I have just read the communiqué from the president’s office verbatim (printed in today’s Kantipur) and the reaction of BRB care taker government and its remonstration against the president’s refusal.

BRB and his cronies are forgetting (or are in denial) that they have already been rendered care taker government. Some people (even Madhav Nepal) are demanding BRB’s resignation which is redundant as it already is a care taker government. BRB too is refusing to resign and PKD is goading him to do so!

In this backdrop, in my considered opinion, the communiqué should also have pointed out that only a government with executive authority is empowered to promulgate ordinances; care taker government has no authority to promulgate any ordinance whatsoever, irrespective of whether essential ones or otherwise.

I am both encouraged and enthused to learn of news that president has refused to promulgate ordinances related to election that could not be held. I request you to extend gratitude of yours truly and on behalf of conscious and concerned citizenry of Nepal.

A care taker government without executive authority has no authority, whatsoever, related to promulgation of any ordinances, essential ones or otherwise.

BRB and his cronies have effectively captured the state for more than 2 months. One of their conditions to vacate the government is: other parties should agree to state restructuring on ethnocentric lines which is absolutely unacceptable not only because I personally don’t like it but also because more than two-thirds of people of Nepal don’t like it as indicated by several polls conducted recently. Effectively they are holding the nation on ransom to ram their demand of ethnocentric federalism through peoples’ throat. We cannot/shouldn’t give in to this irrational blackmail.

The only way out is to lock-out this unconstitutional group of people strutting around as care taker government from the seat of governance (Singh Darbar and other ministries) and also lock-out of government treasury (one instruction to NRB will suffice) that belong to the people of Nepal.

At the moment the president is the only constitutionally legitimate executive authority of Nepal and anything he does to rid Nepal of this group of people will be constitutionally appropriate. Otherwise, state capture will become a norm rather than exception.

SD Muni isn't Viceroy to Nepal

The likes of him behave in arrogant manner towards people in Nepal, almost like a viceroy to Nepal would do. He is not alone in this. I have come across multitude of them. But I don’t see their fault in all this. The fault lies in we people in Nepal who think they are much more important than they actually are. People sit on their hands to receive gem of “wisdom” from them, rush on their knees to meet them. Even president of Nepal has been granting “audience” to such people (even ones who come to pay “homage” to Pashupati on short notice) when even a sitting minister of Nepal has to file petition well ahead of time to meet her/his counterpart minister of India.
Nepal’s ambassador in Delhi is not allowed to go beyond the ring road of Delhi without prior approval from external affairs ministry. But the counterpart in Nepal roams around the country, distributing largesse, as would a viceroy do.

In my considered opinion, it is a case of reverse colonization. India hasn’t dared to call Nepal a colony. But people in Nepal (we can include PKD, BRB et al in this) behave as if we already are a colony comparable to Bhutan if not a province like Sikkim (that is what some Indians want – there is exception in substantial quantum, though).

This will continue till Nepal succeeds to strike a relationship of equality and reciprocity with India.

Therefore, the best antidote against people with this kind of haughty manner is to pointedly ignore them; don’t simply pay undue importance to what they say or do. Don’t rush to meetings to listen to their pontification. We in Nepal have much more learned people than this breed. But we, unfortunately, like things Indian than Nepali. Till we succeed to change this, this kind of people will continue to with their pontification.

What we have to remember is that India has yet to learn from fiascos like Sri Lankan Tamil and Khalistan movements which were supported, nurtured and funded by India. These ended with untimely/violent demise of Rajib Gandhi and India Gandhi respectively.

Election Commission's position re election of CA

Election Commission has come out with a categorical statement that legal environment to enable it to hold election doesn’t exist. Meaning, the election that the care taker government announced to be held in November 2012 will not be possible. A PM with morals and strong ethical commitment would have resigned. But PM Bhattarai doesn’t need to resign as it already has been rendered care taker, nor does it seem to have any morals or ethics. A parallel exists with an analogy about a fully dressed person feels ashamed while being disrobed in public; however, a naked person does not feel ashamed as it cannot be further disrobed.

In this backdrop it is highly intriguing that the president is yet to call for formation of government under Article 38(1). People are wondering what is impelling him to refrain from calling for formation of a government with executive authority. People would like to believe that president isn’t hand-in-glove with care taker PM and isn’t assisting/abetting care taker government in engendering mayhem and anarchy.

President’s instruction to care taker government to promulgate ordinance

Notwithstanding the fact that I am in complete bed rest subsequent to a surgery (as directed by doctors), I was impelled to send this email after reading a news on above lines which was first published in Rajdhani last Sunday (my first instinct was to ignore thinking that they must have misinterpreted or took something out of context) and subsequently in Kantipur yesterday (after which I was forced to sit in front of my laptop).

They mentioned something about the President instructing the care taker government to promulgate ordinance to enable a Mr Keshav Baral to start working as CIAA commissioner. If this news is baseless or untrue, you can stop reading my email right at this point. If true I, as a citizen of this country on whose education our motherland has invested quite a lot, have every right to be indignant and disturbed (even outraged) for following reasons:

• President himself has made it clear that BR Bhattarai is PM of a care taker government, bereft of executive authority.
• A care taker government cannot promulgate even essential ordinances. Based on this very concept president is demurring from promulgating ordinance to conduct election already forwarded by the care taker government.
• The proposed ordinance isn’t an essential one. I am sure that people will retort by citing Supreme Court order in this respect. The court order was for a government with executive authority not care taker one.
• There is a consensus that care taker government cannot rule by ordinances. Promulgation of this ordinance will amount to just that and pave path to open floodgate of ordinances.
• The news is not that clear but it also implied that the ordinance should pave path to fill vacancies in constitutional bodies, too. One important process enshrined in the constitution in this respect is parliamentary hearing. If this ordinance is to bypass the hearing process then, it also will amount to amendment of the constitution itself by an ordinance. It will amount to high treason (राष्ट्रदोह) on the part of all those involved inter alia advisors to the president and the president himself. BR Bhattarai and his team do not need to bother about this as they have taken part in many serious acts of commission and omission which has already made them liable to be called as such by the posterity.

Dear Prof Lohani

I refrained from responding to your email right away as I wanted to see if the president’s initiative will fructify, as I was apprehensive that I would be branded skeptic had I articulated my thought before the meeting took place. In my considered opinion what was done is too little too late. We are in full agreement as, is generally, usual.

We are being treated to unfolding drama in this respect. UML’ student wing is in the street demanding care taker PM”s resignation. People aren’t even clear as to constitutional position of care taker government. It will be highly embarrassing if even president is awaiting the resignation. Otherwise, why hasn’t he conformed with the provision of Article 38(1) of the constitution.

Incidentally, I am getting admitted in Norvic Hospital today for a surgery to “repair” incisional hernia. I am given to understand that the surgery will be performed sometime in the afternoon.
