether they should start analyzing the disaggregated energy needs for different uses, my recommendation will be no need to bother at this juncture. I have my reasons. Alternative sources of energy like solar and wind is useful for lighting purposes (including some limited infotainment) only. Biogas for mainly cooking. Nepal needs quite a lot of electric energy for industrialization which will generate employment and it is not possible to use alternative sources of energy for this purpose. Besides, life cycle cost of alternative sources of energy tends to be higher by a magnitude and, therefore, for a nascent economy like that of Nepal, alternative sources of energy is unaffordable for mainstream uses. Rich European countries have resorted to alternative sources to spruce up their image; green one.

Yes, the big shots of these multilaterals go about shooting their mouth off without checking facts and, unfortunately, hydrocrats in Nepal accept such “sermons” without even checking the veracity of such statements. I agree with you that expats seem to abuse “license to speak out of turn” due to Nepal’s poverty. But the poverty is more of intellectual poverty than anything else.

As one of the main objectives of this article was to demolish the myth created by Susan Goldmark that Nepal’s GDP will be comparable to that of Saudi Arabia, I had to compare GDP of Saudi Arabia with potential value of energy export from Nepal.
Secondly, I have yet to find relevant law related to taxation on oil revenue in Saudi Arabia to be able to write about her income from oil. This is important as the gross export proceed of the oil doesn’t constitute income for Saudi Arabian government; investors will take away (repatriate) a lion’s share of it. Incidentally, I have done similar comparison with oil revenue of Norway in my articles earlier. Norway government in total levies about 80% of the oil revenue as tax and duties – 80 cents from each dollar of oil export goes to government treasury. But under current Nepal law, Nepal receives about 3% of the export revenue by way of taxes and duties. Hence, the impossibility of Nepal government becoming rich by exporting power.

Answering your question about the hydrocracy (politicos, bureaucracy, intelligentsia, business community, renowned economists etc. involved in hydropower) is not easy. Especially in view of the availability of “clean, clear guiding signposts”, as you have rightly put. One easy answer would be that they always “bend towards the wrong direction” because they simply don’t understand. But I have met and dealt with almost all of them and their IQ level is comparable with yours and mine, if not higher. The other logical conclusion is your statement that “they (are) much less patriotic than us.” However, I don’t feel like believing this. Hence, I am in a dilemma as to what is the right answer to your question.

Then you go on to ask “are they themselves governed by others?” This makes it easy to answer the whole thing. Yes, these people are governed by “greed”. They pay lip service to patriotism etc. (bold for emphasis; because for them patriotism is something to talk about along with everything else and profess to be patriotic which doesn’t need to be put to practice) but if something as silly as patriotism comes in their way of garnering wealth, then this is the first thing that they will gladly trample without a thought; as appropriately put by Samuel Johnson: "Patriotism is the last refuge of the scoundrel." They will not think twice before mortgaging national interest if it suits their purpose; even sell it a few silvers. But will take refuge to it when everything else fails them.

Thanks for the congratulations.

Looked at it from Indian perspective, I don’t blame the Indians. It is natural for them to want to do so to Nepal in their national interest. By what gets my goat is the attitude of the people in Nepal wanting to perpetuate what you have termed, appropriately, resource colonialism of India. I call it reverse colonialism: people of host country eagerly wanting to be colonized in this age and time. I know many people in Nepal who treat Indians as their masters, make themselves available at Indian beck and call in their eagerness to oblige. A nasty word that comes to my mind, begging your pardon, is intellectual prostitution.

I agree with you that as an upstream country Nepal is providing environmental services which are valuable to India without her asking. But the beneficiary is a modern imperialist who doesn’t believe in all this. The problem is further aggravated by the people in Nepal who, far from demanding recompense for such benefits accruing to India, want to go about mindlessly building huge dams in Nepal just to provide flood control services during wet season and irrigation services in the dry season free of cost which are generated at huge cost in terms of inundation of valuable land and involuntary displacement of the inhabitants.

Ratna,

nice one.. I am particularly pissed off with what is now resource colonialism... a sort of energy factory farming. Is like Nepal doesn't have any intrinsic value other than as a supplier for India.. which gets us back to historically nasty patterns of Patron client relationships and unequal contacts....one could be forgiven for thinking the objective is to progress not fall back on old exploitive models.. so congrats.. What you didn't consider and may be the topic for your next treatise is the environmental services value of the rivers, valleys and forests by just being there.. ie dams versus cost to the city of clean water etc..
I am trying to put a case to stop a nasty dam on the mainstream Irrawaddy.. Its not I am anti dam, but scale, location, seismology, geology, hydrology, alternative land use, climate change and glacier melting etc.. are not considered.

I now realize that NT did so deliberately. My article was set to be published last week itself. However, they delayed it by a week just to include this interview.

I am glad that they decided as such. Because this proves how hollow the argument of his ilk is. Failing to contradict the points I was driving, the only different point he futilely makes is that Nepal gains from the infusion of convertible foreign currency when Nepal receives foreign direct investment. In my article I didn’t touch on this issue. The gain from the infusion of convertible foreign exchange from FDI is also only apparent because over 99% of such foreign exchange gets used up in the imports (of construction materials, electromechanical equipment, expat salaries, etc.) during implementation of the project itself and Nepal’s gain in the foreign exchange reserve is by about 1% only.

I just had a quick reading of your article. As usual, I found your argument on the subject logical and forceful. Just a factual error, though. Saudi Arabia's GDP is only about US$ 376 billion, not $309 trillion as quoted in your article. In fact, there are only about 15 countries in the world with GDP of more than a trillion dollar. The GDP of China, the second largest economy in the world, is only about US$ 5 trillion.

Hydrocratic dreams: Using hydro-dollars to mitigate our trade deficit is a mirage

Nepal’s balance of trade deficit in the last fiscal year (2009-10) was Rs213 billion; annualized linearly it amounts to Rs320 billion. It was only Rs216 billion the year before. A whopping 48% increase! Our balance of payment was also unfavorable by Rs1.95 billion during the same period (Rs2.92 billion for the year). It was favorable by Rs38 billion the previous year. These indicate that the country’s economy has taken a turn for the worse!

One doesn’t need to be a Nobel laureate economist to deduce that Nepal is technically insolvent and diagnose reduction of these to forestall bankruptcy. The business community, renowned economists and the “hydrocracy” (politicos, bureaucracy, intelligentsia, etc. involved in hydropower) argue that the only way out is to export hydropower. Susan Goldmark, the World Bank country director in Nepal, lent credence to this diagnosis by declaring that Nepal’s GDP could be comparable to that of Saudi Arabia if we exported hydropower; due to which the clamor for hydro-dollars reached a crescendo.

Actually, it is because Nepal for the past two decades concentrated on projects to export hydropower that we are suffering an energy crisis (in both electricity and petroleum products) and have been relegated to the status of net importer of even electricity. The situation will get worse unless policymakers understand that there is much to it than meets the eye and refocus and realign the country’s comprehensive energy policy.

Nepal’s famed economic potential of 43,000 MW will generate 188 billion kilowatt-hours (units) of electricity if implemented at 50 per cent average plant factor (which ranges from 20-25 per cent for storage projects to 65-70 per cent for run-of-the-river projects). Exporting at 5 ¢/unit (the rate for peak-in West Seti power that India’s PTC agreed to) will generate a revenue of $ 9.4 billion/year, which doesn’t bring Nepal anywhere near Saudi Arabia, whose GDP even in 2006 was $ 309 trillion (source: www.nationmaster.com/), impelling one to wonder whether Ms Goldmark did check her facts before pontificating.

Superficial look at the quantum of potential hydro-dollar has made people to jump to the conclusion that exporting power will mitigate Nepal’s balance of payment deficit; which is far from true. Even at a low ballpark cost of $1,000 per kilowatt, implementing 43,000 MW will entail an investment of $43 billion which is beyond Nepal’s means. The only alternative is to build with foreign direct investment which will also mean that almost all of the hydro-dollars will get repatriated from Nepal as return on investment and debt service, except for royalties to be paid to the government (income from hydropower neither attracts income tax nor is electricity VAT-able) and a small amount spent on local salaries; a substantial portion of which will go for expat wages. The operation and maintenance cost of such projects and corporate overheads will also not stay in Nepal. Only about three percent of the hydro-dollars we generate from exporting hydropower (about $282 million) will actually stay in Nepal, and will help ease our balance of payment deficit to that extent only. Rest of the hydro-dollars is merely statistics for Nepal; inflow and outflow simultaneously.

At least statistically, balance of trade will become favorable by the quantum of hydro-dollars; but it requires a closer scrutiny. A country’s economy benefits from value addition due to increased export manifest in favorable balance of trade, triggered by augmented employment as a cascade impact of industrialization necessary for incremental production for export. But in the case of hydro-dollars, value addition will not be commensurate to export; it will rather be limited by the quantum of percolation into Nepal’s economy. Ninety-seven percent of hydro-dollars flowing out of the economy will not meaningfully add value, will neither increase industrialization nor generate employment.

Therefore, Nepal’s priority should be to use hydropower for value addition and to wean ourselves from our dependence on imported petroleum products (which aggravates the balance of trade and payment deficit and causes Nepal Oil Corporation to hemorrhage) to the maximum possible extent by electrifying the public transportation system (also generating carbon offset benefits) thereby ensuring overall energy security (not just in terms of electricity). We must also aim to supplant the use of animal and agricultural residue and firewood which cause indoor pollution that reduces the productive life of, mainly, women, by clean hydropower. We, further, should not just use the electricity to drive the economy to attain normal economic growth rate contrasted to currently prevalent suppressed growth rate but also to achieve accelerated growth rate.

However, it doesn’t mean that hydropower shouldn’t be exported at all. But it would be foolish for Nepal to have projects built to export at around Rs2 per unit, and import at over Rs10 in the name of reducing load shedding problem in Nepal and simultaneously perpetuate our dependency on imported petroleum products. The country’s best interest will be served by buying electricity at the lowest rate from developers capable of building projects cost effectively, and use the electricity to meet our own demand to supplant non-renewable and unclean sources Nepal, not the project developers, should export the remaining electricity at premium price, because demand and price in India is highest when Nepal “spills” energy (wastes generation capacity), during the monsoon.

Good to hear from you.

In English that is called “speaking from two sides of the mouth” and he is right that UCPNM has been inconsistent in its policy and approach towards Nepal’s water resources. I too have pointed this out to them several times publicly and in my articles too. However, Dr Lohani’s present “perspective” on water is also no less important. Because, it was he who signed Mahakali treaty which “surrendered” Nepal’s right to water and the current stance of his is diametrically opposite to what is enshrined in that treaty.

Yes, you have raised a valid point. We, as an upstream country, have absolute territorial sovereignty over the water flowing in our rivers and we shouldn’t allow politicos to fritter this away. Although, Koshi and Gandaki treaties were signed against Nepal’s interest in many respects but these in two treaties India has accepted Nepal’s absolute territorial sovereignty over water of these two rivers (except for water of dry season in the case of Gandaki river).

Thank you very much for sharing the article. The view and analysis on Nationalism by Dr. Lohani should be understood by so called Nationalistic leaders/parties too. He has addressed a crucial character of politics who have two mouth or in popular Nepali saying "Elephants with two different types of teeth."

It will really great, this will be followed by another article about integrated water resource management. We as upstream country and for any infrastructure build on Nepal, what would it be used if we do not possess it? How can we call ourselves sovereign if we cannot make decisions and use resources for our own benefit. It is the time that decision makers should answer to their own character/action rather than blaming others/history only.

पंक्तिकार एक जना नेवार हो र नेवार भएकोमा गर्व गर्दछ । किनभने आज नेपाली संस्कृति वास्तुकला, शिल्पकला आदि सबैमा नेवार संस्कृति वास्तुकला, शिल्पकलाको अमीत छाप छ भने नेपाल राष्ट्रको नामै पनि नेवारहरुको तत्कालिन राज्यको नाम नेपालमा नैं आधारित छ । गोर्खाका शाह राजाहरुबाट पराजित हुनु अघि नेवारहरुको राज्यलाई नैं नेपाल भनिन्थ्यो । पृथ्वी नारायण शाहबाट पराजयोपरान्त बिजयी गोर्खा राज्यमा नेपाल राज्य नगाभिएर नेपाल राज्यमा गोर्खा राज्य मात्र गाभिएन पूर्वमा टिष्टा देखि पश्चिममा कांगडा सम्मको गोर्खा राज्यद्वारा बिजित प्रदेश/भूभाग पनि नेपाल कहलियो, आज पर्यन्छ कहलिएकोछ । आज नेपाली सांस्कृतिक रिति रिवाज भनिएका अधिकांश सांस्कृतिक रिति रिवाज नेवारहरुको सांस्कृतिक रिति रिवाज हो भने पगोडा शैलीको मन्दिर देखिका सबै जस्तो वास्तुकलामा नेवारहरुको अमित छाप छ । त्यस्तै ख्याती प्राप्त नेपाली शिल्पकला भनेकै नेवार शिल्पकारहरुको पसिनाको पहिचान हो ।

यस्तोमा जातिय पहिचान सहितको राज्य पुनःसंरचना गरिनाले अढाई शतक पछि नेवा राज्यको पुनःस्थापना हुने कुराले यस पंक्तिकारलाई सतहि हिसाबले केहि समय खुशी बनायो । जातिय पहिचान सहित संघियतामा जांदा बहिस्करणमा परेका, सीमान्तकृत, उपेक्षित, उत्पिडित, पाखापारिएका र पछाडी पारिएकाको समस्या समाधान हुने भिनंदा हौसिनु स्वाभाविक नैं हो । किनभने राजधानी काठमाडौं जस्तो सापेक्षरुपमा समृद्ध, सुसम्पन्न ठाउंमा जन्मेर पनि यो पंक्तिकार बहिस्करणमा परेको, सीमान्तकृत, उपेक्षित, उत्पिडित, पछाडी पारिएको, पाखापारिएको वर्गमा पर्दछ । अन्य धेरैले राज्यबाट पाएको छात्रबृत्ति, पदोन्नती, कदर, विशेष सुविधा जस्ता कुनै पनि कुरा यस पंक्तिकारले कहिल्यै पाएन ।

साथै यस पंक्तिकारका पूर्खा माथि पृथ्वी नारायण शाहले गरेको उत्पिडनले नेवा राज्यको पुनःस्थापनाको अवधारणाले पनि केहि आकृष्ट गरेको हो, जुन घटनाको उल्लेख लिखित इतिहांसमा कतै पनि छैन, कीर्तिपुरका बासिन्दाका नाक कान काटिएको घटनाको उल्लेख भएतापनि । तत्कालिन मल्लहरुद्वारा शासित नेपाल राज्यका शासकहरु पराजयोपरान्त भूमिगत भएकोमा पृथ्वी नारायण शाहले आम माफी घोषणा गरे अनि यो घोषणामा विश्वास गरेर सार्वजनिक हुने सबैको आम हत्या गरियो । यिनको घोषणा नपत्याउनेहरु, यिनलाई विश्वास गर्न सकिन्न भन्नेहरुका सन्तान मात्र आज बांकी छन, धेरै समय सम्म र केहि पुस्ता भूमिगत बसेको हुनाले । यस्तो नृसंश घटनाको उल्लेख लिखित इतिहांसमा छैन ।

जातिय संघियताको बिपक्षमा
तैपनि यस पंत्तिकार पहिला नेपाली अनि मात्र नेवार हो र जातिय आधारमा नेपाललाई प्रान्तियकरण गरेर सीमान्तकृत, उपेक्षित, उत्पिडित, आदिको समस्या समाधान नहुने र बरु नेपालको अखण्डतामा आंच आउने सम्भावना देखेकोले जातिय संघियताको पक्षमा उभिन असमर्थ छ । किनभने जतिसुकै संख्यामा संघियताको नाममा नेपालको बिखण्डण गरेतापनि हरेक प्रान्त एकात्मक नैं रहनेछ र सीमान्तकृत उपेक्षित उत्पिडित आदिका समस्या समाधान हुनेछैन ।

सांच्चिकै सीमान्तकृत, उपेक्षित, उत्पिडित आदिका समस्या प्रान्तियकरणबाट समाधान हुने भए दोहरो बहिस्करण, सीमान्तिकरणमा परेका ५० प्रतिशत भन्दा बढीको संख्यामा रहेका महिलाहरुको लागि छुट्टै प्रान्त घोषणा गर्न जरुरी हुन्छ । तर समस्याको समाधान महिलाहरुको पहिचान सहितको छुट्टै प्रान्त निर्माण गरेर हुन्न । बरु जीवन उराठ लाग्दो मात्र हुन्न श्रृष्टि नैं रोकिन्छ ।

जातिय संघिय संरचनाको विभिषिकामा परेर आजको विश्व मानचित्रमा युगोस्लाभियाको अस्तित्व बांकी छैन र त्यहि कारणले सोभियत रुस बिखण्डण भएर पहिले भन्दा सानो रुस मात्र बांकी छ । नेपालले पनि यो बाटो पछ्याएर इतिहांसबाट पाठ नसिक्ने महाभूल गर्नु हुन्न ।

समस्याको पहिचान र समाधान
पुरानो नेपालमा धेरै बिकृति, बिसंगति, समस्या छन् र नयां नेपाल निर्माण गर्ने आवश्यकता निर्बिबाद छ । तर यसको लागि समस्याको ठीक पहिचान गरेर समाधानको उपायहरु पहिल्याउन र कार्यान्वयन गर्न आवश्यक छ । अर्थात रोग ठीक निदान गरेर मात्र पुग्दैन आवश्यक ओखति र मात्रा, अनि सेवन गर्ने उचित तरीका यकीन गर्न जरुरी छ । औषधी ठीक परेतापनि परिमाण सेवन गर्ने तरीका ठीक भएन भने रोग निको हुनुको सट्टा बल्झने मात्र होइन बिरामीको मृत्यु नैं हुन सक्छ । तर अहिलेको नयां नेपालको नारा नयां सिसिमा पुरानो रक्सी समेत नभएर पुरानै सिसिमा पुरानै रक्सी र लेबल मात्र नयां टांसिएको अवस्था छ ।

पुरानो नेपालको समस्या समाधानको लागि संघियतालाई उपायको रुपमा अघि सारिएको छ । संघियताका राम्रा पाटाहरु पनि छन् तर सीमान्तिकरण, बहिस्करण, उत्पिडन, आदिको समाधान आत्मनिर्णयको अधिकार सहितको जातीय प्रान्तियकरणबाट हुन्न ।

सामन्तबाद, एकात्मक शासन प्रणाली बिरुद्ध भन्दै संघियता पक्षधरको गैर लोकतान्त्रिक र असहिष्णु ब्यबहारले निरंकूशताको झझल्को दिन्छ । संघियताको बिरोधमा उभिनेको नाक काट्ने, नेवा राज्य खडा गर्नु बुद्धिमत्तापूर्ण काम होइन भन्नेलाई काठमाडौं छोडेर जाने उर्दी दिइन्छ जुन लोकतान्त्रिक आचरण होइन । निरंकूस राजतन्त्रलाई फाले पछि देशको बिखण्डण चाहने केहिको निरंकूशता सहन जनता बाध्य छैनन् ।

जातिय प्रान्तियकरण
जातिय आधारमा प्रान्तियकरण गरे पछि मिश्रित बैबाहिक बन्धनमा भएकाले के गर्ने भन्ने प्रश्न पनि खडा हुन्छ । लोग्ने स्वास्नी पारपाचुके गरेर समस्या समाधान हुन्न । युगोस्लाभिया टुकि्रएर बनेको स्लोभेनिया, क्रोयसिया, बोस्निया-हर्जेगोभिना, मासेडिनिय, मोन्टेनेग्रो, सर्बिया, कोसभो आदिमा मिश्रित बिबाह गरेका पति पत्नीले भोगेको यातनाबाट सिक्न जरुरी छ । अझ जातिय प्रान्तियकरण पछि मिश्रित बिबाहबाट जन्मेका सन्तानले भोग्ने समस्या प्रति पनि संबेदनशील हुन जरुरी छ । जातिय प्रान्तियकरण पछि भएको बसाई सराईको समस्याले जातीय विद्वेष फैलाउन सक्दछ र भारत पाकिस्तान बिभाजनबाट शिक्षा लिन वान्छनिय छ । यसै पनि यो समस्या अहिले नैं तराईबाट शुरु भई सक्यो र कतिपय नागरिक आफ्नै देशमा शरणार्थी भई सकेका छन् ।

अग्राधिकार र शासकीय संयन्त्र
जातिय प्रान्तियकरण आफैमा खराबी छैन होला । तर यससंगै अगाडी सारिएका जातिय अग्राधिकार र शासकीय संयन्त्रमा जाती विशेषको हालीमुहाली रहने प्रावधानले जातिय विद्वेष फैलाउनेछ । जातिय आधारमा गठित प्रान्तमा एउटा जाती विशेषलाई अग्राधिकार दिने बताई्रएकोछ । यस्तोमा त्यस प्रान्तमा बस्ने अन्य जातिय समूहहरु दोश्रो दर्जाको नागरिक बन्नेछन् र यसले धेरै समस्या निम्त्याउनेछ ।

यस्तै जातिय आधारमा गठित प्रान्तमा एउटा जाती विशेषले शासकीय संयन्त्रमा विशेष स्थान पाउने व्यवस्था हुने भनिएको छ । जातिय आधारमा बन्ने भनिएका कुनै पनि प्रान्तमा विशेष जातिय समूहको बहुमत नहुनाले जस्तै प्रस्तावित नेवा राज्यमा नेवारहरु अल्पमतमा छन्, मूलत बहुमत माथि अल्पमतको शासन हुने अवस्था हुन्छ जुन लोकतन्त्रिक परिपाटी अनुकूल होइन र कसै गरेर पनि स्वीकार्य हुन्न ।

जनताको चाहना
२००७ साल सम्म १ सय ४ वर्ष जहानिया राणा शासन थियो, शाह राजाहरुलाई खोपाको देउता बनाइएर । सात सालको क्रान्तीले निरंकुश राजतन्त्र पुनःस्थापना गर् यो, जुन २०४७ साल सम्म कायम रहुे । पहिलो जनआन्दोलनले प्रजातन्त्र ल्यायो भने दोश्रो जनआन्दोलनले लोकतन्त्र ल्यायो भनिन्छ तर जनता के चाहन्छन् भन्ने नबुझेरै देश बिखण्डिकरण अझ विश्वको नक्साबाटै गायब पार्ने तिर उद्यत भएकाछन् । भनिन्छ संबिधान सभाको राज्य पुनःसंरचना समितिले सर्वसम्मतिबाट पहिचानको आधारमा संघियतामा जाने निर्णय गर् यो रे !

तर इन्टर डिसिप्लिनरी एनालिस्ट्स (IDA) ले गरको जनमत सर्वेक्षण जसको नतिजा, नेपाल साप्ताहिकमा २०६८ बैशाख ४ को अंकमा प्रकाशित भएकोछ, अनुसार संघियता बारे सुनेका ४९ प्रतिशत मात्र छन्, यी मध्ये कतिले संघियता बारे बुझेका छन् भन्ने प्रश्न खडा हुन्छ । त्यो पनि सुनेको छ भन्नेको औसत समर्थन ४.२ रहेको देखिएकोछ (शून्यले सबभन्दा कम समर्थन १० ले सबभन्दा बढी समर्थन र ५ ले न बढी न कम समर्थन भन्ने संकेत गर्छ) । यसबाट जनतामा संघियताप्रतिको समर्थन कम नैं रहेको विश्लेषण गर्न सकिन्छ । नेवारहरु मध्ये पनि जातिय संघियता प्रति समर्थन ४.२ मात्र रहेकोछ । अर्थात संघियता चाहने अल्पसंख्यक नेवारहरु मध्ये पनि नेवा राज्यको स्थापना प्रति समर्थन आधा पनि छैन ।

संघियतामा जांदा देश कस्तो हुन्छ भनेर जनतम सर्बेक्षण गरिएकोमा ६२ प्रतिशतले थाहा नभएको बताइएकोले संघियता सम्बन्धमा जनमानसमा प्रष्टताको अभाव देखिन्छ । २१ प्रतिशतले देश बिभाजन हुने आशंका व्यक्त गरे भने १४ प्रतिशतल् देश कमजोर हुन्छ भन्ने बिचार राखेका छन् । ७ प्रतिशतले मात्र स्थानिय तहमा अझ धेरै विकास हुने आशा राखेकाछन् । यसले आमजनताले संघियताका सकारात्मक भन्दा नकरात्मक पक्षहरु हावी हुने उल्लेख गरेकाछन् ।

यस्तै संघियताको आधार के हुनुपर्छ भन्ने प्रश्नको उत्तरमा ५४ प्रतिशतले थाहा छैन/भन्न सकिन्न भनेकोमा १४ प्रतिशतले भने संघात्मक राज्य नैं हुनुहुन्न भनेका छन् । १० प्रतिशतले त यसबारेमा सुने पनि नबुझेको बताएको कुरा संप्रेषण भएकोछ । ४ प्रतिशतले मात्र जातिय आधारमा राज्य पुनःसंरचनाको पक्षमा मत व्यक्त गरेको समाचार प्रकाशित भएकोले बहुमत जनताको इच्छा बिपरित जातिय आधारमा नेपाललाई प्रान्तिकरण कुनै हालतमा गर्न उपयुक्त हुन्न ।

स्वायत्त नेवा राज्यको स्थापनाको दृष्टिकोणबाट चाखलाग्दो कुरा के पनि उद्घाटन् भएको छ भने ७३ प्रतिशत नेवारले आफूलाई नेपाली भनेर चिनाउन चाहेका छन् भने २ प्रतिशतले मात्र नेवार मात्र भनेर चिनाउन चाहेका छन् । यस पंक्तिकार पनि पहिले नेपाली हो अनि मात्र नेवार र यो देश टुकि्रन बिखण्डन हुन सक्ने कुनै पनि कार्य प्रति समर्थन गर्न असमर्थ छ । नेपालको नैं अस्तित्व खतरामा पर्ने कार्य त कुनै पनि हालतमा हुन दिने पक्षमा छैन ।
काठमाडौंको अधिनायकबाद
संघियताका पक्षपोषकहरु काठमाडौंको अधिनायकबादको कारण संघियतामा जानु अपरिहार्य भएको बताउंछन् । पृथ्वी नारायण शाहले नेपाल एकिकरण गरे पछि गोरखाका शाहहरुले शासन गरेको २४० वर्ष मध्ये २००७ साल सम्म १०४ वर्ष राणाहरुको अधिनायबाद रहुे, बांकी मध्ये केहि वर्ष थापा, पाण्डे, बस्न्यात, आदिको कुशासन काठमाडौं लगायत सम्पूर्ण देशले खेप्यो । यस्तै सात साल पछि २०४७ साल सम्म शाहहरु निरंकुश राजतन्त्र रहुे । २०४७ पछि झण्डै २ वर्ष गोरखाका भट्टराई १२ वर्ष भन्दा बढी बिराटनगरिया कोइरालाले शाषण गरे अनि डडेलधुरा डोटीका देउबा चन्द धनकुटेली थापाले पालो पाए ।

संबिधान सभा निर्वाचन पछि कास्की र चितवनका प्रचण्ड अनि रौटहतका माधव नेपाल र अहिले इलामका खनालको शासन छ । यी मध्ये कोहि पनि काठमाडौंका होइनन् । एकिकृत नेपालमा काठमाडौंले अधिनायकबाद लाद्नै पाएको छैन र यहि कारण देखाएर देश बिखण्डित गर्न गर्नु भनेको बांदरले िझंगाको रिसले मालिकको नाक काटे जस्तै हुन्छ । तर िझंगा दोषी भएतापनि काठमाडौंले त अधिनायकबाद कहिल्यै लादेको छैन र नलादेको अधिनायबादको दोष देखाएर नेपालको अस्तित्व नैं मेट्ने काम गर्नखोज्नु बुद्धिमत्तापूर्ण काम होइन ।
१० जातीय प्रदेश
संबिधान सभाको राज्य पुनःसंरचना समितिले पारित गरेको भनिएको १४ प्रान्तको अवधारणामा १० जातीय आधारका प्रान्त छन् । नेपालको क्षेत्रफल १ लाख ५० हजार वर्ग किलोमिटरको हाराहारीमा छ र १४ प्रान्त बनाउंदा औसत १० हजार वर्ग किलोमिटरको एक प्रान्त हुन आउंछ । यस सन्दर्भमा संघियतामा गएका मुलुकहरुका प्रान्तहरुको क्षेत्रफल दृष्टिगत गरेर मनन् गर्न जरुरी छ ।

मानिसहरु रुसमा ८० भन्दा बढी प्रान्त, संयुक्त राज्य अमेरिकामा, ५० चीनमा २० भन्दा धेरै र भारतमा ३० भन्दा बढी प्रान्त हुनाले नेपालमा १४ प्रान्त बनाएर फरक पर्दैन भन्दछन् । तर रुसको क्षेत्रफल १ करोड ७० लाख वर्ग किलोमिटर छ र एक प्रान्तमा औसत २ लाख वर्ग किलोमिटर पर्न आउंछ । त्यस्तै संयुक्त राज्य अमेरिकाको क्षेत्रफल ९६ लाख वर्ग किलोमिटर भएकोमा एक प्रान्तमा औसत १ लाख ९२ हजार वर्ग किलोमिटर पर्छ । त्यस्तै नेपालको उत्तरी छिमेकी चीनको कूल क्षेत्रफल ९६ लाख वर्ग किलोमिटर छ र एक प्रान्तमा औसत ४ लाख ३६ हजार वर्ग किलोमिटर पर्छ । अनि भारतको क्षेत्रफल ३३ लाख वर्ग किलोमिटर भएकोमा एक प्रान्तमा औसत १ लाख वर्ग किलोमिटर पर्छ । यस पृष्ठभूमिमा नेपाल जस्तो सानो मुलुक अझ साना साना प्रान्तमा टुक्र्याउनु औचित्यपूण हुन्न ।

जनसंख्याको दृष्टिकोणबाट पनि १४ प्रान्त समबन्धमा विश्लेषण गर्नु समसामयिक हुनेछ । संयुक्त राज्य अमेरिकाको जनसंख्या २८ करोड छ र एक प्रान्तमा औसत ५६ लाख जनसंख्या बस्छन् भने चीनमा एक प्रान्तमा औसत ५ करोड ८३ लाख भने भारतमा ३ करोड १७ लाख बस्छन् । तर नेपालमा १४ प्रान्त बनाइएपछि प्रत्येक प्रान्तमा औसत २० लाख जनसंख्या पनि पर्दैन ।

माथि उल्लिखित देशहरुमा धेरै प्रान्त हुनुमा समयको पनि महत्वपूर्ण भूमिका भएको कुरा बिसर्िन्छन् । संयुक्त राज्य अमेरिकामा ५० प्रान्त छन् त त्यस देशको पश्चिमि सीमानामा दिउंसो १ बजेको समयमा पूर्वी सीमानामा सांझको ६ बजीसकेको हुन्छ । त्यस्तै रुसका पश्चिमि सीमानामा दिउंसो १ बजेको समयमा पूर्वी सीमानामा मध्ये रात हुने हुनाले ८० भन्दा धेरै प्रान्त हुनु व्यवहारिक आवश्यकता पनि हो । तर यस हिसाबले पनि नेपाल धेरै सानो हुनाले यसलाई ससाना टुक्रामा बिखण्डित गर्नु बुद्धिमत्तापूर्ण कार्य हुनेछैन ।

१०० भन्दा बढी जातीय समूह
मानवशास्त्रीहरुका अनुसार नेपालमा १०० भन्दा बढी जातीय समूह छन् । यस्तोमा १० वटा प्रान्त मात्र जातिय आधारमा खडा गर्दा बांकीलाई मान्यता नदिएको ठहर्नेछ । यस सम्बन्धमा किन भनेर प्रश्न गिरंदा नमागेकोले बांकी जातिय समूहलाई नदिइएको भन्ने गरिन्छ । यसको मतलब बांकी ९० वटा भन्दा बढी जातिय समूहले मांग गर्ने वित्तिकै यो सानो मुलुकलाई अर्को ९० भन्दा बढी प्रान्तमा बिभाजित गर्नुपर्ने बाध्यता आईलाग्नेछ र यस्तो मांगको उपेक्षा गरिएमा जातिय द्वन्द्व निम्त्याउने काम हुनेछ । यसरी मागे पछि िदंदै जाने गर्नाले टोलटोलमा प्रान्त बनाउनुपर्ने अवस्था श्रृजना हुनेछ जुन भनेको भानुमतिको पेटारो खोले जत्तिकै जोखिमपूर्ण हुन्छ ।

जातिय द्वन्द्व
जातिय आधारमा प्रान्तियकरण गर्दा प्रान्तहरुको सीमांकनको विषय पनि जातिय द्वन्द्वको झिल्कोले ठूलै बिनास गर्नसक्ने सम्भावनालाई पनि मध्येनजर गरिनुपर्छ । अहिले नैं नेवा राज्य र ताम्सािलंग राज्य बीच सीमांकन सम्बन्धमा बिबाद खडा भईसकेकोछ भने लिम्बुवान, खुम्बुवान, किरांत आदि राज्यहरु बीच पनि यस्तै द्वन्द्वमय स्थिति देखा पर्दैछ । तसर्थ जातिय आधारमा प्रान्तियकरण गर्ने भनेको जातिय द्वन्द्व निम्त्याउंदै काम हो र यसले गर्दा जातीय बिद्वेष फैलने सक्ने सम्भावनालाई गम्भिरतापूर्वक मनन् गरिनुपर्दछ ।

धेरै वटा प्रान्त बनाउंदा प्रान्तिय राजधानी कहां रहने भन्ने विषय पनि झगडाको बिउ हुनजान्छ । २०६७ आषाढ २६ गते क्षेत्रिय रंगशाला धरानमा कि इटहरीमा निर्माण गर्ने भन्ने बिबादमा राष्ट्रिय खेलकूद परिषदमा हात हालाहाल र तोडफोड भयो भने मध्य पश्चिमांचल विकास क्षेत्रमा स्थापित गर्ने भनिएको विश्वबिद्यालय सुर्खेतमा कि नेपालगंजमा भन्ने बिबादले निम्त्याएको झगडामा यो मुलुकले आवश्यकरुपमा धनजन क्षति भोगेको बिस्मृतिमा पार्नु बुद्धिमत्तापूर्ण काम होइन ।

अन्तरिम संबिधान
जातिय आधारमा संघियताको पृष्ठपोषण गर्नेहरु अन्तरिम संबिधानमा नेपाललाई संघिय राज्य घोषणा गरिईसकेकोले संघियताबाट पछाडी फर्कन मिल्दैन भन्ने गर्दछन् । विशेषतः अन्तरिम संबिधानको धारा १३८(१) मा पहिलो संशोधनबाट परिवर्तन गरेर यस्तो गरिएकोमा जनताले नचुनेको अन्तरिम व्यवस्थापिकालाई यस सम्बन्धमा अधिकार थिएन । जनताले संघियता के हो, यसले के कस्ता अनुकूल प्रतिकूल प्रभाव पर्छ भन्ने बुझ्नु पर्छ र त्यसपछि मात्र निर्णयमा पुगिनुपर्छ । जनताद्वारा निर्वाचित संबिधान सभालाई मात्र यस सम्बन्धमा निर्णय गर्ने अधिकार छ र अझ आवश्यक परे जनमत संग्रहमा जानुपर्छ ।

अन्तरिम संबिधान लेख्नेले र अन्तरिम संसदले गरेकै निर्णय अन्तिम हुने भए दसौं अर्ब खर्च गरेर किन संबिधान सभाको चुनाव गरेको र दसौं अर्ब खर्चमा किन ६ सय १ जना सभासद्लाई पालेको भन्ने प्रश्न पनि खडा हुन्छ । तसर्थ संबिधान सभाका सम्पूर्ण सदस्यहरुलाई जातिय आधारमा गरिने राज्य पुनःसंरचना त्यो पनि जातिय अग्राधिकार र शासकीय संयन्त्रमा जाती विशेषको हालीमुहाली रहने गरेर संघियतामा जांदा देश र जनता माथि के कस्तो प्रभाव पर्छ भन्ने कुरा बोध गराएर मात्र यस सम्बन्धमा निर्णय निरोपण गरिनुपर्छ ।
सर्बोच्च अदालत
जातिय आधारमा संघियताको वकालत गर्नेहरुले सर्बोच्च अदालतले समेत संघियता सम्बन्धित व्यवस्था अपरिवर्तनिय मानेको हुनाले यसमा कुनै परिवर्तन नहुने भन्ने गरेकाछन् । यस्तो भन्ने अधिकार संबिधानमा सर्बोच्च अदालतलाई नैं छैन किनभने सार्वभौमसत्ता सम्पन्न जनताले निर्वाचित गरेको संबिधान सभालाई निर्माणाधीन संबिधानको सन्दर्भमा यो यति कुरा परिवर्तन गर्न पाउंदैन भन्ने अधिकार सर्बोच्च अदालतलाई छैन । त्यस कारण सर्बोच्च अदालतको यस सम्बन्धी धारणा पूर्णतः असंबैधानिक छ । सम्झन के जरुरी छ भने सर्बोच्च अदालतकै अधिकार पनि अब लेखिने संबिधानले तोके बमोजिम हुनेमा नयां आउने सम्बिधानमा के प्रावधान राख्ने के नराख्ने सम्बन्धमा सर्बोच्च अदालतलाई फैसला गर्ने अधिकार छैन ।

जातिय अग्राधिकार र शासकीय संयन्त्रमा जाती विशेषको हालीमुहालीको व्यवस्था रहेको अवस्थामा नेपालमा नेपाली नैं दोश्रो दर्जाको नागरिक बन्ने र अल्पमतले बहुमत माथि शासन गर्ने प्रावधानले नागरिकको मौलिक अधिकार समेत उल्लंघन गर्नेमा यस्तो किसिमको संघियतालाई अपरिवर्तनिय मानेर सर्बोच्च अदालतले गरेको फैसला समेत नागरिकको अन्तर्राष्ट्रिय रुपमा मान्यता प्राप्त मौलिक अधिकारको सिद्धान्तको बिपरित छ ।
एमाओबादीको रवैया
संघियताको अवधारणाको प्रणेता एमाआबादी दल रहेकोमा कुनै शंका छैन । विशेष गरेर बहिस्करणमा परेका, सीमान्तकृत, उपेक्षित, उत्पिडित, पाखापारिएका र पछाडी पारिएकाको समस्या समाधानार्थ संघियतालाई अगाडी सारिएको हो । जस अन्तर्गत जातिय अग्राधिकार र शासकीय संयन्त्रमा जाती विशेषको हालीमुहाली रहने व्यवस्थाको मांग पनि यहि दलले गरेकोछ ।

तर यसै दलको विभिन्न जातिय राज्य समितिको संरचना हेर्दा एमाओबादी दल यस सम्बन्धमा गम्भिर देिखंदैन । कोचिला राज्य समिति देखि तमुवान राज्य समिति सम्मका अधिकांश प्रमुखहरु ब्राम्हन समुदायबाट भएकोबाट यो कुरा छर्लङ्गिनाले एमाओबादीकै यस सम्बन्धी भनाई र गराईमा ठूलो अन्तर छ ।
आर्थिक बोझ
अहिले एक/एक वटा राष्ट्रपति, उपराष्ट्रपति, प्रधानमन्त्री र ४०/४५ जनाको मन्त्रीमण्डल, अनि व्यवस्थापिका, न्यायपालिका लगायत बिभिन्न आयोगहरुको लागि वार्षिक झण्डै १ अर्ब रुपैयाँ खर्च हुनेगरेको देखिन्छ । १४ प्रान्तमा नेपालको बिभाजन पछि हरेक प्रान्तमा गभर्नर तथा मुख्य मन्त्री सहितको २०/२५ जनाको मन्त्रीमण्डल, न्यायपालिका लगायतका विभिन्न आयोगहरुको लागि थप ८/१० अर्ब रुपैंया खर्च हुने निश्चित छ । स्वच्छ खानेपानी नपाएर झाडापखालाबाट र खाद्यान्न नभएर अनिकालबाट नागरिक मरिरहेको यो देशले यसरी थप खर्च गर्नु औचित्यहिन हुन्छ ।

अहिले स्थानिय विकासको लागि विनियोजना गरिएको रकमको ४० प्रतिशत भन्दा कम रकम मात्र स्थानिय विकासको कार्यान्वयनमा खर्च हुन्छ र बांकी प्रशासनिक खर्च हुन्छ भने बिभिन्न प्रदेशहरुको एक तह थप शासकिय संरचना बढ्दा स्थानिय बिकासमा खर्च हुने रकम घटेर ३० प्रतिशत भन्दा कममा झर्नेछ ।

जलश्रोतको दोहनको हिसाबले संघियता
नेपाल जस्तो सानो मुलुकलाई आत्मनिर्णयको अधिकार सहित जातिय आधारमा राज्य पुनःसंरचना गरेर संघियतामा जांदा जातिय विद्वेष फैलने देश टुकि्रने देखि देशको अस्तित्व नैं जोखिममा पर्ने हुनाले जातिय पहिचानको नाममा १४ प्रान्तमा बिखण्डिकरण गर्नु कदापि हुन्न । अर्को तर्फ नेपाललाई जलश्रोतमा धनी मानिए पनि घरहरुमा धाराहरु छन् तर पानी आउंदैन जलबिद्युत उत्पादनको अथाह सम्भावना छ तर उपभोक्ता लोडसेिडंगको मारमा बसेकाछन् । तसर्थ नेपाल र नेपालीको सर्बोच्च हितलाई मध्ये नजर राखेर जलश्रोतको अत्यधिक दोहन सम्भव हुने गरेर राज्यको पुनःसंरचना गर्नु उपयुक्त हुन्छ ।

तसर्थ यस पंक्तिकारको बिचारमा राज्यले जलश्रोतको अधिकतम दोहन सुनिश्चित गर्ने हिसाबले तीन प्रान्तहरु बनाउन उचित हुन्छ । पहिलो सप्तकोशी-मेची प्रान्त जसमा सिन्धुपलान्चोक जिल्लामा उद्गम रहेका मेलम्ची लगायतका कोशी नदीको सहायक नदीहरुको जलाधार क्षेत्र देखि पूर्वी नेपालको सम्पूर्ण भेग रहनेछ । मेची नदीको जलाधार सानो हुनाले यसलाई पनि यहि प्रान्तमा समाबेश गर्नु आर्थिक दृष्टिले उचित देखिन्छ ।

दोश्रो प्रान्त सप्तगण्डकी नदीको जलाधार क्षेत्रलाई बनाउनु पर्छ । यसमा रसुवा जिल्लाको चिलिमे देखि पश्चिम तर्फ गण्डकी नदीको सबै सहायक नदीहरुको जलाधार क्षेत्र समेटिनुपर्छ । तेश्रो प्रान्त कर्णाली नदीको जलाधार क्षेत्रमा महाकाली नदीको जलाधार क्षेत्र समेत समेटेर कर्णाली-महाकाली प्रान्त घोषणा गरिनुपर्छ । महाकाली नदीको जलाधार क्षेत्र नेपालमा सानो हुनाले यो नदीको जलाधार क्षेत्र र कर्णाली नदीको जलाधार क्षेत्रको एउटा प्रान्त बनेमा यी दुवै नदीको अत्यधिक दोहन सम्भव हुन्छ र नेपाल र नेपालीको सर्बोच्च हितमा यी नदीको पानीको सदुपयोग हुनसक्दछ ।
