संघियता बाधक हुनेछ जलश्रोतको अधिकतम दोहनमा

पूर्णतः एक अराजनैतिक व्यक्तित्व यस पंक्तिकारलाई राष्ट्रिय जनमोर्चाको तर्फबाट शान्तीवाटिकामा जलश्रोत र संघियता सम्बन्धमा गत बैशाख ९ गते प्रवचन दिन निम्ता आउंदा दुई विषयमा घोत्लिन बाध्य पार्यो । कुनै पनि प्रकारको साम्यबादमा विश्वास नगर्ने भएकोले उक्त राजनैतिक दलको निम्ता नैं स्वीकृत गर्ने सम्बन्धमा अन्तरद्वन्द्व भयो । तर लोकतन्त्र, मौलिक हक, कानूनी राज, राजनैतिक नियन्त्रण र सन्तुलन जस्ता मूलभूत सिद्धान्तहरुमा अधिकांश दलहरुमा फरक देखिन्न भने आर्थिक/वित्तिय हिसाबले सबै दलहरु एकै किसिमका देखिन थालेकाछन् । तर देशभक्ती देशप्रेमको हिसाबले भने टड्कारो रुपमा दुई प्रकारका दलहरु देखिएकाछन्; देशभक्ती देशप्रेम भएका दल र राष्ट्रिय स्वार्थसंग सम्झौता गर्ने दल । तसर्थ राष्ट्रिय स्वार्थको सम्बर्धनको मुद्दा उठाएको दलले गरेको आग्रहलाई अस्वीकार गर्ने इच्छा भएन । त्यस पछि विषयवस्तु बारेमा चिन्तन गर्दा उब्जेको निम्न बिचारलाई यहां लिपिबद्ध गरिएकोछ ।

अन्तरिम संबिधानमा संघियता
२०५८ सालको दरबार हत्या काण्डमा तत्कालिन युवराजले आत्महत्या गर्नु अगाडी राजा, रानी (आफ्नै माता, पिता) लगायत सम्पूर्ण राजपरिवारको हत्या गरे पछि - जुन अपराध तिनले नैं गरेको हो भन्ने मान्न धेरै नेपाली अझ पनि तयार छैनन् - नेपालमा चलेको जनआन्दोलन ६२/६३ मा चरमोत्कर्षमा पुग्दा नेपालमा लोकतन्त्र मात्र स्थापना नभएर राजतन्त्रको पनि अन्त्य भयो । जनता आफैले चुनेकॊ संबिधान सभाद्वारा नेपालको संबिधान बनाउने नेपाली जनताको २००७ साल देखि अपूर्ण आकांक्षा परिपूर्ति हुने अवस्था पनि श्रृजना भयो । संबिधानको ढांचा कस्तो हुने, यसमा के कस्ता कुरा लेख्ने लगायत मुलुक एकात्मक नैं रहने कि संघियतामा जाने आदि विषयमा यो सभाले छलफल गरेर निक्र्योल गरी संविधानमा समावेश गर्नुपर्ने हो, तर अन्तरिम संबिधान लेख्ने जिम्मा पाएका बिज्ञहरुले बढी जान्ने भएर संघियता के कस्तो हो, यसले मुलुकमा के कसरी अनुकूल प्रतिकूल प्रभाव पर्छ भन्ने बारे नबुझेरै अन्तरिम संबिधानमा नैं नेपाललाई संघिय राज्य घोषणा गरिदिए । यसले गर्दा एकात्मक राज्य संरचनाले नेपालमा निरन्तरता पाउने कि संघिय संरचनामा जांदा देश र जनता लाभान्वित हुन्छ भन्ने विषयमा छलफल र सहमति गर्ने अवसरबाट संबिधान सभालाई बंचित पारिने अवस्था भएकोछ । तर यसो भन्दैमा अन्तरिम संविधान लेख्नेहरुलाई संविधान सभाकै जस्तो अधिकार सम्पन्न मान्न सकिन्न र यस सम्बन्धमा छलफल, मन्थन, बहस जरुरी छ र यस पछि मात्र निर्णयमा पुगिनुपर्छ नेपाल जस्तो सानो मुलुकलाई बिभिन्न प्रान्तहरुमा बिखण्डित गर्नु लाभदायक हुन्छ कि हुन्न भनेर ।

प्राकृतिक श्रोत
जलश्रोत पनि प्राकृतिक श्रोतहरु मध्ये एक भएतापनि अन्य प्राकृतिक श्रोत भन्दा फरक छ । संघियताको सन्दर्भमा जलश्रोत बारे बिबेचना गर्नु अगाडी जलश्रोत र अन्य प्राकृतिक श्रोतको बीचमा बिद्यमान बिभेद पहिचान गर्न आवश्यक हुन्छ । जमिन, जंगल, जडीबुटी, खनिज पदार्थ जस्ता श्रोत स्थानिय बासिन्दा आफै संलग्न भएर, उद्यम गरेर र उपयोग गरेर लाभान्वित हुनसक्छन्, प्रत्यक्ष लाभ लिन सक्छन्, रुखबाट टिपेर, जमिनबाट उखेलेर, जग्गा उत्खनन् गरेर, खेती गरेर इत्यादि । तर जलश्रोतको प्रकृति फरक छ । स्थानिय बासिन्दाले िसंचाई, लघु जलबिद्युत, जल पर्यटन आदिबाट लाभान्वित हुन सक्छन् तर ठूला जलबिद्युत आयोजना निर्माण भएमा स्थानिय बासिन्दा प्रतिकूल प्रभावमा पर्छन् भने लाभान्वित हुन्छन् अन्यत्र बत्ति बाल्ने जनता ।

नदीको प्रवाहमा आधारित जलबिद्युत आयोजना निर्माण हुंदा आयोजनाको अनुमतिपत्र (लाईसेन्स)ले प्रदान गर्ने जलाधिकारको कारण माथिल्लो तटीय क्षेत्रमा नयां जमिनमा िसंचाई गर्नबाट बंचित हुन्छन्, किनभने आयोजनालाई उपलब्ध हुने पानीको परिमाण घटेमा बिद्युत उत्पादन घट्नाले आयोजानाको राजश्व घटेर लगानिकर्तालाई घाटा हुनेहुन्छ । दृष्टान्ततः कर्णाली आयोजना निमार्ण भएमा जुम्लाका जनताले तीला नदीबाट समेत नयां िसंचाई आयोजना निर्माण गर्नबाट बंचित हुन्छन् । यस अतिरिक्त नदी छेकेर नहर/सुरुङबाट आयोजनामा पानी लैजानाले नदीको एउटा भेग नैं पानी रहित हुनपुग्छ (सडक मार्गबाट पोखरा जांदा मस्यांङदी नदीको यस्तो बेहाल टडकारो रुपमा देखापर्छ) र नदीको यस भेगमा निर्भर स्थानिय बासिन्दा परापूर्व देखि आफूले प्रयोग गर्दै आएको पानीबाट बंचित हुन्छन् । यस्तोमा उत्पादित बिजुली अन्य प्रान्तमा उपयोग हुने भएमा आयोजना निर्माणको लागि स्थानिय जनता राजीहुने सम्भावना अत्यन्त न्यून हुन्छ र सम्भाव्यता अनुरुप जलबिद्युत उत्पादन गर्ने सम्भावना क्षीण हुन्छ ।

जलाशययुक्त आयोजना
नदीको प्रवाहमा आधारित आयोजना भन्दा जलाशययुक्त आयोजनाले स्थानिय जनतालाई अझ बढी प्रतिकूल प्रभाव पार्छ - काली गण्डकी ए आयोजनाले जस्तै नदीमा दिनभरी बगेको पानी संचय गरेर आवश्यक समयमा बिद्युत उत्पादन गर्नेले सापेक्ष रुपमा कम प्रतिकूल प्रभाव पार्दछ भने कुलेखानी जस्तो वर्षभरी परेको पानी संचय गर्ने आयोजनाले अत्यधिक प्रतिकूल प्रभाव पार्दछ । जलाशय निर्माण गिरंदा जग्गा जमिन, वन जंगल, वन्यजन्तु, पर्यटकीय स्थल, मन्दिर देवालय, स्थानिय पूर्वाधार समेत डुबानमा पर्नुको अतिरिक्त स्थानिय बासिन्दा बिस्थापित समेत हुन्छन् । यसरी ठूला जलाशाययुक्त आयोजना निर्माण गरेर जलश्रोतको उपयोग गरेको अवस्थामा स्थानिय बासिन्दा लाभान्वित हुनुको सट्टा धेरै कुराबाट बंचित हुन्छन् ।

अर्कोतिर जलाशययुक्त आयोजनाको निर्माणबाट तल्लो तटीय क्षेत्रमा सुख्खायाममा समेत थप पानी उपलब्ध हुन्छ, जुन खानेपानी, सिचाई, औद्योगिक प्रयोग, जलाधारको सुधार आदिमा मात्र उपयोग नभई सुख्खायाममा निश्चित परिमाणमा पानी बग्नाले जलपरिवहन र जलक्रीडामा आधारित पर्यटकिय प्रयोग समेत भएर तल्लो तटीय क्षेत्र लाभान्वित हुन्छ । यस्तोमा माथिल्लो तटीय प्रान्तले जलाशययुक्त बहुउद्देश्यीय आयोजना निर्माणमा सहमत हुने सम्भावना एकदम न्यून हुन्छ । उदाहरणको लागि धेरै टाढा जानु पर्दैन भारत पाकिस्तानमा बिद्यमान यस सम्बन्धी प्रान्तियद्वन्द्व मात्र अवलोकन गरे पनि पुग्छ ।

पुनर्वास
अझ बढी मनमुटाव बढाउंछ बहुउद्देश्यीय आयोजनाबाट विस्थापित स्थानिय जनताको पुनर्वासको मुद्दाले । जलाशय निर्माण गरिने पहाडी क्षेत्रमा पुनर्वासको लागि आवश्यक जग्गा जमिनको अभाव हुन्छ भने आवश्यक जग्गा उपलब्ध हुने ठाउंमा जातिय सन्तुलन बिग्रने कारण दर्शाएर पुनर्वासको लागि सहमत हुन्नन् । पश्चिम तराईका थारुहरुले पश्चिम सेती आयोजनाबाट विस्थापितलाई आफ्नो भूभागमा पुनर्वास गराउन असहमति नैं जनाईसकेकाछन् । यस्तोमा छुट्टाछुट्टै प्रान्त गठन भईसके पछि अन्यत्र कतैका शहर बजारहरुमा उज्यालो छर्नको लागि माथिल्लो तटीय प्रान्तले आफ्नो भूभाग डुबाएर जनता विस्थापित गरेर जलाशययुक्त आयोजना निर्माण गर्न सहमत हुने सम्भावना हुन्न ।

िसंचाई तथा बाढी नियन्त्रण
नेपालमा झण्डै ४० लाख हेक्टर खेतीयोग्य जमिन छ भन्ने तथ्यांक छ (धेरै जसो तराईमा) भने ५ लाख हेक्टर (१३ प्रतिशत भन्दा कम) मात्र िसंचित छ त्यो पनि अधिकांश वर्षायाममा मात्र जसले गर्दा धेरै जसो जमिनमा एक वाली मात्र राम्ररी खेती गरिन्छ । देशमा खाद्य सुरक्षा बहाल गर्न र नगदे वाली लगायत प्रबद्धन गरेर किसानलाई समृद्ध पार्न सुख्खायाममा समेत िसंचाई गरेर खेती गरिनु - कम्तीमा तीन बाली लगाइनु - पर्दछ । यसको लागि जलाशय बनाएर वर्षायाम, ४ महिनामा परेको पानी संचित गरेर बांकी ८ महिना पनि िसंचाई गर्नुपर्दछ । जलाशय निर्माण गर्दा तल्लो तटीय क्षेत्रमा वर्षायाममा आउने बाढी पनि नियन्त्रण हुन्छ । यस्तोमा तराई छुट्टै प्रान्त बनेमा जलाशययुक्त आयोजना निर्माणको सम्भावना कमै हुन्छ ।

जलबिद्युत
अहिले पश्चिमााचल विकास क्षेत्रले सबभन्दा बढी, झण्डै ३ सय ३० मेगावाट जलबिद्युत उत्पादन गरेर आधा मात्र खपत गर्दछ भने पूर्वााचल विकास क्षेत्रले १४ मेगावाट उत्पादन गरेर त्यसको बीसौं गुणा बढी उपयोग गर्छ । मध्यमााचल विकास क्षेत्रले आफ्नो उत्पादन २ सय ७५ मेगावाट भन्दा केहि बढी खपत गर्छ । बिद्यमान ५ विकास क्षेत्रहरुलाई नैं प्रान्त घोषित गरिएमा यस किसिमको मिलिजुली उत्पादन एवम् उपयोगको सम्भावना कम हुन्छ । एक प्रान्तबाट अर्को प्रान्तमा कति मूल्यमा बिजुली उपलब्ध गराउने भन्ने सामान्य विषय पनि बिबादमुक्त हुन नसकेर एक प्रान्तले अर्को प्रान्तमा बिद्युत आपूर्ति नैं बन्द गर्ने सम्मको अवस्था आउन सक्छ ।

जलश्रोत सम्बन्धमा बिबाद
संघियताको संघारमा पुग्न लागेका नेपालीको आंखा छिमेकी भारतमा बिद्यमान यस सम्बन्धी बिबादले मात्रै पनि खुल्नु पर्ने हो । पानीको बांडफांट सम्बन्धमा पंजाब र हरियाणा बीच बिबाद छ भने नर्मदा बिबादमा मध्य प्रदेश महाराष्ट्र गुजरात र राजस्थान संलग्न छन् । त्यस्तै तमिल नाडु र कर्णाटकता बीच काबेरी बिबादले उग्ररुप िलंदा अपेक्षातितरुपमा काम भएकोछैन । तथापि भारतको भूभाग ठूलो हुनाले संघियतामा जानु जायजै मान्न सकिएला तर भारतको एक प्रान्त भन्दा पनि सानो वा प्रान्त जत्रो नेपाललाई अझ ससाना प्रान्तमा बिभाजन गर्दा जलश्रोतका समुचित दोहनमा बिभिन्न प्रान्त बीचको बिबादले धेरै नैं अवरोध पुर्याउने देखिन्छ ।

मित्र राष्ट्रसंग सन्धी गर्ने क्षमता
कोशी देखि गण्डकी टनकपुर हुंदै महाकाली सन्धी सम्मको यात्रामा नेपालले धेरै गुमाईसकेकोछ । यो कृयाकलाप नेपालमा संघियता लागू हुनुभन्दा अगाडी भएकोहो । तर एक पटक नेपाल विभिन्न प्रान्तहरुमा विभाजित भएपछि यी प्रान्तहरु नैं आपसमा द्वन्द्वरत रहने भएकोले मित्र राष्ट्रसंग सन्धी सम्झौता गर्दा अझ बढी गुमाउने अवस्था आउनेछ । नेपाल भित्रका बिभिन्न प्रान्तलाई जुधाएर, लडाएर कोशी, गण्डकी, महाकाली पुनराबृत्ति गर्ने अभिष्ट पनि पूरा हुने अवस्था बन्न सक्छ । सम्झन के जरुरी छ भने एउटा पाउरोटी कसरी बांड्ने भन्ने बारे दुई बिरालो बीच बिबाद उठ्दा तराजुमा जोखेर बांडफांट गर्ने अग्रसरता देखाउने बांदरले अलिअलि गरेर पूरै पाउरोटी खाईसकाएको कथा चरितार्थ हुने ठूलो जोखिम संघियतामा गएपछि खडा हुनेछ ।

अन्तमा
बिभिन्न प्रान्तहरुका फरक आकांक्षा आवश्यकताले गर्दा जलश्रोतको अधिकतम उपयोगमा अवरोध आउने सम्भावना धेरै छ । अझ प्रान्तहरुको सीमांकन नदीमा आधारित गर्ने परिपाटी हुनाले दुई किनाराका प्रान्तहरुको दुई किसिमका आकांक्षा हुनेहुनाले बिबाद अझ घनिभूतरुपमा खडा हुन्छ जसले गर्दा समेत जलश्रोतको समुचित दोहन कष्टसाध्य हुनजान्छ । तसर्थ अहिले हतारमा देशलाई विभिन्न प्रान्तमा खण्डित पारेमा पछि फुस्रदमा धेरै पछुताउन पर्ने हुन्छ । समय छंदै यस सम्बन्धमा चेत्न जरुरी छ ।

Re: Federalism and Water Resource

Resolving these issues in the interest of people, I admit, is possible as has been pointed out, in an ideal society. But that too would be over simplification as, unfortunately, utopia is rather rare. Had it been that simple, a number of provinces in India wouldn’t have been fighting with each other (it is same in Pakistan, too). Suppose I were to agree that these issues could be resolved in the interest of people in an ideal situation, then one will have to further agree that even it would not have been necessary to raise the demand for federal structure in such a situation as nobody would have been excluded (or felt excluded) from the mainstream of the society and governance. But that is the not the case. Therefore, in my article I have simply pointed out the possibilities of hindrances in the optimal exploitation of water resources under federal structure.

I have perused the chapter on natural resources of NACSS memo and it has recommended apportionment of the right to natural resources between and center and states at various rates. The question that will arise is what is the basis of these percentages and may be deemed arbitrary. Reaching an agreement on these percentages will amount to opening a Pandora’s Box. After arriving at a consensus on these ratios then there will be second generation problems of quantification and monetization of the benefits to share the benefits amongst various provinces (yes, more than one province may be involved in one project) and the center . Moreover, the costs in terms of adverse impacts on the local populace also will have to be quantified which will also result in a lot of arguments. Hence, under a federal structure optimal exploitation water resource will be possible with great difficulty.

Federalism will hinder optimal exploitation of water resources

For this scribe “People’s Movement II” is “Rhododendron Revolution” of 2006 which not only paved path for the abolition of much maligned monarchy, subsequent to Royal Palace massacre – reportedly committed by the then Crown Prince who is alleged to have committed suicide after committing heinous crime of regicide (also patricide), matricide, fratricide (both bother and sister) and also killing off an uncle and couple of aunts (however, most of the people still do not believe this “yarn” – which denigrated royalties (mainly the last “monarch” of Nepal and his son) in the eyes of the “loyal subjects” of Nepal, in 2001 June, but also afforded an opportunity for the people of Nepal to write a constitution of their own – through the elected Constituent Assembly. The assembly is supposed to decide the form and content of the constitution and also the structure of the state as to whether federal or unitary. However, the overzealous people in the commission writing Interim Constitution went out of way to declare that Nepal will be a federal state; preempting the people’s representatives in the assembly from deliberating about it and arriving at a well thought through decision. Now it has become a contentious issue as to whether spinning off of Nepal into an indeterminate number of provinces under federal structure is really a good idea. Here an attempt is being made to analyze how will federalism affect optimal exploitation of water resources.

Water Resource – Unique Natural Resource
Optimal exploitation of most of the natural resources can be done locally. They can benefit by cultivating land, harvesting it, collecting herbs, living off forest or extracting minerals. But water resource is a different kind of natural resource and things are not that simple with its exploitation. Local inhabitants can benefit, for example, by building micro hydropower project (less than 100 kW) or from water based tourism like rafting. But exploitation at a larger scale to benefit from scale economy results in different set of additionalities and externalities.

Construction of a run-of-the-river (RoR) hydropower at a specific site deprives upper riparian populace from using the river water for consumptive uses (i.e. irrigation) as any reduction in the quantum of water will result in decrease in electricity generation and in turn downsizing the revenue stream. Similarly, a patch of the river will become dewatered as water will be diverted from the river into powerhouse through a network of canal/tunnel and eventually penstock pipe by building intake. The people dependent on this patch of river will face severe water scarcity – amply demonstrated by the dewatered area in Marshyangdi River by the highway to Pokahra. If the users of electricity come from a different province, the people adversely impacted as such will never agree to construction of implementation of hydropower plant in their province resulting in failure to generate electricity at optimum level.

Reservoir Project
Contrasted with RoR project, a storage project will entail building a reservoir resulting in inundation/submergence of large tracts of fertile agricultural land, forest and even extant infrastructure and will also displace the inhabitants. Daily pondage project also causes similar adverse impact, by a lesser magnitude, though. In this scenario, people of the province set to lose their land and to get displaced will not be too eager to build a project if the electricity is to be used in another province. Moreover, storage project also generates downstream benefit in terms of augmented flow which benefits the lower riparian people by making water available for water supply, irrigation, industrial use, improvement of watershed and they can also use the same for water sports based tourism and navigation. In this backdrop people in upper riparian province will have no reason to agree to build such a project, thus scuttling the prospect of implementation of a multipurpose project, but for federal structure.

Resettlement of people displaced by a multipurpose project will also become problematic as there is scarcity of good land in the hills where such projects could be sited while the resettlement in the area where necessary land is available will not be allowed for reasons of disturbing ethnic balance. Tharus in western Terai are already objecting to the resettlement plan for people to be displaced by West Seti project. After formation of separate provinces, the ensuing tussle will take the form of agitation as to why should upper riparian province lose land and its people to electricity for some far off city.

Irrigation and Flood Control
Nepal has 3.97 million hectares of cultivated land (mostly in Terai) and only 0.5 million hectares (only 12.6%) has some irrigation (mostly during rainy season). Cultivation of multiple crops in a year – imperative to ensure food security in the country (including high value cash crop that will make the farmers there prosperous) – requires massive irrigation during dry season which is possible only by building a reservoir in the hills that will store water during the rainy season (about 4 months in year) for irrigation during other 8 months. Building reservoirs as such will also control flood in the river’s flood plain in the Terai. But such a scheme will be precluded after splitting the country into federal structure for reasons explained above, especially if Terai is to become a separate province.

Electricity
Suppose it is decided to have 5 provinces in the lines of current development regions, then western development region will be generating most of hydropower (over 329 MW), using only about half of its generation capacity, while eastern region will be consuming a lot more than what it generates (under 14 MW). Central development region will consume a little more than it generates (275 MW). Under federal structure this type of happy sharing will not be possible. Simple issue like pricing can spin out of control and provinces with more generation capacity can shut off power if the price is not right.

Dispute over water resource
What is happening in India should be an eye opener for us in Nepal about to cross the threshold into federalism. There is dispute between Punjab and Haryana over Yamuna Sutlej Link canal. A clutch of states are fighting over Narmada and Tamil Nadu and Karnataka do not see eye to eye on Cauvery. All this is impeding optimal exploitation of water resource in India, although she has adopted federal structure due to her huge land mass.

Negotiating power
From Koshi through Gandaki, Tanakpur and Mahakali treaties Nepal has ended up getting raw deals. These things took place before Nepal went federal. After implementing federalism, each province will be squabbling with other province/s and Nepal’s negotiation capacity will be further weakened vis-à-vis India and the nightmare of a “monkey” from abroad settling dispute between two “cats” - siblings - over sharing of a bread of loaf (water resource) and monkey ending up eating the bread bite by bite will become a reality. Merely this should disssuade patriotic Nepali people from breaking up Nepal into several provinces.

Conclusion
Implementing water resource projects in a federal structure will become difficult/daunting task due to competing demands over water and clashing aspirations of each province and several provinces. The complications will get compounded due to the convention of demarcating provinces by using rivers as the boundary. This will result in diametrically opposite aspiration of one province with that of the province on the other side of the river.

In view of this, and also due to the fact that Nepal is as small or smaller than a reasonable sized province of India and most federal nations, we need to tread cautiously before going for federal structure. As far as water resource is concerned, splitting the country in haste will provide us ample opportunity to repent at leisure.

Trolley Bus Development in Ring Road of the Kathmandu Valley

Rapid and unplanned urbanization and migration of rural people in Nepal has resulted in a rapid growth in the demand for transport in the urban areas over the past few years, especially in the capital city Kathmandu. The number of vehicles registered in Kathmandu alone in the past 10 years has increased by 211 percent. Needless to say, the increase in vehicles is putting immense pressure on the existing infrastructure and triggering numerous adverse effects. The environmental impact of these vehicles is mainly felt in terms of air pollution, primarily Greenhouse Gases (GHGs), from tail pipe exhausts and noise pollution. GHGs not only cause global warming but also impacts the health of the local populace adversely. The adverse health impact from the air pollution includes increased incidence of chronic bronchitis and acute respiratory illnesses, exacerbation of asthma, and impairment of lung function. Chronic bronchitis and asthma lead to chronic obstructive pulmonary disease (COPD).

Different studies have indicated that the air quality in Kathmandu, especially the PM10 (particulate matter less than 10 microns) has a major impact on respiratory diseases leading to COPD. Various studies indicate that transport sector contributes the highest CO2 emissions in Nepal. In addition, as most of these vehicles are fossil fuel based, the government is spending the scarce foreign currency reserve to import fuel for these vehicles. Pollution can also be detrimental to our cultural heritage and can also have severe effects on the tourism industry. Electric based vehicles have a convincing potential to counter escalating pollution levels and adverse impacts thereof, and are currently being promoted in the country, especially in the mass transport system. The fleet of about 600 battery powered three wheelers, called "Safa Tempos", in the country are testimony to this new found public awareness of the benefits of clean energy. The concept of electric public transportation is not new to Nepal. In 1975, Chinese support enabled the operation of a 32 fleet trolley bus system between Tripureshwor in the city center (in Kathmandu) and Suryabinayak in the town of Bhaktapur in the Kathmandu Valley. Although an amalgam of problems led to the termination of Nepal’s one and only trolley service in late 2001, the system has recently been partially revived by a consortium of three municipalities: Kathmandu, Thimi and Bhaktapur.

In an effort to address the current transport related problems in the Kathmandu valley, a prefeasibility study for the development of a trolley bus system in the Kathmandu valley Ring Road has been undertaken under the PREGA project. The project is being initiated at a time when the government policy is favorable for electric vehicles; this has the potential to contribute to the overall sustainable development of the Nepali economy. The project is expected to make a positive impact on poverty reduction through employment generation, support the tourism sector, and promote environment protection, positive health impact etc.

As an immediate 100% replacement of all diesel buses from the Ring Road is an unrealistic target, the trolleybuses are planned to be introduced in phases over three different periods during the project life. It is proposed that 50 trolleybuses will be introduced in the initial stage; followed by 25 trolley buses introduced in three, five year intervals. This would mean that an additional 75 buses would be added in the system during 2011, 2016 and 2021, resulting in a total of 125 trolley buses on the Ring Road by 2021.

In terms of replacing diesel buses, the 50 trolleybuses introduced in 2005 would replace about 34 diesel buses and 33 diesel minibuses. Ultimately, introduction of the total 125 trolleybus fleet during the project period (2005-2025) would replace about 85 diesel buses and 83 diesel minibuses from the Ring Road. Apart from other benefits, implementation of the trolleybus transportation system in the Ring Road would ultimately help reduce about 128,927 tons of CO2 equivalent emissions during the project period alone.

The project investment scheme will also be staggered over the project period. Investments are required at different intervals as additional numbers of trolleybuses are introduced over the project period 2005-2025. The initial investment, amounting to NRs 522.49 million (US$ 6.97 million) will be made in 2005 for the 50 trolley buses. The additional 75 trolleybuses, to be introduced at three five year intervals, require an additional investment of NRs 211.56, NRs 185.41 and NRs 211.56 million (US$ 2.82, 2.47 and 2.82 million) during the years 2011, 2016 and 2021 respectively. The total investment required for the infrastructure needed to implement the trolley bus project along the Ring Road amounts to about NRs 1,131 million (US$ 15.08 million). However, this cost can be reduced to NRs. 969.5 million (US$ 12.93 million) if the trolleybuses are assembled locally with imported components i.e., chassis from India and electrical components from China.

The estimated cost of an imported trolleybus is NRs 5.5 million (US$ 0.073 million) whereas the cost of a locally manufactured trolleybus is estimated at NRs 4.2 million (US$ 0.056 million). As the cost of imported trolley buses is substantially higher, the assembly of trolleybuses locally has been found as a cost effective option besides the appurtenant benefits thereto in the form of backward linkage. In addition, an annual operation cost of NRs. 1.18 million (US$ 0.015 million) per trolleybus per year has been estimated. The project can be financed in two ways: one time lump sum payment for the abatement during the life usually through Global Environment Facility (GEF) or payment each year upon delivery of abatement through the Clean Development Mechanism (CDM).

CDM is a mechanism within the Kyoto Protocol that allows industrialized Annex I countries to implement projects that reduce emissions in non-Annex I countries (developing countries) and get credits for meeting their commitments to reduce emissions. In order to make the project commercially feasible and attract private investors, the FIRR needs to be at least 14%. Calculations suggest an incremental cost of about NRs 155 million (US$ 2.06 million) for imported trolleybuses, and NRs 63 million (US$ 0.84 million) for locally assembled ones. If the lifecycle costs of baseline and project case are considered, the incremental cost becomes Rs. 427.02 million (US$ 5.69 million) for imported trolley bus and Rs. 207.48 million (US$ 2.77 million) for locally assembled. However, the economic analysis indicates that the project will be beneficial to the society if implemented. But the financial calculation suggest that additional income like sell of CERs would be needed on top of the revenue from passenger service to be financially viable.

The abatement cost of CO2 varies depending upon the funding mechanism. Receipt of payment for the total GHG abatement during the life time of the project at the beginning of the project through one time lump sum payment makes the abatement cost of CO2 more economical compared to the abatement cost through CERs paid annually. If the project were to be implemented with imported trolleybuses, then the abatement cost would be US $ 16 per ton of CO2 eq mitigated. For locally assembled trolleybuses, this would be around US $ 6.5. On the other hand, if the project were to be paid for CERs generated each upon delivery, the cost of CO2eq would be around US $ 57 per ton of CO2eq mitigated for imported trolleybuses, while the cost of CO2eq would be around US $ 23 for locally assembled trolleybuses. Similarly, the abatement cost is US$ 44 per ton of CO2eq for imported trolleybuses, and US$ 21.5 per ton of CO2eq for locally assembled if the incremental cost computed on the basis of through lifecycle analysis. From the above results it is evident that the cost of CO2eq is higher if the payment for the generated CERs is to be made annually, and that, the project would be even more attractive if the trolleybuses could be manufactured locally.

On the other hand, a detailed monitoring plan needs to be developed for CDM funded projects. For certain projects, monitoring the performance and GHG impacts can be an important component of a project’s total transaction costs. The latest draft simplified baseline and monitoring methodologies for selected small-scale CDM project categories, which also includes "Emission Reductions in the Transport Sector", requires monitoring to track the number of trolley buses operated and the annual units of service for a sample of the vehicles. An effective and efficient record keeping system can be established in the company based on the overall kilometers covered, total passengers traveled, the total number of trolleybuses as well as diesel buses in operation etc. This data can be reported on an annual basis and can be electronically archived.

A half-day workshop to gather stakeholder comments regarding the draft report was held on November 3, 2003 in Kathmandu. The overall consensus was that the project should be investigated further by conducting a detailed feasibility study. Questions pertaining to how the local costs would compare to the initial investments, how to raise the preliminary capital, the need to incorporate health impacts to strengthen the study, development of a concrete substantiation of benefits in order for EVs to be eligible to claim subsidies, involvement of the private sector in future trolleybus operations, and the need for a strong management system were suggested by workshop participants to further substantiate the study.

RE: India halts power supply deal (Ha!! I told you so....)

Thanks for forwarding interesting news. Later during the day other papers too have reported about it.

However, it will take a while for it to dawn on most of our hydrocracy (bureaucracy, politicos, intelligentsia, media persons, business community, bankers involved in the hydropower sector) that export of power to Nepal is an additional weapon in Indian arsenal for her against Nepal (as is the trade and transit) to ensure that Nepal toes the line, they want her to. I dare to trust that people in Nepal haven’t forgotten (although “people” are famed to have very short memory) about the trade embargo and transit blockade that India imposed on Nepal in late 80’s leading to “people’s movement I”. What ensued is in the pages of history obviating repetition here.

In the same vein, when I read about Nepal’s plan to import 500 MW from India, while I was vacationing in Vientiane with my brand new granddaughter, I had tears in my eyes trying to stop myself from laughing uncontrollably for quite a while. This was exactly what I was worried about – India using “power” (electric) to have Nepal dance to their tunes (according to their caprices). Besides, I felt sad and also felt like smiling (simultaneously!) at the tragicomic situation, after reading that PTC has offered a “generous” rate of INR 3 while Nepal is set to export at NPR 3 – offering a handsome markup of 60% straight (how magnanimous we are!). Eventually they will be importing from Nepal at Rs 3 and export the same to us at Rs 4.80 – reinforcing the firmly held belief in Indian politicos and bureaucracy that Nepali people are nice and, therefore, dumb (except for those who sell their souls for “a few silvers”).

An interesting thing about the “halt” is that it is Ministry of External Affairs in New Delhi that has thrown wrench in the works. It is surprising that simple export of power to Nepal requires approval of Ministry of External Affairs in New Delhi. However, hydrocracy of Nepal deems export of power normal trade (simply trading in “electron”) and they proclaim that exporting power does not have anything to do with water resources (even Supreme Court of Nepal has delivered a verdict in this line in the case of west Seti. When reference is being made to west Seti, it needs to be remembered that Nepal wasn’t importing 30 MW dedicated power from a specific project. However, west Seti it is dedicated export oriented project. What is more galling is that west Seti generates augmented flow of 90 m3/s which ends up benefiting farmers in India (can irrigate 270,000 ha land for non paddy cultivation), but the deal, even from this perspective was deemed not sharing of water resources.

This also calls on us to look at the other side of this very coin (export of power to India). Intransigent people (including those who would like to replicate Bhutan model in Nepal) dream of having India “jump” at our bidding by exporting power to her as she will be dependent on “us” for substantial amount of power from large plants – up to 10,000 MW from Karnali (and making Nepal "immensely" rich). I have pointed out the fallacy behind this belief in my article published in Nepali Times (# 314, 8-14 September, 2006) as “India is uncomfortable being dependent on an independent Nepal on such a scale. The comfort level would have gone up significantly if the security of such a project is to be guaranteed by the Indian Army.” With regard to Bhutan, being a protectorate of India, India does not feel uncomfortable being dependent on her. I hope I don’t need to overemphasize it here by saying that Indians would hate to lose sleep by having to wonder when someone in Nepal is going to switch off power from plants in Nepal exporting to India (exactly the reverse of what they have just done to Nepal suffering from chronic load shedding). In view of this, the idea of dedicated export oriented power plants in Nepal for India will never work as long as Nepal will fail to graciously accept Indian security arrangement of such plants in Nepal. I have gone on to opine in that article that “But Nepali people are famous for their “intransigence” in this matter” (Thank God!). I would like to believe that I am not off mark in this matter

Before concluding, I would like to repeat, ad nauseoum (since I have been repeating this over and over again) that Nepal’s best interest will be best served by ensuring energy security and being self reliant in the matters of energy – from our own water resource.

I would like to close this email by reiterating that Indian interest in Nepal’s hydropower is just a façade to capture water belonging to Nepal – we can find abundant examples in Koshi, Gandaki and Mahakali treaties. My belief as such has been confirmed by current union water resources minister of India Mr. Saif Uddin Soz (no less a person) who has been frank and honest in admitting, with Navin Singh Khadka, BBC Nepali Service, 12 September 2008 that “Our main interest is flood control and irrigation. Those are our first and second priority. If we get hydroelectricity as by product, that will be a bonus for us.” I pray to god almighty that he gets elected once more and ascends the same ministerial berth in Delhi.

None of our HydroDollarists wanted to believe some of us 'baikalpikwallas' when we said North India has 10000MW shortage currently. Hence the idea of solving our loadshedding problem by importing power from India is madness. They can't supply, and if they do, the political cost will be too high. Today's news report clipped below proves our point if any proof were needed.

It would have been far better to give all facilities to our own developers to develop our hydro and export only when we have a surplus. Hundreds of potential PPAs that could be developed within two years are not signed by the current government because of this big pie-in-the-sky idea of importing from the Mughlani Sahu and NEA's dog-in-the-manger policy of not allowing Nepali private competition but allowing load shedding to continue (till 2019 BS as per the Som Nath Paudel '10,000MW' Commission)!.

I wonder what our 'nakkacharas' advocating Mahatonomics and Enronism will now have to say??!!

India halts power supply deal

KATHMANDU, April 24: The action initiated by the Maoist-led government against army chief General Rookmangud Katawal and the polarized views of the political parties on the issue have now affected the power import deal between Nepal and India.The Indian government on Thursday put on hold the agreement to supply 30 MW power to Nepal just two days before it was supposed to be signed."We had finalized everything from our side. But the agreement has now been put on hold," a Nepal Electricity Authority (NEA) official told this daily. The source informed that as per the request of the Bihar Board, a letter requesting government of India´s approval on the agreement was sent to the Ministry of External Affairs in New Delhi through the Indian embassy in Kathmandu on April 22. However, the Ministry did not send a consent to the request.A week ago, the NEA had forwarded a memorandum of understanding to the Power Board of Bihar to import the additional 30 MW of electricity at the rate of IRs 4.79 per unit for a period of two months.“Both sides had settled all issues and conditions for the import,” the source added.The Power Trading Corporation (PTC) of India was making necessary arrangements for the import to Nepal via Ramnagar in Bihar.The development comes amid reports that the Indian government has been inserting pressure on the Maoist-led government in Nepal against the dismissal of the army chief.Indian ambassador to Nepal Rakesh Sood on Thursday flew to New Delhi, canceling all appointments here, to brief the South Block on the ´current developments´ in Nepal.Meanwhile, the board meeting of the NEA on Thursday awarded Korea Nuclear and Hydro Power (KNHP), a Korea-based company, the contract to construct the electro-mechanical and transmission lines of the 30-MW Chameliya Hydroelectric Project (CHP) in Darchula. मस्यौदा "बिद्युत ऐन २०६५" मा अत्यावश्यक सुधारहरु

जलबिद्युत नीति २०५८ मा जारी भएकोमा ८ वर्ष पछि उक्त नीतिसंग तादात्म्य मिल्ने गरेर बिद्युत ऐन जारी गर्न बिद्युत विधेयक हालै नेपाल सरकारले संविधान सभामा पेश गरेकोछ । तर यस विधेयकमा निम्न कमी कमजोरी भएकोले सुधार गर्न अपरिहार्य छः

१. अनुमतिपत्र सम्बन्धी व्यवस्था (परिच्छेद-२)
१. १ पहिले निवेदन दिनेले अनुमतिपत्र पाउनमा अग्राधिकार प्राप्त गर्ने (first come first serve) व्यवस्था कायमै राखिएको छ । आयोजना कार्यान्वयन गर्न आवश्यक वित्तिय सक्षमताको अपरिहार्यतालाई आत्मसात गरिएको छैन । वित्तिय सक्षमता परिक्षण गर्ने संयन्त्रको अभाव पनि कायमै छ । यसले गर्दा अनुमतिपत्र ओगट्ने लगायत अनुमतिपत्रको दलाली गर्ने जस्ता बिद्यमान अस्वस्थ वातावरण नयां ऐन जारी भए पछि पनि कायमै रहने देखिन्छ । कतिपय अनुमतिपत्र प्राप्त गरेकाले आयोजना कार्यान्वयन गरेको नभएको भने होइन ।

यो परिपाटीले गर्दा आवश्यक वित्तिय सक्षमता नभएकाको हातमा पनि अनुमतिपत्र पर्ने कोष परिचालन गर्ने क्षमताको अभावमा आयोजना कार्यान्वयन गर्न नसक्ने हालको बिद्यमान प्रचलनले निरन्तरता पाइरहेनछ । जसले गर्दा:

क) राज्यले आवधिक योजनामा समाबेस गरेका आयोजनाहरु कार्यान्वयन नहुने वा समयमा कार्यान्वयन नहुने

ख) प्राधिकरणलाई अपेक्षातीत थप बिजुली समयमा उपलब्ध नहुने

ग) जसको फलस्वरुप बिद्युत कटौती अपरिहार्य हुन गई समग्र अर्थतन्त्र समेतमा नकरात्मक प्रभाव पर्ने र

घ) रोयल्टी जस्ता राजश्व श्रोतबाट समेत बंचित भएर राज्यले ठूलै रकम नोक्सानी व्यहोर्दै आएकोछ र व्यहोर्न पर्ने हुन्छ ।

तसर्थ अनुमतिपत्र प्रदान गर्नु अगावै आवश्यक वित्तिय सक्षमता परिक्षण गर्ने व्यवस्था ऐनमा गर्नु पर्छ र यसको परिक्षणको लागि र समयमा कार्य सम्पन्न गर्न नसकेको अवस्थामा राज्यलाई रोयल्टी नपाएर हुने नोक्सानी र बिजुली अनुपलब्ध भएर अर्थतन्त्रलाई पर्ने हानी नोक्सानी भराईलिन समेत आयोजनाको अनुमानित लागतको १० प्रतिशत बराबर जमानत/बण्ड/प्रत्याभूति प्रतितपत्र प्राप्त गरेर मात्र अनुमतिपत्र जारी गर्नुपर्दछ ।

१.२ दफा ४ को उपदफा ६ मा अपबाद स्वरुप "नेपाल सरकारले नेपाल राजपत्रमा सूचना प्रकाशन गरी तोकेको जलबिद्युत आयोजनाको विकास तथा संचालन गर्न सकिने सम्भाव्य क्षेत्रमा प्रतिस्पर्धाको माध्यमबाट सर्बेक्षण अनुमतिपत्र दिन सक्नेछ" भन्ने व्यवस्था गरेको छ । यसबाट निश्चित केही आयोजनाको सम्बन्धमा अपबाद स्वरुप मात्र प्रतिस्पर्धात्मक रुपमा जलबिद्युत आयोजनाको विकास तथा संचालन गर्ने व्यवस्था भएको देखियो । प्रतिस्पर्धात्मक रुपमा अनुमतिपत्र दिइंदा पारदर्शी समेत हुने परिपे्रक्ष्यमा अपबाद स्वरुप बाहेक सामान्यतया सर्बेक्षण अनुमतिपत्र दिने प्रकृया अपारदर्शी तथा अप्रतिश्पर्धात्मक नै रहेको देखिन्छ ।

तसर्थ नेपाल सरकार आफैले कार्यान्वयन गर्ने आयोजनाहरुलाई मात्र अपबादमा राखेर अन्य सबै आयोजनाको अनुमतिपत्र पारदर्शी एवं प्रतिश्पर्धात्मकरुपमा मात्र जारी गर्ने व्यवस्था गर्न वान्छनिय छ । तर यो व्यवस्था निवेदक आफैले पहिचान गरेको आयोजनाको अनुमतिपत्रको सम्बन्धमा लागू गर्न हुन्न ।

साथै दफा १४ मा भने प्रतिश्पर्धाको माध्यमबाट बिद्युत विकास तथा संचालन गर्न सकिने सम्बन्धमा व्यवस्था गरेकोछ । तर बिधेयकमा भएको व्यवस्था अनुरुप भएमा केहि विषेश अवस्थामा मात्र प्रतिश्पर्धात्मक तरीका अपनाइने देखिन्छ अपवाद स्वरुप मात्र । वास्तवमा अपवाद स्वरुप मात्र बिना प्रतिश्पर्धा गर्न सकिने व्यवस्था गरेर सामान्यतया प्रतिश्पर्धात्मक तरीका अनिवार्य रुपमा अवलम्बन गर्नुपर्ने व्यवस्था हुन वान्छनिय छ ।

१.३ दफा ९ को उपदफा १ मा उत्पादन आदिको लागि अनुमतिपत्र जारी गर्नको लागि नगद वा बैंक जमानत बुझाउनु पर्ने व्यवस्था गरिएकोछ । तर सर्बेक्षण अनुमतिपत्र सम्बन्धमा भने मौन रहेको अवस्था छ । यसबाट सर्बेक्षण अनुमतिपत्रको लागि केही कुनै जमानतको आवश्यकता मस्यौदाले नदेखेको प्रष्टिन्छ । तर उत्पादन अनुमतिपत्र जारी गर्नको लागि वित्तिय व्यवस्था र प्राधिकरणसंग बिद्युत खरिद सम्झौता हुनै पर्ने व्यवस्था भएको पृष्ठभूमिम। वित्तिय सक्षमता नहुनेले उत्पादन अनुमतिपत्र पाउने अवस्था यसै पनि छैन । त्यसैले सर्बेक्षण अनुमतिपत्र जारी गर्दाको बखतमा नैं जमानतको व्यवस्था गर्न अनिवार्य छ ।

उपयुक्त त के हुन्छ भने सर्बेक्षण अनुमतिपत्र जारी गर्ने बेलामा नेपाल सरकारले जमानत प्राप्त गर्ने र प्राधिकरण संग बिद्युत खरिद सम्झौता गर्दा प्राधिकरणले जमानत लिने । यसो गर्दा वित्तिय सक्षमता नहुनेले अनुमतिपत्र ओगट्ने अवस्था सृजना हुन्न भने बिद्युत खरिद सम्झौता सम्पन्न गरेर पनि आयोजना कार्यान्वयन नगरेर बस्ने स्थिति पनि तात्विक रुपमा निर्मूल हुनेछ । जमानत दोहरो नपार्ने उद्देश्य हो भने प्राधिकरणले आयोजनाको अनुमानित लागतको ५ प्रतिशत जमानत लिने र सर्बेक्षण अनुमतिपत्र प्रदान गर्ने बेलामा सरकारले लिएको १० प्रतिशत जमानत मध्ये आधा ५ प्रतिशत फुकुवा गर्नु उचित हुने छ ।

यसबाट तोकिएको मितिमा आयोजना सम्पन्न नभएको कारणले प्राधिकरणलाई उपलब्ध हुनुपर्ने बिद्युतिय शक्तीको अभावको कारणले पर्ने प्रतिकूल वित्तिय प्रभाव साथै अर्थतन्त्र माथि पर्ने आर्थिक भार र राज्यले गुमाउने राजश्व रोयल्टी को रकम जमानतको रकमबाट क्षतिपूर्ति प्राप्त गर्ने व्यवस्था गर्न मिल्नेछ र प्राप्त गर्न पनि वान्छनिय छ । यो व्यवस्था गरिएमा खोला ओगट्ने काम र प्राधिकरणसंग बिद्युत खरिद सम्झौता गरेर पनि आयोजना निर्माण नगर्ने सम्भावना निर्मूल पार्न सकिन्छ ।

१.४ दफा १० (४) मा विभिन्न श्रोतबाट बिजुली उत्पादन गर्ने आयोजनाको लागि उत्पादन अनुमतिको अवधि तोकिएकोछ । तरे यसरी तोकिएको अवधि आयोजना कार्यान्वयन सम्पन्न भएर बिद्युत उत्पादन भएपछि देखि लागू हुने वा अन्यथा हो भन्ने सम्बन्धमा स्पष्ट छैन ।

२. राष्ट्रिय बिद्युत प्रसारण गि्रड (पच्छिेद-३)
दफा १६ (४) मा गि्रड संहिता वितरण संिहता आदि कम्पनीले वनाउने र सो आयोगवाट स्वीकृत भएपछि लागू हुनेछ भनि उल्लेख गरिएकोछ । सवै संहिताहरु उत्पादक प्रशारक र वितरकहरुलाई समान रुपमा लागू हुन पर्ने हुनाले कुनै विषेश संहिता कुनै कम्पनीले नबनाई आयोग आफैले वनाउनु उपयुक्त हुनेछ ।

३. संरचना हस्तान्तरण (पच्छिेद-३)
दफा १५ १ मा "अनुमतिपत्रको अवधि समाप्त भएपछि देहायको संरचना नेपाल सरकारलाई चालू हालतमा निशुल्क हस्तान्तरण गर्नु पर्नेछ" भन्ने व्यवस्था छ । तर design standard, design life र construction standard को अभावमा हस्तान्तरण गरेको केहि दिन वा महिना भित्रै आयोजना संचालन हुन नसक्ने सम्भावना हुन्छ ।

साथै नेपालको कानून र व्यवहारमा आयोजना कार्यान्वयन/निर्माण अवधिमा अनुगमत गर्ने व्यवस्था/परिपाटी नहुनाले हस्तान्तरण उपरान्त आयोजना संचालन गरेर राज्य लाभान्वित हुने भन्ने अवधारणा दुस्वप्न मात्र बन्न सक्दछ ।

४. रोयल्टी (पच्छिेद-५)
४.१ निकासीमूलक जलबिद्युत आयोजनाहरुका सम्बन्धमा नेपाल सरकारले निजी क्षेत्रसंग हाल सम्म सम्पन्न गरेका सम्झौता/समझदारीहरुमा रोयल्टीको अलावा बिभिन्न दरहरुमा निशुल्क बिजुली पनि प्राप्त गरेकोछ पश्चिम सेतीबाट १० प्रतिशत, माथिल्लो कर्णालीबाट १२ प्रतिशत र अरुण तेश्रोबाट २१.९ प्रतिशत । तर यस सम्बन्धमा मस्यौदा ऐनको दफा २३ मा कम्तीमा १० प्रतिशत भनिएकोछ । किटानी प्रतिशत नतोकिएको अवस्थामा के कस्तो प्रकृयाद्वारा निशुल्क दर निर्धारित भयो भन्ने सम्बन्धमा पारदर्शिताको अभाव हुने देखिन्छ र पारदर्शीताको अभावमा सृजित हुने बिकृतीहरुले जलबिद्युतको विकासमा अवरोध आउन सक्नेछ ।

छिमेकि भारतमा पनि एक प्रान्तबाट अर्को प्रान्तमा एउटै देश भित्र निकासी भएको अवस्थामा १२ प्रतिशत निशुल्क बिजुली लिने परिपाटी देखिएको हुनाले नेपालबाट अकैं देश, भारत निकासी गर्दा १२ प्रतिशत अंक पनि अपुग हुनेमा १० प्रतिशत मात्र न्यूनतम तोक्नु अनुचित छ ।

यस अतिरिक्त जलाशययुक्त आयोजना (daily pondage लगायत)ले नेपालको भूभाग डुबानमा गुमाउने खेतीयोग्य जमिनको समबन्धमा पुनःस्थापनाको क्रममा सोधभर्ना भएतापनि वन जंगल पर्ति जग्गा घांसे मैदान आदिको सोधभर्ना नहुने हुनाले नदीको बहावमा आधारित (RoR) आयोजनाबाट प्राप्त हुने निशुल्क बिजुलीको तुलनामा daily pondage लगायत जलाशययुक्त आयोजनाबाट धेरै नैं बढी निशुल्क बिजुली प्राप्त गर्नुपर्ने देखिन्छ । यस सन्दर्भमा अरुण तेश्रोको तुलनामा पश्चिम सेती आयोजनाबाट नेपालले अत्यधिक कम निशुल्क बिजुली प्राप्त गरेको स्मरणिय छ । तसर्थ नदीको बहावमा आधारित आयोजनाबाट न्यूनतम १२ प्रतिशत, डेली पंडेज आयोजनाबाट न्यूनतम १५ प्रतिशत र जलाशययूक्त आयोजनाबाट न्यूनतम २५ प्रतिशत निशुल्क उर्जा प्राप्त गर्ने व्यवस्था हुनुपर्छ ।

४.२ यस दफा सम्बन्धी अनुसूची खण्ड क को उपखण्ड ५ मा क्याप्टिभ प्लाण्टलाई क्षमता रोयल्टी मात्र रु १५०० प्रति जडित किलोवाटको दरले लाग्ने र उर्जा रोयल्टी नलाग्ने व्यवस्था छ । तर खण्ड क को प्रतिबंधात्मक वाक्यांशको रुपमा "तर क्याप्टिभ प्लाण्टबाट उत्पादित बिद्युत व्यापारिक प्रयोजनको लागि बिक्री गर्दा उपखण्ड ५ बमोजिम उर्जा रोयल्टी लाग्नेछ" भनिएकोमा उपखण्ड ५ मा उर्जा रोयल्टी सम्बन्धमा व्यवस्था नहुनाले अस्पष्टताको स्थिति श्रृजना भएको छ । अर्थात क्याप्टिभ प्लाण्टबाट उत्पादित बिजुली व्यापारिकरुपमा बिक्री भएमा के कति दरले उर्जा रोयल्टी लाग्ने किटानी छैन किटानी गर्न वान्छनिय छ ।

४.३ उपरोक्त अनुसूचीको खण्ड ग मा "व्यापारिक आधारमा निर्माण नगरिने" १००० मेगावाट सम्मका आयोजनाको हकमा "वार्षिक १५ प्रतिशत बिद्युत तथा उर्जा रोयल्टी लिइनेछ" भन्ने व्यवस्था गरिएको मा "व्यापारिक आधारमा निर्माण नगरिने" भन्ने वाक्यांश परिभाषित नहुनाले अन्यौलको स्थिति सृजना भएकोछ ।

४.४ सोही अनुसूचीको खण्ड घ मा "१००० मेगावाट भन्दा बढी जडित क्षमता भएको निर्यातमूलक बिद्युत उत्पादन गर्ने अनुमतिपत्र प्राप्त संगठित संस्थासंग वार्ताद्वारा छुट्टै रोयल्टी निर्धारण गर्नेछ" भन्ने व्यवस्था अपारदर्शी छ । यसलाई या त पारदर्शी तरीकाबाट निर्धारण गर्ने प्रकृया ऐनमा तोकिनु पर्छ अथवा रोयल्टीको निश्चित दर ऐनमा नैं तोकिनु पर्छ ।

५. लघू जलबिद्युत तथा ग्रामिण बिद्युतिकरण (पच्छिेद-११)
५.१ दफा ४७ मा "राष्ट्रिय ग्रीडमा पहुंच नपुगेको ग्रामिण क्षेत्रमा नेपाल सरकारको स्वामित्वमा रहेको जलबिद्युतको व्यवस्थापनको जिम्मेवारी प्रचलित कानुन बमोजिम गठन भएको स्थानिय सहकारी संस्थालाई दिन सकिनेछ" भन्ने व्यवस्था भएकोमा सहकारी संस्थामा सीमित नगरी स्थानिय तवरबाट स्थापना भएको सबै प्रकारका सामुदायिक संस्थालाई जिम्मेवारी दिने व्यवस्था गर्दा बढी प्रभावकारी हुने देखिन्छ ।

६. निकासीमूलक आयोजना सम्बन्धी सैद्धान्तिक टिप्पणीहरु
६.१ हाल प्रचलनमा रहेको अन्तरिम सम्बिधानको धारा १५६ र २०४७ सालको संबिधानको धारा १२६ मा प्राकृतिक श्रोतको उपयोग र सोको बांडफांट सम्बन्धमा संसदीय अनुमोदनको व्यवस्था गरिएको छ र यो कार्य कानूनले तोके बमोजिम हुने भन्ने व्यवस्था छ । जलबिद्युत उत्पादन जलश्रोतको उपयोगबाट हुने र निकासी गर्नु बांडफांट गर्नु हो भन्ने धारणा जनमानसमा परेकोले प्रस्तुत बिधेयकमा यस सम्बन्धमा स्पष्ट व्यवस्था हुन वान्छनिय छ ।

जलबिद्युत निकासी भनेको इलेक्ट्रोनको ब्यापार हो र बिजुलीलाई वस्तु मानेर निकासी गर्ने भन्ने अर्काथरीको मान्यता पनि रहेको परिबेशमा सोही कुरा यस बिधेयकमा किटानी व्यवस्था गरिएमा अन्यौल हट्न जानेछ । अर्थात नदीको पानीको बहाव र उचाईलाई प्रयोग गरेर बिजुली उत्पादन गर्नु प्राकृतिक श्रोतको उपयोग नमानिने र बिजुली निकासी गर्नु बांडफांट नठहर्ने किटानी व्यवस्था हुनु पर्छ यदी यही कुरा सर्बमान्य हो भने । विषेशतः जलश्रोतसंग सम्बद्ध के कस्ता कृयाकलाप माथि संसदीय अनुमोदन आवश्यक हुन्छ र कुन हुन्न भन्ने कुरा यो ऐनमा उल्लेख गिरंदा बिद्यमान अन्यौल मात्र नहट्ने भएर न्यायपालिकामा पर्ने मुद्दा मामिलाको संख्या पनि घट्ने देखिन्छ ।

साथै बिद्यमान अन्यौलको स्थितिले गर्दा स्वदेशी तथा बिदेशी लगानिकर्ता पनि अलमलमा परेको देखिन्छ र विषेश गरेर बिदेशी लगानि नेपाल भित्रिने क्रममा ह्रास आएको छ । तसर्थ पनि यो पक्ष स्पष्ट पार्न अनिवार्य छ ।

सिद्धान्ततः आयोजना विशेषलाई निकसीमूलक रुपमा विकास गिरंदा बिजुली उत्पादन गर्नु प्राकृतिक श्रोतको उपयोग हो भने निकासी गर्नु भनेको बांडफांट गर्नु हुन जान्छ । तर नेपालको आन्तरिक खपतको लागि आयोजना कार्यान्वयन गरेर बढी भएको बिजुली समुचित मूल्यमा निकासी गर्दा प्राकृतिक श्रोतको उपयोगको बांडफांट हुन जांदैन । त्यस्तै जलाशययुक्त आयोजना निमार्ण गरेर नेपाल भित्र यसको बहुआयामिक लाभ लिने गरी बहुउद्देश्यीय आयोजना निर्माण गर्दा प्राकृतिक श्रोतको उपयोगको बांडफांट हुंदैन भने जलाशययुक्त आयोजना निमार्ण गरेर तल्लो तटीय लाभ छिमेकी मुलुकलाई प्राप्त हुने अवस्थामा प्राकृतिक श्रोतको उपयोगको बांडफांट ठहर्छ ।

६.२ दफा ४१(१) अनुसार आयोजना निमार्णको लागि आयात गरिने आवश्यक मेशिनरी उपकरण औजार आदिमा लाग्ने भंसार महशूल मूल्य अभिबृद्धि कर जस्ता पैठारी महशूल छूट दिनाले आयोजनाको निर्माण लागत घट्दछ र यस्तो आयोजनाबाट उत्पादन हुने बिजुलीको उत्पादन लागत पनि स्वभावतः कम हुन्छ । यसरी पैठारी महशूल छूट दिनाले राज्यको कोषले राजश्व गुमाएतापनि उत्पादित बिजुलीको लागत सस्तो हुने हुनाले उपभोक्ताले सस्तो बिजुली उपभोग गर्ने अवसर पाउने हुन्छ र यसबाट मुलुककै अर्थतन्त्र लाभान्वित हुन्छ । समग्रमा यसरी छूट दिइनाले नेपालको अर्थतन्त्र नैं लाभान्वित हुन्छ ।

तर निकासीमूलक आयोजनाको हकमा भने नेपालको अर्थतन्त्रले एकातिर मेशिनरी उपकरण औजार आदिमा लाग्ने पैठारी महशूलबाट प्राप्त हुनु पर्ने राजश्व गुमाउंदछ भने नेपाली उपभोक्ताले समेत यस्ता सस्ता आयोजनाबाट उत्पादित सस्तो बिजुली उपयोग गर्ने अवसरबाट बंचित हुने हुनाले नेपालको अर्थतन्त्रले दोहरै गुमाउंदछ ।

तसर्थ पैठारी महशूल छूटको सुबिधा नेपाल भित्र खपत गरिने जलबिद्युत आयोजनाको हकमा मात्र प्रदान गर्ने र निकासीमूलक आयोजनाले नपाउने व्यवस्था गर्न वान्छनिय छ ।

६.३ जलबिद्युत आयोजना निर्माण गरिएर मुलुक भित्र उपयोग गर्नाले मुलुकमा आर्थिक कृयाकलापमा अभिबृद्धि भई समग्रमा अर्थतन्त्र लाभान्वित हुन्छ । तसर्थ जलबिद्युत आयोजनाले आर्जन गरेको मुनाफामा दफा ४१(२) अनुसार आय कर छूट गर्नाले देशको अर्थतन्त्रलाई घाटा हुंदैन । तर कुनै आयोजना विषेशले उत्पादन गरेको जलबिद्युत निकासी गरिनाले पैठारी गरेर उपयोग गर्ने ठाउंमा आर्थिक कृयाकलापमा अभिबृद्धि भई त्यहींको अर्थतन्त्र लाभान्वित हुन्छ भने नेपाल भित्र आर्थिक कृयाकलापमा अभिबृद्धि हुने र अर्थतन्त्र लाभान्वित हुने अवसरबाट मुलुक बंचित हुन्छ । यस्तोमा सो आयोजनाले आयकर पनि छूट पाउंदा नेपाल सरकारको कोषले आयकर राजश्व गुमाउनाको अलावा बिजुली उपयोग गरेर नेपालमा आर्थिक कृयाकलाप अभिबृद्धि गर्ने अवसरबाट पनि बंचित हुने हुनाले नेपालले दोहरै गुमाउने हुन्छ ।

तसर्थ आयकर छूटको सुबिधा नेपाल भित्र खपत गरिने जलबिद्युत आयोजनाको हकमा मात्र प्रदान गर्ने र निकासीमूलक आयोजनाले आयकर छूट नपाउने व्यवस्था गर्न वान्छनिय छ ।

७. स्थानिय लगानि सम्बन्धी सैद्धान्तिक टिप्पणीहरु
आयोजनाहरुलाई आयकर दफा ४१(२) छूट िदंदा राज्यको कोष आयकर राजश्वबाट बंचित भएतापनि स्थानिय लगानिकर्ताद्वारा प्रबद्र्धित आयोनाको हकमा यी स्थानिय लगानिकर्ता लाभान्वित हुने र नेपालमा पूंजी निर्माणमा समेत सघाउ पुग्दछ । अर्थात राज्यले आयकर राजश्व गुमाएपनि नेपाली अर्थतन्त्र लाभान्वित नैं हुन्छ ।

तर बिदेशी लगानिकताद्वारा प्रबद्र्धित आयोजनाले आयकर छूट पाएको अवस्थामा राज्यले आयकर राजश्व मात्र नगुमाएर अर्थतन्त्र पनि लाभान्वित हुने मौकाबाट बंचित हुन्छ ।

त्यस्तै आयोजना निमार्णको लागि आयात गरिने आवश्यक मेशिनरी उपकरण औजार आदिमा लाग्ने भंसार महशूल मूल्य अभिबृद्धि कर जस्ता पैठारी महशूल छूट दिनाले आयोजनाको निर्माण लागत घट्दछ र यस्तो आयोजनाबाट उत्पादन हुने बिजुलीको उत्पादन लागत पनि स्वभावतः कम भई प्रबद्र्धकले कमाउने खूद मुनाफामा अभिबृद्धि हुन्छ । साथै स्थानिय लगानिकर्ता यसरी लाभान्वित हुंदा नेपाली अर्थतन्त्र पनि लाभान्वित हुन्छ । अर्थात यसरी पैठारी महशूल छूट दिनाले राज्यको कोषले राजश्व गुमाएतापनि स्थानिय लगानिकर्ता लाभान्वित भई नेपालको अर्थतन्त्र नैं लाभान्वित हुन्छ ।
तर बिदेशी लगानिकर्ताले प्रबद्र्धित आयोजनाको हकमा भने नेपालको अर्थतन्त्रले एकातिर मेशिनरी उपकरण औजार आदिमा लाग्ने पैठारी महशूलबाट प्राप्त हुनु पर्ने राजश्व गुमाउंदछ भने लगानिकर्ताले थप कमाउने मुनाफाले नेपाली अर्थतन्त्रमा योगदान गर्ने मौकाबाट समेत नेपालले गुमाउंदछ ।
तसर्थ पैठारी महशूल छूटको सुबिधा नेपाली लगानिकर्ताले प्रबद्र्धित आयोजनाको हकमो औचित्यपूर्ण हुने भने बिदेशी लगानिकर्ताले प्रबद्र्धित आयोजनाको हकमा भने निष्फल हुन्छ ।

संक्षेपमा स्थानिय लगानिकर्ताद्वारा प्रबद्र्धित आयोजनालाई आयकर तथा पैठारी महसूल छूट िदंदा राज्यले राजश्वको श्रोत गुमाए पनि अर्थतन्त्र भने लाभान्वित भएकै हुन्छ । तर बिदेशी लगानिकर्ताद्वारा प्रबद्र्धित आयोजनाको हकमा यी छूट हरु िदंदा राज्यले राजश्व गुमाउनाको अलावा अर्थतन्त्रले पनि गुमांदछ । तसर्थ स्थानिय लगानिकर्ताद्वारा प्रबद्र्धित आयोजना र बिदेशी लगानिकर्ताद्वारा प्रबद्र्धित आयोजनाको सम्बधमा यी छूटहरु सम्बन्धमा छुट्टाछुट्टै व्यवस्था गर्न वान्छनिय छ ।

८. तल्लो तटीय क्षेत्रमा हुने लाभ बापत रकम प्राप्त गर्ने व्यवस्था
नेपालको भूभाग डुबानमा पारेर जलाशय निर्माण गरेर बन्ने जलाशययुक्त जलबिद्युत आयोजनाले वर्षायाममा तल्लो तटीय क्षेत्रमा बाढी नियन्त्रण गर्दछ भने सुख्ख्यायाममा िसंचाई खानेपानी जलपरिवहन जलपर्यटन औद्योगिक प्रयोजन आदिको लागि थप पानी उपलब्ध गराउंदछ । यसरी लाभान्वित हुने तल्लो तटीय भूभाग नेपाल भित्रै भएमा नेपालको अर्थतन्त्रले यस्तोबाट लाभान्वित हुन्छ भने अन्य मुलुकमा परेमा नेपालले यस्तो लाभ बापत तल्लो तटीय मुलुकबाट यथोचित सोधभर्ना प्राप्त गर्न पर्दछ ।

यस सम्बन्धमा संयुक्त राज्य अमेरिका र क्यानाडा बीच सम्पन्न कोलम्बिया सन्धीले स्थापना गरेको नजीरले प््रतिपादन गरेको सिद्धान्त अवलम्बन गर्न पर्ने देखिन्छ । उक्त सन्धी अन्तर्गत क्यानाडाले वर्षायाममा संयुक्त राज्य अमेरिकामा अवस्थित तल्लो तटीय क्षेत्रमा बाढी नियन्त्रण र सुख्ख्यायाममा िसंचाई खानेपानी जलपरिवहन जलपर्यटन औद्योगिक प्रयोजन आदिको लागि थप पानी उपलब्ध गराए बापत एकमुष्ट रकम प्राप्त गरेको देखिन्छ । तसर्थ नेपालमा जलाशययुक्त आयोजना निर्माण भएर छिमेकी मुलुकले तल्लो तटीय लाभ प्राप्त गर्ने अवस्था भएमा प्रस्तुत विधेयकमा पनि यही सिद्धान्त अनुरुप नेपालले सोधभर्ना प्राप्त गर्ने व्यवस्था हुन वान्छनिय छ । किनभने जलाशय निर्माणको कारणले डुबानमा पर्ने भूभागको वैकल्पिक प्रयोगबाट नेपाल बंचित हुन्छ ।

९. जलाशय निर्माण गरिएको कारणले थप उत्पादन हुने बिजुलीको लाभ
साथै जलाशय बनाएको कारणले बढी क्षमताको आयोजना निर्माण भई बढी बिजुली उत्पादन हुन्छ । उदाहरणार्थ पश्चिम सेती आयोजनामा जलाशय निर्माण नगरेको खण्डमा १०० मेगावाट क्षमताको मात्र जलबिद्युत आयोजना बन्नेमा जलाशय निर्माणको कारणले ७५० मेगावाट क्षमताको आयोजना निर्माण हुने अवस्था छ । यो आयोजना नेपालको भूभाग डुबाएर जलाशय निर्माण गरेर बन्ने हुनाले यसरी बढी क्षमताको आयोजना बने बापत पनि नेपालले समुचित लाभ पाउन वान्छनिय छ । माथि उल्लिखित कोलम्बिया सन्धी अन्र्तगत क्यानाडाले उत्पादित थप क्षमताको बिजुली बापत यसरी थप उत्पादन भएको बिजुलीको आधा प्राप्त गरेको छ । उदाहरणको लागि पश्चिम सेती आयोजनामा जलाशय नबनाएको भए १०० मेगावाट क्षमताको मात्र आयोजना निर्माण हुनेमा जलाशयको कारणले ६५० मेगावाट थप उत्पादन हुने क्षमताको आधा अर्थात ३२५ मेगावाट नेपालले निशुल्क प्राप्त गर्ने व्यवस्था प्रस्तुत मस्यौदा ऐनमा गरिन वान्छनिय छ ।

मस्यौदा "नेपाल बिद्युत नियमन आयोग ऐन २०६५" मा अत्यावश्यक सुधार

सरकारले नेपाल बिद्युत नियमन आयोग ऐन २०६५ जारी गर्ने उद्देश्यले संसदमा बिधेयक दर्ता गरेको समाचारसंगै यस कलमजीविलाई बिधेयकको प्रति प्राप्त भएकोले गहन अध्ययन गर्दा निम्न सुधारहरु वांछनिय देखियोः

१. आयोगको गठन
(क) विधेयककोदफा ५ को उपदफा ६ मा सिफारिस समितिले अध्यक्षको हकमा ३ जना र सदस्यको हकमा रिक्त सदस्य संख्याको दोब्बर हुने गरी सिफारिस गर्न पर्ने व्यवस्था छ । यो अवस्थामा सिफारिस गरिएका मध्येबाट छनौट हुने भन्ने कुरा अपारदर्शी ढंगले निर्णय हुने अवस्था श्रृजना गर्नु हो । तसर्थ सिफारिस समितिले आवश्यक संख्यामा मात्र सिफारिस गर्ने व्यवस्था हुनुपर्छ । बरु सिफारिस समितिको सिफारिस उपर कुनै बिबाद नआओस भन्ने समेत हेतुले सिफारिस समितिले निर्णय गर्नु अगावै सार्बजनिक सुनुवाईको कार्यक्रम गरेर यस्तो सुनुवाईबाट समेत सफल उम्मेदवारलाई मात्र छनौट गरेर सिफारिस गर्ने व्यवस्था गरिनुपर्छ ।

(ख) यस्तै दफा ५ कै उपदफा १ अनुसार एक जना अध्यक्ष र कम्तिमा एकजना महिला सहित चार जना सदस्य रहेको आयोग गठन गर्ने व्यवस्था छ भने ऐ उपदफा ६ मा "त्यसरी सिफारिस गर्दा सदस्यको हकमा दफा ६ बमोजिम प्रत्येक बिधाको लागि छुट्टाछुट्टै व्यक्ति सिफारिस गर्नु पर्नेछ" भन्ने व्यवस्था भएकोले चार जना सदस्य छुट्टाछुट्टै बिधाबाट सिफारिस गरेर नियुक्त गर्ने मनसाय देखिन्छ । तर दफा ५ मा दफा ६ बमोजिम छुट्टाछुट्टै बिधाका भनिए पनि दफा ६ भने कुन कुन बिधा भन्ने सम्बन्धमा मौन रहनाले के कुन बिधाबाट आवेदन मांग गर्ने र सिफारिस गर्ने भन्ने समेत अस्पष्ट छ । तसर्थ के कुन बिधाबाट चार सदस्य सिफारिस गरिने हो भन्ने कुरा प्रष्ट्याउन जरुरी छ ।

(ग) दफा ६ मा नैं अध्यक्ष र सदस्य पदको लागि योग्यता र अनुभव समान राखिएको छ । दफा २५ अनुसार "अध्यक्ष पूरा समय काम गर्ने प्रमुख पदाधिकारी" समेत हुने हुनाले निजको योग्यता र अनुभव सदस्यको भन्दा उच्च स्तरको हुनु पर्ने देखिन्छ ।

२. सेवा शर्त
दफा २५ को उपदफा ५ मा आयोगको "सेवा निबृत्त भएको एक वर्ष सम्म त्यस्तो अनुमतिपत्र प्राप्त व्यक्तिमा कुनै पनि रुपमा संलग्न हुन पाउने छैन" भन्ने व्यवस्था छ । तर दफा ७ को खण्ड ङ मा यही तप्काका संस्थामा संलग्न भई अलग भएको तिन वर्ष व्यतित नभएको व्यक्ति अयोग्य हुने प्रावधान छ ।
तुलनात्मक रुपमा हेर्दा आयोगबाट अलग भएको तिन वर्ष सम्म यस्ता संस्थामा संलग्न हुन नपाउने व्यवस्था हुन वान्छनिय छ । किनभने आयोगमा बसेर निर्णय गर्ने अनि एक वर्ष कुरेर लाभान्वित भएको संस्थाबाट शुभलाभ गर्ने सम्भावना हुन्छ ।

३. प्राविधिक व्यवस्थापन गर्ने
(क) दफा १२ ङ मा गि्रड संहिता बितरण संहिता वा अन्य सम्बन्धित कागजात स्वीकृत गर्ने व्यवस्था भएकोले कुनै एउटा उत्पादक÷प्रसारक÷वितरकले पेस गरेको सम्बन्धित संहितालाई आयोगले स्वीकृत गर्ने भन्ने बुझिन्छ । तर देशमा एक भन्दा धेरै उत्पादक÷प्रसारक÷वितरक हुन सक्ने हुनाले एकरुपता समेतको समस्या पर्न सक्ने हुनाले आयोग आफैले गि्रड संहिता वितरण संहिता वा अन्य सम्बन्धित कागजात तैयार गरि लागू गर्न वान्छनिय छ ।

(ख) दफा १२ च मा "लागत बिस्तार" बाक्याँस लेखिएको छ जुन सम्बन्धित बिषय सँग मेल खांदैन । सन्दर्भ बिचार गर्दा "क्षमता बिस्तार" भन्ने वाक्यांश उपयुक्त हुने देखिन्छ ।

४. आयोगको सचिव
दफा २७ २ अनुसार "आयोगको प्रशासकीय प्रमुखको रुपमा सचिव रहने" व्यवस्था छ । तर सोही दफाको उपदफा ३ मा तोकिएको योग्यता भने अध्यक्ष वा सदस्यको लागि आवश्यक जत्तिकै छ जुन औचित्यपूर्ण छैन ।

५. कोष तथा लेखापरीक्षण
दफा २९ ९घ अनुसार वितरण अनुमति प्राप्त संस्थाबाट कुल आयको बढीमा एक प्रतिशतका दरले रकम प्राप्त गरेर आयोगको कोषमा जम्मा गर्ने व्यवस्था छ । तर स्वतन्त्र बिद्युत उत्पादकले उत्पादन गरेको बिजुलीमा पनि प्राधिकरणले १ प्रतिशतका दरले तिर्न पर्ने हुन जाने हुनाले प्राधिकरण प्रति यो व्यवस्था अन्यायपूर्ण छ । तर उत्पादन अनुमति प्राप्त संस्थाबाट यो रकम उठाउने गर्दा उपयुक्त एवम् न्यायोचित हुने देखिन्छ ।
